Blagojevich Sentencing Hearing Begins, Prosecutors Want Ex-Governor To Get 15 To 20 Years (VIDEO, LIVE BLOG)

CHICAGO — After all his claims of innocence and facing years in prison, Rod Blagojevich let his lawyers make an admission that he has so far avoided – that he is, in fact, guilty of public corruption.

The former Illinois governor will get a chance to do the same Wednesday, when he is scheduled to address the judge who will decide his sentence.

Judge James Zagel signaled Tuesday he may be prepared to impose a stiff prison sentence, saying he thinks Blagojevich lied when he told jurors he never tried to sell or trade an appointment to President Barack Obama's vacated Senate seat for campaign cash or a top job.

Throughout the first day of his two-day sentencing hearing, the impeached executive-turned-reality TV star known for his jocular personality was somber and ill-at-ease, staring down at the floor. His wife sobbed as a letter from their daughter was read begging Zagel not to send Blagojevich to prison.

The hearing was a stark contrast to the circus atmosphere around Blagojevich's trials on multiple counts of corruption.

The conciliatory tone came as something of a surprise – just days after defense filings that, as many times before, stridently declared Blagojevich's innocence and said he had been duped by aides but never intended to cross any lines into illegality.

Attorney Sheldon Sorosky told Zagel it was illegal for Blagojevich to ask for a job for himself in exchange for naming Obama's replacement in the Senate.

"There's no doubt this is a crime to do this in relation to the Senate seat, we accept that," he said. "I am just saying that does not call for a 15- to 20-year jail" term as prosecutors have requested.

Sorosky made the same argument when he talked about the other crimes for which Blagojevich was convicted: shaking down a racetrack executive and a hospital executive, as well as lying to the FBI.

At Tuesday's hearing, Blagojevich ringed his hands and pulled nervously at his fingers, pausing occasionally to sip on a plastic bottle of Cherry Coke. Legal experts believe Blagojevich needs to express remorse for his actions when addressing the judge Wednesday.

Zagel, who has said he'll pronounce a sentence Wednesday, said early on during Tuesday's hearing that Blagojevich was clearly the ringleader of the schemes for which he was convicted and that he lied about his actions on the witness stand. The judge made it clear he did not believe a suggestion made by defense attorneys that Blagojevich was duped by aides and advisers.

"There is no question from his tone of voice that he was demanding," Zagel said of Blagojevich's comments on phone conversations secretly recorded by the FBI. "His role as leader is clearly shown by his actions."

And in a harsh assessment of Blagojevich's performance on the witness stand, Zagel said the former governor was lying when he testified that he planned to appoint the state's attorney general to Obama's seat in a political deal that is legal.

"I think this is untrue," Zagel said. "I thought it was untrue when he said it and I think it is still untrue."

Defense attorney Aaron Goldstein pleaded with the judge not to impose a lengthy prison sentence – not for Blagojevich's sake, but for that of his family. In an emotional few minutes before proceedings ended for the day, Goldstein said locking Blagojevich up for a long time would devastate his wife and two daughters.

When Goldstein began reading a letter to the judge from Blagojevich's older daughter, 15-year-old Amy, the former governor suddenly seemed to fight to maintain his composure, fidgeting with a pen, biting on his lip. An attorney turned to gently pat his shoulder.

Amy wrote that she needs her father for all the things that will happen in her life – graduation from high school, applying to college and when her heart gets broken. In another letter, Blagojevich's wife, Patti, asked Zagel to "please be merciful" and said the punishment her husband fears the most is not seeing his daughters grow up.

Zagel seemed engaged in what Goldstein was saying as he described Blagojevich as a father. Patti Blagojevich began sobbing, tears streaming down her cheeks, then dabbing her reddened face with a tissue. She closed her eyes tight, tears still rolling down her face, when Goldstein played a tape recording of a giddy Blagojevich calling his younger daughter, who is now 8, and putting on a high baby-like voice, saying "Hey Annie!"

A second defense attorney told the judge that Illinois history of political corruption shouldn't count against Blagojevich. Carolyn Gurland said it would be unfair to Blagojevich for Zagel to impose a tougher sentence because other Illinois politicians, including former Gov. George Ryan and U.S. Rep. Dan Rostenkowski, have been sent to prison for corruption.

"The law is clear that he should not be punished because of the history of corruption in Illinois," she said.

If Blagojevich gets the 15 to 20 years in prison, she said, he would become the most severely punished public official in state history.

Prosecutors say the twice-elected governor not only shirked all responsibility for his crimes but repeatedly thumbed his nose at the U.S. justice system. Blagojevich's attorneys have said he has already paid a price in public ridicule and financial ruin, and propose a term of just a few years.

Gurland also argued that Zagel should take into account the fact that Blagojevich did not "receive a single penny" in ill-gotten gains, unlike other politicians convicted of public corruption.

"Rod Blagojevich received nothing," she said, adding that Blagojevich was doing what politicians do by seeking campaign contributions and not "money stuffed into envelopes."

Blagojevich and his wife knew they were setting themselves up for ridicule by appearing on reality television shows, she said, but they did so to provide for their children. Blagojevich appeared on "Celebrity Apprentice," where he struggled to use a cellphone, and his wife ate a tarantula on the reality show, "I'm a Celebrity...Get Me Out of Here!"

Blagojevich's sentencing comes just days before his 55th birthday and three years to the week of his Dec. 9, 2008, arrest. The jury deadlocked in his first trial, agreeing on just one of 24 counts – that Blagojevich lied to the FBI. Jurors at his retrial convicted him on 17 of 20 counts, including bribery.

Among the court attendees Tuesday were more than a dozen jurors from both of Blagojevich's trials, including both foremen.

After sentencing, Zagel will likely give Blagojevich weeks before he must report to prison. Once there, the man heard scoffing on FBI wiretaps about earning a low six-figure salary would have to take a prison job – possibly scrubbing toilets – at just 12 cents an hour.

As the former governor's sentencing hearing got underway Tuesday, Judge James Zagel gave several indications that he was siding with prosecutors and that the defense's arguments were falling on deaf ears.

"Mr. Blagojevich received nothing... and was never going to receive anything," said defense attorney Carolyn Gurland, insisting that it was Blagojevich's advisors who were the real manipulators of any wrongdoing.

But Zagel wasn't buying it.

"I don't think he was an easy man to stop," Zagel declared. "It is absured to contend that his staff and advisors. would have devised schemes that would have benefitted only him."

As defense attorneys tell the judge about Blagojevich's devotion to his family, his wife Patti was visibly upset.

The Chicago Sun-Times reports:

Patti's giving somebody with prosecutors the stink eye. Her sister is trying to calm her down, arm around her shoulder and shushing her.

Mrs. Blagojevich is using tissues.

Rod Blagojevich spots his wife looking sad.

"Y'alright?" he asks her. "What's the matter?"

He leans in pats her cheek and gives her an audible kiss.

Its a shame to see Blagojevich going to prison for doing what Senators and Congressmen do every day. I am not saying that what Blagojevich did is right,but what is wrong is that if he were a Senator or a Congressman their wouldn't have ever been any charges brought against him. If Blagojevich had arranged for a lobbyist to handle the appointment of Obamas old job, would that be illegal? He should go to prison and so should a lot of other people, we can thank lobbyists for our jobs going to other countries, the price of fuel,tax cuts for the wealthy, and a host of other bills that have done the American people no good, but made some politicians very wealthy.And if something isn't done soon to get these people who sell their votes for money out of office we all are going to continue to see our country shipped across the pond. Soon we will be Mexico and China and India and be renamed the New United States, land of poverty.

Finally, FINALLY, this public Chicago embarassment will be over. I hope Judge Zagel is not leinent in his sentence of this idiot to jail. Based on Blagojevichs activity over the last few years I don't think anything wil get through Rod's thick skull other than the maximum sentence. Too bad for the daughters. Their mother is a jerk also.

What are all you going to do when Sanduski gets half the sentance Blago gets? U going to scream and cry foul? Whats going to happen is Blago is going to goto jail for ALONG time. The guy who rapped little boys Jerry Sanduski isnt even going to serve half of what Blago does. So think about that next time you wanna say the judical system in this country is fair. These are the only WELL KNOWN cases I am sure there are other ones U havent heard about. Keep that in mind though next time u wanna judge people. Because I am pretty sure all of you would wanna see Sanduski goto jail longer then Blago....

I just spent the weekend in jail in a 7 x 9 cell for a couple traffic tickets that fines totaled 225 dollars. I spent 15 hours alone before I got a cellmate. I became frighteningly depressed in few minutes . My anger turned inward. I thought I was an idiot for overlooking a court date. I later got a cellmate who had spent six years in prison. His life had been destroyed. I asked him if you ever get use to prison and he said no. You just try to sleep through it. I once spent two weeks in jail. We are one of the sickest cultures in the world if not the sickest. We have over a million people who are incarcerated in our prison system and this does not count the countless people who are stuck in our jails for no other reason than to keep the jail filled so they can collect government funds. Our justice system mainly targets young men who have yet to get control of their hormones or impulses. The social isolation of prison not only destroys the inmate, it destroys the family. Blago should get no time. Those of you who don't agree with me are abusers who gain satisfaction from punishing others. And this goes for the egotistical cold-hearted persecutors who are trying to advance their careers. The harsh reality of being exposed to the cruelty of our system leaves me feeling hopeless and fearful. Sadly, I can change nothing.

You can write. And you have touched on a subject that hits very close to home but one which nobody talks about. Any idea how many Americans owe money on outstanding tickets but buy food for their families or pay the rent or mortgage when forced to make the choice? Then a warrant for arrest is issued following nonpayment, the driver's license is suspended, and if you are stopped by a cop you are arrested and pulled in. There are probably millions of people living out on the edge just like you. It is how local police help keep communities afraid. Keep writing and write local legal aid offices and ask for help. I'm going to follow you.

It's kinda funny some post here say 15 to 20 is way to long, some say it is not enough.So the people of Illinois, listened to, voted for and TRUSTED to be HONEST,and uphold the laws of the State and Nation of the United States of America. and he broke all of the above. so yes send him up for the maximum sentance, then maybe just maybe others will think twice about breaking the Trust of the people.

For infomation NO i have not broken trust, for I was taught that a man or womans word , defines who they are. in other word if your word is no good your not either. and yes there are others, and as soon as they are found out the hammer should be dropped on them as well.

I am figuring Steve51517 isn't a politian, sworn to oath when he gets the job.

He paid the price for illegal actions. Now he has to face the consequences of those actions. It is a very easy concept we all seem to ignore. His family, my heart goes out to.

Guess we have to start sending the message out. All crooked pol. should also be voted out of their positions and/or also have legal actions taken against them. That would be how we clean house, so we can finally have the representation we want and need.

Do I think he's guilty? Yes. But 15 to 20 years? Hell no! While what he did might have been "very" wrong, a couple years in prison is very "horrible". 2 years is enough time. I might be very wrong, but that's my opinion.

8 years in prison he should get. 2 years of hell he has already been through. 2 years of prison is nothing ans will set a dangerous precedents for the hundreds of thousands of immoral corrupt american citizens who will in the future find themselves in positions of power. What's 2 years of comfortable life in prison when you have stashed a few millions in a bank account eh?
Too bad he is the only one going, and not followed by the likes of Bush, Cheney, Paulsen, Bernacke among other distinguished americans.
