EL CAJON, Calif. — A child was charged with murder and felony assault in the fatal stabbing of a 12-year-old boy, authorities said Wednesday.

San Diego County district attorney's office spokesman Steve Walker declined to say if the defendant was the victim's 10-year-old neighbor who was taken into custody shortly after the stabbing. The neighbor is the only person who has been identified by homicide investigators as a suspect.

A detention hearing was scheduled for Thursday in juvenile court.

The 12-year-old died Monday, a little more than an hour after he was stabbed in the 10-year-old's driveway in a quiet, kid-friendly neighborhood in El Cajon, east of San Diego.

The victim slept at the boy's home for two nights before he was attacked at the end of the holiday weekend, said Cody Vales, a close friend of both boys. He said they were "like best buddies."

Vales, 16, said the 10-year-old appeared calmer since he began taking a new medication about three weeks ago, becoming "a new kid." He said the younger boy wasn't one to pick a fight but exploded when he felt provoked.

Vales said the boy once punched him in the face for accidentally bumping his pelvis when they were jumping on a trampoline. The boy threw a tantrum when he spilled a cup of water inside his house and was asked to clean up.

"If you pushed his buttons and cussed him out, he'd just lose it on you," Vales said.

The 10-year-old liked to play football and practice Muay Thai boxing and jujitsu, Vales said. He was muscular and a little short for his age.

The 10-year-old's adoptive mother, who lived with the boy and her father, was the only person who knew how to calm him, Vales said. She hugged him and reassured him that everything would be all right.

"The nicest woman you'd ever meet," Vales said. "If it was anybody else, they wouldn't be able to put up with (him)."

The victim's mother told U-T San Diego that she knew the 10-year-old and his mother well.

"Please don't make it out that he was this terrible human being," Lisa Carter told the newspaper. "He's not some monster."

The neighborhood in San Diego's foothills is one of modest, aging one-story homes on narrow, winding roads. The two boys played often with others at a playground clubhouse in the mobile home park where the victim lived. They sometimes pretended to be pirates.

It is unusual for children so young to kill. Law enforcement agencies reported 11 homicides nationwide by children 12 and younger in 2010 – the same number as in 2009 and 2008, according to FBI data.

James Alan Fox, a professor of criminology, law and public policy at Northeastern University in Boston, said that 1976 through 2010, 242 homicides were committed in the United States by children 10 and younger, according to his analysis of FBI statistics. Of those, 48 percent of victims were family, 20 percent were acquaintances and 8 percent were friends.

Fox said there are typically no telltale signs to predict such acts of violence.

"Overwhelmingly the most common element is just an argument," he said. "It's the same motivation why kids fight."

California requires that children be at least 14 to be charged as adults, said Shaun Martin, a University of San Diego law professor. State law allows children to be detained until they turn 25 if tried and convicted as juveniles.

I work with children who have mental and emotional issues and it seems to me that this 10 year old boy must have either one or both if he can stab his friend. Maybe he should not be in jail but he needs to be somewhere for treatment because he obviously can't control himself.

What video games have they been playing? So many games are so full of violence these days. Kids sometimes try to immitate these games. So sad things like this can't just be prevented by simply paying closer attention to your kids and what they're all about or up to.

I agree with you. Parents should know better and select appropriate games for their children.
Those violent games shouldn't be allowed on the market at all.Illegal item.

Videogames? Really?

How about a mentally unstable child who according to the article "exploded when he felt provoked" and "threw a tantrum when he spilled a cup of water inside his house and was asked to clean up."

The kid was apparently already broken, a ticking time bomb that was already on medicine.

Don't try and blame society or videogames or any other straw man for this tragedy.

Actually if you read the article closely. It does not say that the 10 year old did it. At this point; he is a suspect. It happened in his family's driveway. However, the 16 year old was present and who knows who else was there? Who's word is it that the 10 year old did the stabbing? The only real witness here sounds like the 16 year old. They are jumping on the 10 year old why? Because he has a condition that requires medication? I think there are alot of facts just being assumed here. Until there is alot more evidence to prove who the perpetrator of this "murder" was, I don't think that there should be any more finger pointing or commenting on the condition of the 10 year old, until it is somewhat proven that HE committed the crime.

Agreed. As I said before, we are only hearing what is coming out of a 16 year old's mouth whose best friends are 10 and 12. We don't know anything really other than a child was stabbed, a 16 year claims to have witnessed it ,another is on medication for an illness that we are not aware of nor we do know what type of medication he is on and the victim's mother is standing up for the 10 year old.

Of course he shouldn't be tried as an adult. A ten year old is simply not mature enough to think like an adult. It does appear that intensive inpatient treatment in a secure facility for children is needed. Hopefully, he can learn to control himself and function in society, but he shouldn't be released for a very long time.

One big thing that I don't understand about the Juvenile Justice System. How come they won't release the name nor picture of the accused, because he is a juvenile, but as in this case, the victim is a juvenile and his face and name is printed in the media. WHY??? what is the logic there???

Well it would seem out of place by seeing the neighborhood the video...but hearing the word "adopted" and judging from the short-fused "snap" nature of the attack, I wonder if it's tnb. That would be the most obvious reason to use the law to hide his name/face.

He is a SUSPECT he has not been accused - why are you so anxious to believe a story that is leaving most of the information out from the public?? Your like all the other "oh well this article said he is guilty or that he did it - so I beleive every word I read about it!!!" That is way the court system is all screwed up - you and others are very quick to judge LONG before evidence is rightly presented and established.

That in itself is pretty amazing. That has to be hard, but she knows more about
the 10 year old than any of us do, and she must know what his "problems" are.

I have two boys ages 8 and 9 and I just can't imagine having this happen to one of my boys. The thought of losing one of my children just makes me sick. I, personally, don't know if I could find forgiveness in my heart for the 10 year old who did this. It worries me that he is going to be around other children and one day, be an adult in our community. I can only imagine what kind of crimes he is going to commit between now and becoming an adult. The scary thing, there is nothing that can be done with him except try to medicate him and work with him......but at whose expense? Who else is going to suffer from the actions of this ill child soon to become an adult in our community?

Good question. I'm not sure honestly. I would be very, very scared for my child and myself. I know that I would constantly worry when he would be around others without being strictly supervised.

This is so sad that a beautiful young boy was killed by his best friend. But until we know more about the situation, we can't judge the 10 year old. He had a condition and just the fact that the mother of the victim understands that it wasn't a concious decision to kill Ryan; should really be taken into consideration by all. I agree that the 10 year old needs to receive some sort of punishment or treatment to prevent this sort of thing from happening again; but to be tried as an adult is not the answer. I'm from Florida, where they do try some children as adults and I don't believe it's a correct thing to do, considering the facts of the cases. First they need to decide whether the child is mature enough to realize the severity of the crime, then decide whether it was a concious decision of that child to commit the crime. Our children are being raised in an environment where chemicals are everywhere and we do not know what effect they are having on the brains of our young citizens. It is quite evident that SOMETHING is affecting the brains and lives of EVERYONE on this planet if you look at the rate of violence on this earth. My condolences to the family and friends of both the victim and everyone else involved in this tragedy.

Do we even know if this child has ADD/ADHD or any mental illness at all? What type of medication he is on and why? We are reading the words of a 16 year old who plays with children who are 6 years under him.. Maybe they were playing "pirates" as they were known to do and the kid accidentally stabbed the other child?

I am not blaming the meds. Medication has helped people in my family more than it has hurt. However taking medication at a young age can have certain side effects. I would question everything about this child. Something was wrong. What caused him to stabb his friend? JMO

There are kids in prison right now for doing things they wouldn't have done if they hadn't
been taking medication that wasn't meant to be taken by kids.

I guess it doesn't matter what your age is, if you're prescribed drugs for a mental condition and you don't take them, you can erupt in a violent way. I give the victim's mother a lot of credit for not calling the boy "a monster" even though he's responsible for her son's death. What now is the question for that 10 year old boy.

You can erupt in a violent way if you do take them. Do you ever listen to the TV ads for
medication? Do you hear the possible side effects? They're not kidding around. Medication
for adults that's given to kids is an experiment. Sometimes it doesn't go well.
Adults can flip out if they don't stop taking meds properly. A ten year old would be helpless
to explain what's happening in his head.

Because Muay Thai boxing and any martial arts are a strong teacher of self discipline. When studied and learned for the correct reasons, martial arts are very beneficial ! They ARE NOT just a tool to hurt other people. Sure they do teach you to defend yourself; but they also teach you the right time to use what you have learned.

I know it sounds crazy, but it helps to channel some of the pent up anger into something that is self controlling. You learn about how to control your body and your mind in those classes, and that is exactly what doctors suggest to do when you have those problems. Notice, please, that it was neither of these martial arts that ended up killing the boy, but a knife. It had nothing to do with those lessons.
