Obama Health Care Law: Supreme Court Sets Dates To Hear Oral Arguments

Obama Health Care Supreme Court

First Posted: 12/19/2011 11:05 am Updated: 02/18/2012 4:12 am

WASHINGTON -- March madness is coming to the Supreme Court next year. The justices have designated three days, March 26 to March 28, as the oral argument dates for the health care cases.

The Court agreed to hear the challenges to the Affordable Care Act in November, setting aside an extraordinary five and a half hours for oral argument.

The main event will be on Tuesday, March 27, when the Court will take up the constitutionality of the health care law's minimum coverage requirement. That provision, commonly called the individual mandate, requires virtually all Americans to purchase health insurance or pay a penalty. The Court has set aside two hours for argument over whether Congress' passage of the individual mandate exceeded the legislature's powers to regulate interstate commerce or lay and collect taxes under Article I of the Constitution.

On Monday, March 26, the Court will hear an hour of argument over whether a Reconstruction-era federal statute, the Anti-Injunction Act, bars the justices from making a decision on the individual mandate's constitutionality until after the provision goes into effect in 2014.

The Court will consider two additional issues on Wednesday, March 28. Ninety minutes will be dedicated to whether the individual mandate is so central to the health care overhaul that the entire law must fall should the justices find the mandate itself unconstitutional. An additional hour of argument will address 26 states' claim that the law improperly expands Medicaid by coercively conditioning states' receipt of federal funds on their participation in the new health care exchange system.

These three days of oral argument will occur almost exactly two years after President Barack Obama signed the Affordable Care Act, sparking a slew of lawsuits across the country.

The four courts of appeals to consider the issues now before the Supreme Court have split on the constitutionality of the individual mandate and the application of the Anti-Injunction Act, but have all rejected the challengers' arguments about state coercion and the centrality of the individual mandate.

The justices' decision in the health care cases will likely come down at the end of June.

Medicare For All is the only logical way to go. ALL for Profit Systems will eventually Fail. 50 Million Americans without Health Care is a Disgrace. There are currently 35 Million Americans covered by Medicare Single Payer, Millions More are enrolled in Medicaid Single Payer, Millions of Military Retirees are insured by Tricare Single Payer, add to that the VA, Government Employees, the Military, Teachers, Police, etc. and it quickly adds that currently a large piece of American Health Care is already Government Administered. To Merge all systems into one and have One Single Payer System makes sense to everyone but the Wall Street Profiteers, making money on the Pain and Suffering of others.

So, if I can't pay for the individual mandate, will they pay for my healthcare?

Cost of undeclared Iraq war: $1.9 trillion. Cost of ObamaCare: $1.45 trillion. Give me one good reason to support the former and not the latter. The first cost kills thousands, the second gives people medical care. If you want any proof that we have a lot of twisted and warped minds in this country, look no further than the opposition to ObamaCare.

then single payer will be next since that is the plan with administrative limits.
04:47 PM on 12/20/2011
Not sure what the point is. This court has made it clear that listening to arguments in many cases is for the purpose of justifyding their pre-formed opinion, not to make a decision based on the arguments presented.. Another waste of time an energy. Not worth listening to.

I'm a perfect living example of President Obama's policies.....I have a job, I get my food for free, I have a place to live for free, I get free medical care..who am I...answer: A Chinese National being forced to work at a job I hate, living in a communal building...getting ration food and ration medical care, oh yeah, my dental care is free too...any cavities I get, are just extracted, no fuss, no muss...I get to go on a 2 week vacation once I get 50 more work credits...which should take me about 5 more years...plan on visiting my grand-mother in the northern province...if I get my travel permit approved in time..life is China is great...I could be in North Korea where people are starving to death..
09:29 AM on 12/23/2011
@art69z, so you can't form an intelligent argument about President Obama's policies so you pick the most outlandish example you can find that doesn't actually fit any facts. Well played sir, your distorting and twisting of the issue was masterfully done. Not only did you sidestep facts you distorted them and raised the specter of communism with out actually saying communism. Well done, your linguistic skills are only surpassed by your disregard for intelligent discourse and facts.

There is no argument with an person that has chosen to be delusional, facts have no bearing to them, neither has reason, they can spout rhetoric but the facts are simple something to be ignored, In a nation that fought a revolution to get away from the exploitation of the wealthy and monied class, and created a government that is suppose to promote the welfare of all of it's people, in no way shape or form promoted the idea that wealth and corporations well being came before the peoples

Here's what I do not understand. In my state, Minnesota, if you own a car you have to provide proof of insurance, and if you have a loan on the car you have to have full coverage. I think everyone should have to have basic health insurance, it would keep people out of the emergency rooms for everyday things like sore throats, etc. etc................... The simplest thing would be single payer. Try explaining that to the teabaggers. Oh, I forgot they think reading is for socialists.

I have a choice not to own a car. I can ride the bus, I can walk, I can ride my bike. If you can't understand this basic difference, then you can't be helped to understand why this is wrong. I think everyone should have premium health care, not just basic. Here is the difference, I don't even buy premium care for myself. Why should I pay for better care for you, than I pay for myself?
07:24 PM on 12/20/2011
Specious argument. The moment you want to drive you will need insurance. Also, every one goes for some medical needs whether it be routine or of necessity. Therefore, insurance should be required and as the law allows will be provided with assistance if you are not able to afford it. Back to you car argument ... if you can't afford the insurance ... there is no assistance.

I am already paying for poor people to go to the emergency room for their health care. Now you want me to pay for them, and have to stand in line behind them, for my care. The simple answer to single payer, is would you like your health care to be handled by the staff at the Dept of Motor Vehicles?
08:16 PM on 12/20/2011
You show a complete narrow mindedness and lack of understanding. The best medical care in the world is not provided by the USA. Countries that have single payer or socialized medicine all have better medical outcomes than the USA starting with infant mortality rates where the USA ranks last. In NZ a visit to the doctor cost me (a tourist) (US citizen) less than the luncheon for me and my partner with no wait or questions or reams of paperwork.

stupid and illiterate people are to expected they are so immune to intellect that for them it's something to despise, They cover themselves in childish and simpleminded responses, because as a child, they simple cannot address things that they cannot understand. Unfortunately on the right you couple that ignorance with the sickness of racism and you get that aberrant personality that post the stupidity that for them suffices as thought

This poorly written screed represents the worst kind of leftist balderdash. It is totally lacking in
any kind of rational argument as to the issue, and simply expresses derision towards those who do not agree.
I don't know enough about the 2000 pages of Obamacare to have an educated opinion on it.
I think it is important that its constitutionality be adjudicated soon. I trust that those arguing pro and con will be more rational than IFany.

If I continue to see post from the right decrying socialism, I think that we got to somehow stop the rate of functional illiteracy in this nation, Not one of them know what socialism is what it means and that this nation was founded on just that idea, the rate of ignorance by people that use the term as if it denotes something wrong is so prevalent on the right that one can only wonder just how knowledgeable these people are, about their government, their history, and themselves, since not a one of them has not benefited from the socialist ideals of this nation. it's still a fact that if you don't know anything that you can be led anywhere and told anything.

If six grader were to ask a republican what they had against schools, that the would want make creationism part of the curriculum, what would the supposedly intelligent Republican response would be, Or perhaps they would ask why do you think this nation is a christian nation, Or why why their daddy has no health care, or they won't be having Christmas, because will not be getting a unemployment check, and the mortgage is not paid. and now the child is homeless, How much education does it take to figure that the right wing is some of the dumbest people in this nation, with a superiority complex

If the court in any way, set to destroy health care reform in this nation it will be a death knell to the right wing in this nation for years to come, The Court has shown that it can no longer be seen as now driven by anything other than it's political views versus the LAW . It's decision to turn corporations into people is something that will always define that the right wing judges as just that, right wing judges, and not impartial as to the the law or reason. It's not a liberal view, it's a matter of logic and reason that depicts the court as being missing both of those key ingredients. And in recent ruling has practiced ideology instead of what the tenets of the court require. When the next congress comes into session, there are justices that should be facing serious question as to their financial reason for their ideology and their decisions, and the undue influences of spouses and money and perks have had.
