Wisconsin Voter ID Law Hit With First Federal Court Challenge

WASHINGTON -- Civil rights groups filed a third lawsuit against Wisconsin's controversial voter ID law on Tuesday, launching the first federal challenge to new voter ID requirements enacted in multiple states this year.

The National Law Center on Homelessness & Poverty, the American Civil Liberties Union, and the ACLU of Wisconsin filed their lawsuit in the U.S. District Court in Milwaukee against a new state statute requiring citizens to present photo identification to vote.

Lawsuits have already been filed by the League of Women Voters of Wisconsin Education Network and by the Milwaukee branch of the National Association for the Advancement of Colored People. The latest lawsuit bypasses the Wisconsin courts to make a direct federal challenge to the law, which mirrors laws passed in six other states this year.

"This lawsuit is the opening act in what will be a long struggle to undo the damage done to the right to vote by strict photo ID laws and other voter suppression measures," said Jon Sherman, a lawyer with the ACLU Voting Rights Project, in a statement.

The lawsuit argues that the Wisconsin law violates the 14th and 24th amendments to the Constitution and effectively serves as a poll tax, because people have to pay to obtain a photo ID. The groups bringing the suit point to the $20 cost of obtaining a certified birth certificate in Wisconsin as an undue burden.

This is also the first suit against the voter ID requirements filed by homeless advocates, who contend the law disproportionately places a burden on homeless persons.

"It's crucial their right to vote is protected, since this is one of the few ways they can impact the political process and make their voices heard," said Heather Johnson, a lawyer for the National Law Center on Homelessness & Poverty working on the case.

According to Johnson, the Wisconsin law allows people to prove their residency with utility bills, pay stubs and mortgage documents, but specifically disallows Internet service bills, rental leases and homeless shelter verification as proof of residency. She said many more forms were accepted as proof of Wisconsin residency before the voter ID law passed.

The ACLU has been actively opposing the slew of new voter ID legislation enacted in recent years. The group submitted comment letters to the U.S. Department of Justice regarding laws in South Carolina and Texas and intervened in court cases in North Carolina, Alabama, Arizona and Georgia. Thirteen states currently have a photo ID requirement to vote; another 16 have a non-photo ID requirement.

The first election covered by Wisconsin's law will be the state's primary contest on Feb. 21, 2012. The latest suit was filed on behalf of 17 eligible voters.

One is Carl Ellis, a 52-year-old Army veteran living in a shelter who cannot use his veteran ID card to prove residency under the new law. Another is Ruthelle Frank, 84, who was born at home in 1927 and does not have a birth certificate.

"I have exercised my right to vote in every election since 1948," Frank said in a release. "I should not suddenly be barred from voting just because I don't believe in paying for identification in order to vote. That's like a poll tax and sends this country back decades ago when it comes to civil rights."

The lawsuit comes on the same day that U.S. Attorney General Eric Holder is giving a speech in Texas on voting requirements, expressing concern about the effort to "exclude people from being involved." Holder is speaking at the Lyndon Johnson Presidential Library, named for the president who signed the Voting Rights Act of 1965.

A voting laws study by New York University School of Law's Brennan Center for Justice looked at 19 statutes and two executive orders in 14 states and concluded that they could make it more difficult or more costly for up to five million citizens to vote. Although proponents of voter ID laws say the legislation is needed to prevent voter fraud, the Justice Department has found next to no evidence of such widespread fraud. And more than 10 percent of U.S. citizens lack the kind of photo ID required by these laws.

Wisconsin Gov. Scott Walker (R) signed the voter ID bill into law in May. The Republican-controlled legislature had passed the law before the summer's recall elections while they still had a solid majority in the state Senate.

Now for those applying for driver license IDs it will take you weeks to get it instead of getting it on the same day. Wisconsin has subcontracted with a California firm that will mail your photo ID weeks later.

I am Latino and I have an ID. I vote and show it every time. I would be livid if I showed up and someone else voted in my place. I fully support having an ID to vote. It is bologna to say that voters won't vote because they can't afford or want to get an idea. Get real liberals, you are required to have an ID for everything in this country. Voting is a right that must be protected from fraud. Democrats are just using this as a cover for losing the 2012 Elections. MSDNC and HP love to hype this issue every time they can! SAD!

So, she could get ID but is too cheap. A voting ID is free at the DMV, but don't let the facts get in the way.

The DMV is problematic for many. In Wisconsin they have limited hours an sparse locations.

In Wisconsin... DMV office hours have been cut. DMV offices have been closed. Some DMV offices are still open the same number of hours each week except instead of maybe a Mon-Wed-Fri 6 hours a day schedule it reverts to a Mon-Tues 9 hour day schedule. They claim hours were not cut. They weren't. The number of days were cut. If you do get to the DMV it costs $28 UNLESS you ask for it to be free. You need to know that otherwise it will cost you and the DMV personnel are not allowed to tell you it is free for the asking.

The Supreme Court will uphold the validity of the law.

Why? Because it is as legal as it is needed.

You need a valid photo ID to:

- Drive a car
- Cash a check
- Sign up for welfare benefits
- Rent a DVD
- Buy alcohol
- Buy cigarettes
- Enter a bar
- Rent a car
- Board a plane
- Get a library card

If it is legal to make those requirements before you can do or receive something, then there is nothing to legally prevent this law from going into effect.

If between now and Nov. 2012 you can't find your way to your courthouse with a utility bill or phone bill to get a FREE gov't approved photo ID, then it is your own fault you are unable to vote.

Deal with it.

The first right of every citizen here whether they go to a library,drive a car, collect welfare, buy, rent, fly or cash. First, voter ID is different from all the other things you listed for one main reason: none of the things in your list are constitutionally protected rights. Voting is. And anything prohibiting or limiting your voting rights is unconstitutional.

Second, in most states where voter ID laws have been passed, it requires more than a utility bill or phone bill. Most require that you have a birth certificate. And if you don't have a birth certificate, you have to buy one. Hence why it's a poll tax.

And third, the IDs aren't free. As I mentioned above, to get an ID, you need a copy of your birth certificate, which, depending on the state you live in, can cost anywhere from $15-$45. And if you happen to be a married female, you also need a copy of your marriage certificate if you legally changed your name once married.

Don't forget the corporations that don't lower cost to match jobs. Here they're intentions are obvious. They Americans to accept third world pay for their profit margin. I have a Patriot Act for you. I live in Texas. There are plenty of firemen and police men. In fact, my nephew just started the police academy here in Houston. I have a great job with one of those "evil" corporations that makes a profit. I have no problem showing my ID when I vote because I have nothing to hide. I live within the laws of this country as do most Americans. The only people not wanting to show their ID's are the people who don't have ID's. You know, the illegals, the Donald Ducks and Mickey Mouses out there......the "people" that the Liberals KNOW will vote democrat.....

Well duh....it would be hard to show an ID if you dont' have one. By the way...the main groups of people in the US that do not have ID are the elderly, the disabled, and college students. I wonder why you'd be opposed to those groups being able to vote? Now THAT is the real question. Well, that and why are you in support of a law that completely violates the Constitution?

Facts are tough to fake, but you can try.
It was uncomfortable watching the other lefty panelists try to out-smarm each other by beating Costa over the head with a new Brennan Center for Justice report that purportedly shows vote fraud to be nonexistent. The report points out that a minuscule 0.0002 percent of votes cast in Wisconsin in 2004 were “fraudulent,” each one resulting from an ineligible felon having voted.

Stop it, that ONE unproven ALLEGATION had to do with Obama and Clinton getting on the ballot not the actual election. And it only involved about 176 votes not like 1.7 million votes in Florida that Bush stole from Gore with the help of the Supreme Court. Last time I checked, Obama didnt win the election by 176 votes. I think it unlikely that a federal court would overrule a Supreme Court precedent.
