Richard Cordray Nomination Blocked By Senate Republicans, Obama Hints At Recess Appointment (UPDATE)

WASHINGTON -- Senate Republicans on Thursday blocked an effort to put someone in charge at the Consumer Financial Protection Bureau, a move that prevents the newly formed agency from supervising some of the same nonbank entities that triggered the financial crisis.

The Senate voted 53 to 45 to reject a procedural motion to begin debate on confirming Richard Cordray as the CFPB director. The motion required 60 votes to pass. Sen. Scott Brown (R-Mass.) was the lone Republican to side with Democrats in seeking to begin debate.

Update: 12:20 p.m. -- Moments later, President Barack Obama responded with a veiled threat to install his nominee by recess appointment. Speaking to the press after the vote, he said it makes "absolutely no sense" for Republicans to block Cordray given his credentials and the fact that many of them actually would support him if not for their opposition to the structure of the agency itself.

Asked directly if he would consider a recess appointment of Cordray once the Senate adjourns, Obama said only, "I will not take any options off the table."

The failed vote was no surprise. Republicans have been vowing for months to oppose Cordray's confirmation -- or any nominee's confirmation -- until key changes are made at the agency. Among their demands: eliminating the director's position, creating an oversight board instead, and requiring the agency to get congressional approval of its budget versus permitting it to draw funds from the Federal Reserve. The CFPB, the brainchild of Harvard law professor and now-Massachusetts Senate candidate Elizabeth Warren, was created under last year's Dodd-Frank financial reform legislation.

Democrats argue that Republicans' real aim is to undermine the agency's work altogether.

"In other words, to protect their Wall Street friends, they're not going to allow a director to be in place unless you weaken this agency," said Sen. Sherrod Brown (D-Ohio), who sits on the Senate Banking, Housing and Urban Affairs Committee. Republicans are "almost always flacking for Wall Street. It never ceases to amaze me," he added.

"This is the first time in Senate history a party has blocked a qualified candidate solely because they disagree with the existence of the agency," said Senate Majority Leader Harry Reid (D-Nev.). "Republicans are doing this to undermine the system of law we have in our country."

Republicans denied they were trying to stymie the agency. Instead, they said they were pushing for more transparency and accountability.

"This notion we are against consumer protection, that we're trying to gut CFPB, is just silly," said Sen. David Vitter (R-La.), also a member of the banking committee. "We want these three very important reforms."

"Democrats are using the Senate floor this week to stage a little political theater. They're setting up a vote they know will fail so they can act shocked about it later," said Senate Minority Leader Mitch McConnell (R-Ky.). "Until this or any other president addresses these very legitimate concerns, we cannot and will not support a nominee."

Raj Date, special advisor to the Secretary of the Treasury at CFPB, called Cordray an "exceptional leader" and praised his work at the bureau thus far.

"I have the great privilege of working with Rich every day," said Date. "The CFPB is already hard at work, helping to fix broken consumer financial markets. But without a director, we are only able to supervise banks, not any of the nonbank companies that were responsible for many of the most problematic products and practices leading up to the financial crisis."

The White House launched an unusually aggressive public relations campaign this week in a last-ditch effort to pressure GOP senators into changing their minds. State attorneys general and mayors from around the country wrote letters and held press events to urge the Senate to confirm Cordray, who was formerly the Ohio attorney general. Senior administration officials did interviews on local television stations in seven targeted states, and President Barack Obama even gave special interviews to reporters from those states to press for confirmation of his nominee.

Deputy Treasury Secretary Neal Wolin briefed reporters on Wednesday on how the lack of a director hampers the agency.

"Without a director, the CFPB cannot oversee payday lenders, private student loan providers and other nonbank lenders, including certain mortgage originators and servicers, as well as debt collectors and credit reporting agencies," Wolin said. "This nonbank sector has been the source of some of the most harmful, deceptive, unfair and predatory lending practices. And until a director is confirmed, these institutions will operate without supervision and oversight, just like before the crisis."

It remains to be seen whether the White House will now opt for Plan B, a recess appointment. Wolin ducked the question during Wednesday's briefing.

"Let's see what happens," he said. "But it's not for me here today to announce what comes thereafter."

The Obama can recess appoint everyone he wants.

Obama KNEW FIVE MONTHS ago, about the request for re-structuring of the agency that his nominee was to serve.

With all the problems with the Federal Reserve - and lack of oversight, Obama wanted the Federal Reserve to handle the purse strings - instead of Congress.

The spending of our US taxpayer money - goes through Congress.

Why should Congress accept Obama subverting their authority - in these matters - to be no different than Obama subverting the authority of Congress - to make use of US military action in Libya - without the knowledge or consent of our US Congress.

Obama "pretending" he is blind-sided - by having his nominee opposed - is more than disingenuous.

Obama chose to go on vacations and play golf - and ignore the letter sent to the WH - five months ago - requesting a meeting with him about these matters.

Remember the deal Repugs made with Democrats during Bush's term? Dems threatened a fillabuster against one of Bush's appointments and a deal was made allowing Bush to have his appointment and the fillabuster would be used only on rare occasions? This allowed Bush to go forward with his appointment.

Now Repugs have broken the agreement and fillabustered about 100% more times than any other in history. This latest is blocking the implementation of a legally authorized agency of the government by a minority at the pleasure of the Repugs who agreed not to do this when they wanted their appointment.

Time for the nuclear option and let the cards fall where they may especially if Obama is re-elected but now would be better. Our government is the Government of the People and Repugs have fillabustered the US to a standstill to serve the wealthiest ONE PERCENT. Why is it always the Repugs that do this stuff?

Democrats for years have said they care---yeah, for themselves. It was during the Clinton years, Janet Reno and Bill redlined the mortgage situation and started the ball rolling for everyone to have a home, even if they couldn't pay for it. Republicans continue to openly fight against consumers. By opposing Consumer Financial Protection Bureau, they're making it clear whose interest they serve. Shame on us, the voters for allowing politicians, particularly Republicans to do something like this and get away with it.

Obama does another recess appointment...just another example of him circumventing the democratic process...desperation is setting in the closer and closer we get to Nov 2012...I only hope our nation can survive for another 13 months...I'm getting the feeling the fringe liberal kook democrats are not going to go quietly into the night...once they learn they are back in the minority Nov 2012, the far left loons may purposely kick off "the scorched earth" policy and sabotage our government in any way possible to make the Republican job even harder to bring our nation back from the brink of collapase....

Sure...my thoughts are...the more socialist type actions he takes, the easier it will be to show he perfers Dictatorship over a Republic style of government...just adds more evidence to his actions he already taken....suing the State of Arizonia over illegal immigration...not defending DOMA...backdoor "reconciliation process" in Democratic control Congess to ram the PPACA law down the throats of American's that wanted more time to study the 2,000 plus pages of the law...giving Brazil a 2 Billion dollar loan from the US Export-Import Bank to help with their off-shore drilling...ignoring the "War Powers Act" during the Libya conflict even though it is non-binding...I strongly believe Pres. Obama considers the US constitution and other US laws he doesn't support as just guidelines...that he can ignore when they conflict this his liberal idealogy...in other words, President Obama has shown on a number of ocassions that he is above the law....to include many in his administration....ie. Eric Holder and the "Fast and Furious" operation is a prime example

I used to think term limits were a reasonable idea mostly based on the idea that politicians were just making themselves rich off their offices and living too good proving government was not.

Then I matured and began to appreciate legistating the the government of the United States in competition with all the world required a lot of EXPERIENCE and talent and ability. Goverments are not bad or the enemy of successful nations just the opposite. Repugs are stay the same, no evolution or progressing toward the future. Government fail when Repugs are in charge............please ref. G.W. Bush (the little bush)

Cute how your list seems to favor dismissal of Democrats, LOL. My list would just get to it and list ONE. THE GOP ONCE AND FOR ALL. What have the Repugs done for the US in say the last TEN YEARs except brought US the Second DEPRESSION while making less than ONE PERCENT Rich at the expense of the other Ninety Nine Percent?

Term Limits on the Repugs for say TEN Years just to see what this great Country can really be. Let the hard work of average Americans create the wealth and use it for the good of all Americans in educatioin and healthcare and anything but MORE WARS..............IMHO, LOL
