SAN FRANCISCO — The so-called birther movement was dealt another legal blow Thursday when a federal appeals court tossed out a lawsuit challenging President Barack Obama's U.S. citizenship and his eligibility to serve as commander in chief.

The 9th U.S. Circuit Court of Appeals ruled that none of the challengers had legal standing to file the lawsuit on Jan. 20, 2009, the day Obama was inaugurated. The three-judge panel cited various reasons for disqualifying six sets of plaintiffs, who included Obama's political rivals, taxpayers and military personnel.

The birther movement has filed multiple lawsuits over the issue, so far with no success. Its leaders have lost similar challenges before the U.S. Supreme Court and the California Supreme Court.

The U.S. Constitution says only "a natural born citizen" may serve as president. The challengers allege that Obama, whose father was Kenyan, was born in that African country, rather than the U.S. state of Hawaii. They claim his Hawaii birth certificate is a forgery.

The appeals court didn't address the authenticity of the birth certificate, instead ruling that the challengers couldn't show "concrete injury" from the allegations.

The taxpayers listed in the lawsuit, for instance, failed to show how the citizenship question affected any federal taxing and spending provisions.

The lawsuit was filed in 2009 by 40 plaintiffs, including conservative activists Alan Keyes and Wiley Drake, who ran for president and vice president respectively as members of the American Independent Party against Obama in 2008.

They alleged they had standing to file a lawsuit because of their interest in competing in a fair election. Libertarian Party vice-presidential candidate Gail Lightfoot was also a plaintiff.

Judge Harry Pregerson, writing for the three-judge panel, said Keyes and Drake waited too long to file their lawsuit. The election was over and Obama was already sworn in when the lawsuit was filed.

"Once the 2008 election was over and the President sworn in, Keyes, Drake, and Lightfoot were no longer `candidates' for the 2008 general election," Pregerson wrote. "Plaintiffs' competitive interest in running against a qualified candidate had lapsed."

Orly Taitz, one of the challengers' lawyers, said she would ask the appeals court to convene a special 11-judge panel to reconsider the case. If she's turned down there, she said she would ask the U.S. Supreme Court to review the case.

Taitz said she has filed similar lawsuits in five states and has two other federal appeals pending in Washington, D.C.

If you are a serious birther that wants the law to be upheld, you should check out this article I just read that knocks a big hole iin your arguments because by law and the constitution Obama is a natural born citizen check it out its guaranteed to be on point no more B.S. FACE THE TRUTH

Sanity strikes again! These birthers are struck down over and over and as they continue to try to get a court, any court, to validate their insane claims, their funds (hopefully) get smaller and smaller. It's a bit like watching a staring contest: sooner or later, their eyes are gonna dry out and they'll have to blink.

Hawaii was a United States Territory when Obama was born there, so he is a native-born American. My mother was born in Alaska prior to Alaska's admission as a state, and she too is a native born American. Come to think of it, she'd descended from a tribe of Alaskan indians who were in Alaska before there was a United States. Maybe Alaska and Hawaii should have annexed the other 48 states.

America is growing up to be the country God intended for it to be. The bigots loss again. Thank God for human consciousness and decency. I just pray that does bigots does not take it out on their children by teaching them such hatred. When will it stop because evidence of this hatred still exist in this country capital. What the birther b.igots fail to grasp is that a "natural born American" simply means a citizen by birth (i.e. non-naturalized) since Obama's Mom was an American the citizenship of his father was irrelevant and he could have been born at the north or south pole and he would still be an American citizen BY BIRTH. As it was being born in Hawaii is "gravy" since it also means he has "birthright" citizenship since the US recognizes both claims to citizenship.

Yes but their new argument is that since Hawai'i wasn't a state for 10 years before his birth, therefore she could not have been "citizen enough" to make a "natural enough" baby citizen until August 1969.

It is uncharitable to be unkind on Christmas. But Orly Taitz just brings it out in me, and I am powerless to resist.

Does she not recognize that she has become a boil on the national bottom? Does she not see that she is embarrassing herself and tying up valuable court time on a quest that simply cannot be successful, primarily because she's simply wrong.

The Supreme Court has told her to get lost. Another federal judge threatened to fine her if she didn't stop suing, even after every court in the land, it seems, has ruled against her.

Reality, at some point, has to become the basis of the national political conversation or we're doomed as a nation. Orly Taitz, it seems, has never had a rational thought in all her life.

What I wonder about the most is who exactly is funding this ridiculous birther movement? Filing all these lawsuits cost money and I can't help but think that there are some very rich people, two well-known brothers come to mind, who are behind this.
