Tally one for the 99 percent. NBC Miami reports that Occupy Fort Lauderdale has been successful in thwarting the eviction of one Haitian family in Coconut Creek -- or at least buying them some time.

The Bien-Aime family of seven have been fighting with Wells Fargo bank, who they say are refusing to accept payments. Occupy Fort Lauderdale protestors set up a protest outside family's Coconut Creek home on Monday and received confirmation later that day that the eviction had been postponed. Read the full story on NBCMiami here.

Jeff Weinberger, a former Occupy Miami volunteer who now works with the one in Broward, was one of the protestors outside the Bien-Aime's home. He told HuffPost Miami there has even been some discussion about whether the bank will reverse their intent to evict entirely, saying the Bien-Aime's situation stood out as "particularly heinous" because "the family had done everything right, and they were still getting evicted."

When the Bien-Aimes reached out to Occupy Fort Lauderdale, Weinberger said, protestors accompanied the family to confront Wells Fargo officials at an Urban League-sponsored event last Thursday.

The family and Occupy protestors were initially turned away and the police were even called, he said. But as soon as NBC 5 in West Palm Beach started interviewing them, bank officials were suddenly open to a discussion.

The two-hour talk resulted in an eviction reprieve until January 3. But the Broward Sheriff's Office didn't get the memo and sent an eviction notice anyway, Weinberger said, prompting Occupy FTL to assemble on the Bien-Aime's yard.

Weinberger told HuffPost Miami that he thinks the chances that Wells Fargo will ultimately reverse their decision are only about 51%.

"The legal process is so corrupt, the only way we can fight it is through mass movements," he said.

Weinberger hopes any progress with the Bien-Aime family will have bearing on future cases in which families are unjustly evicted, and that other South Florida families threatened with foreclosure will make contact with Occupy Fort Lauderdale.

people always spend for today and cry tomorrow!learn to manange money, seperate your essentials from your non-essentials,and stop blaming lack of money on the goverment, high taxs and lack of a pay hike.this is for those that are guilty of the above and are paying the price for it now!do not spend beyound your means, the goverment is responsible for making employers pay you enough to cover your essentials (home, transportation, food, clothes, medical etc.) not the non-essentials (alchohal, drugs, video games,sports/concert tickets, fast food, and other addictions that drain your accounts)!!!!!

Beautiful story. I don't see too many 1%ers worried about possible homelessness, or actual homelessness as some groups around the country served food to the homeless on Christmas, including us in Occupy Amarillo.

When I was a kid, my depression era grandparents always told me that people living now were a lot more important than the dead presidents seemed to be worshipped by the rich.

I love it!
This kind of fight builds a coalition between OWS and communities under siege by the banking and finance mafia.

Foreclosures need to be stopped.

Occupy Fort Lauderdale marched 12/23/2011 with Mr. Bien-Aime, and we delivered a letter to two of Ft Lauderdale's Wells Fargo branches demanding the specifics be worked out to keep the family in their house. Both branches had heard we were coming and received the letters from Mr. Bien-Aime very politely. We'll see how/if they respond in the days to come...

Didn't Occupy just deposit 20,000. in the Oakland Wells Fargo?
10:03 PM on 12/22/2011
what does that have to do with people 10,000 miles away?
10:41 PM on 12/22/2011
Well, nothing, if they don't have the same beliefs.

What's your point?

The point is, OWS is hypocritical....

There are too many details missing. How did they get to the point of foreclosure? Did they stop making payments, what? It's one thing if the bank messed up, but another if they just didn't pay their mortgage. If I don't pay my mortgage I will get tossed out. They should be no different.

Better check your facts!!!!!!!

An OWS "protester" ALLEGES that the homeowner "had done everything right".

There is far more to this story than the biased spin presented by the media.

MANY banks have been shown to be just willy nilly foreclosing on homes, MrStat. I too don't know the "whole story," but I tend to believe the family DID do "all the right things."

MILLIONS of us did "all the right things," but there's still the fact that half of us are poor.

That's why so many are angry.

Something's wrong with this story and we're not getting the entire story. If the people were making the payments, why wouldn't the bank accept them? Something is not being reported.

I will be available to satisfy any of the naysayers. The Bienaime's fell behind on their 1st mortgage (Chase) and entered into a permanent loan modification to become current on the loan. Around a year after the 1st went into default and over a month after it was modified, the 2nd mortgage declared foreclosure and stopped accepting payments even though they never fell behind on the 2nd and were current on the 1st at the time as well. The bank continued to refuse to take payments INCLUDING AN OFFER TO PAY THE ENTIRE DEBT OFF ALL AT ONCE, $27,000 WORTH. the family made good faith negotiations all along on a debt they never fell behind on and the bank took them all the way to eviction on Monday until we stepped in.
You seem to have trouble understanding that the banks foreclosure on people for bull**** reasons ALL THE TIME!!!! Wake the **** up people!

What reason did the 2nd mortgage company give for not accepting the payments? There must be some explanation from them.

Good for Occupy. What could be more appropriate than occupying our own homes rather than some public park?
This is what our grandparents did during Great Depression, version 1.
