Justice Scalia On Unlimited Political Ads: Turn Off The TV

COLUMBIA, S.C. -- U.S. Supreme Court justice Antonin Scalia has a simple solution for people who don't like all the political advertisements unleashed by the court's decision two years ago that ended limits on corporate contributions in political campaigns – change the channel or turn off the TV.

Scalia was asked about the decision during a presentation before the South Carolina Bar on Saturday, exactly two years after the court handed down the 5-4 decision in the case that led to the rise of Super PACs. They are outside groups affiliated with candidates that can take in unlimited contributions as long as they don't directly coordinate with the candidate.

"I don't care who is doing the speech – the more the merrier," Scalia said. "People are not stupid. If they don't like it, they'll shut it off."

Scalia was joined on stage by Justice Stephen Breyer, who voted on the losing side in the decision which has become known as "Citizens United," for the group that successfully sued over federal campaign finance laws. Breyer didn't directly criticize the ruling, instead pointing out how it is critical in the American system that people respect the decisions the judiciary makes.

By nature, when a decision isn't unanimous, "somebody is making a mistake," Breyer said.

Breyer also briefly summarized both sides of the argument concentrating on his own.

"There are real problems when people want to spend lots of money on a candidate ... they'll drown out the people who don't have a lot of money," Breyer said.

Money flooding political races was a consequence predicted as soon as the decision was handed down in January 2010. And so far, it's true. Super PACs have raised more than $30 million just three races into the 2012 presidential race, according to the website opensecrets.org, run by The Center for Responsive Politics. TV advertising alone in South Carolina, which is voting Saturday, is estimated at $12 million, or nearly $27 per voter when calculated using the 2008 Republican primary turnout numbers.

Even U.S. Sen. Lindsey Graham poked jabs at the amazing amount of campaign ads on television as he introduced the justices.

"I miss seeing car ads," said Graham, R-S.C.

Scalia said the blame for this type of system shouldn't fall on the Supreme Court, which he said decides merely whether the system is legal under the U.S. Constitution. Instead, he said the ones who have to change things are the politicians who created the system and the voters who often reward the candidates who spend the most money.

"If the system seems crazy to you, don't blame it on the court," Scalia said, during a discussion in front of South Carolina lawyers that lasted for more than an hour.

Both justices refused to talk in detail about the health care legislation case the Supreme Court is scheduled to hear later this year.

Scalia spent more than 10 minutes lamenting the way confirmation hearings for new justices are now held in the U.S. Senate. He said lawmakers are now more concerned with making sure a prospective member of the court will interpret the Constitution they want, instead of the way the founding fathers wrote it.

"It's like conducting a mini constitutional convention every time you pick a justice," Scalia said.

Breyer said it's important for judges to take a flexible view of the Constitution. He said that, depending on a judge's interpretation, the clause allowing everyone equal rights under the law in the 14th Amendment meant making sure someone had the right to a lawyer, or the right to not be forced to give incriminating statements, or even the right to abortion or the right to choose to die when one wants.

"They look at those words and they say they apply to their cases too," Breyer said.

No justice in poltics or life??

The system of justice will either protect citizens from tyranny or be one means by which tyranny is exercised over them. A just society rests upon an equal application of the law to each and every citizen; it protects the rights of individuals regardless of the inconveniences caused thereby. Scalia is absolutely correct in this statement and when the GOP and their corporate masters wanted someone to interpret the Constitution in a convoluted way that benefits only wealthy people and actually detracts from middle class and poor Americans lives giving them less speech and less representation.

Just as there is no justice in life there is also no justice in politics.There never was and never will be - this is why attempts to try to make it seem just will only result in the forfiture of our liberties. Citizens United was the right decision.

Some of you people amaze me.
All these guys and gals who run for office by your defination are haves.
Also the real issue was not the supreme court decision, but the campaign laws that were passed
by congress and the President. That is the issue that has changed the political landscape and the
ammount of money being spent.

I would like to ask Scalia that if money has voice, as he ruled, and that is how industries speak and show their support for politicians. Doesn't that also mean that if our government gives money to private schools, that our government is showing support for those schools?? Doesn't the first admendment forbid our government from endorsing or supporting any religion. what about these Christian and Catholic Schools where they teach religion??? Isn't that a form of supporting a church and showing favor?? Just wondering .

Scalia's trite comments are about what I would expect from this man. After all it takes a warped mind to conclude that corporations, (creatures of legislation) are "persons" and that spending money can't be regulated because it's constitutionally protected "free speech." The majorities that reached those decisions, not only makes this the worst Supreme Court ever, but they also now hold the distinction of being the most destructive internal force against democracy in the Nation's history. Yes, we can "blame the court!" It is the court's "interpretation" and "flawed logic," coming from narrow-minded people with agendas, that we can blame. We must do everything possible to discredit this court and correct the damage they have done to this Nation.

William123 - Scalia has a major problem with ethics. A few years ago there was a case comming before the "supreme court?" The case was that the Democrats wanted to know just who all was making up the panel that was on the energy policy board of the Bush adminastration. It was headed up by no less than Dick Cheney. The case went before the "supreme court" BUT, before it got there, Scalia ask Cheney to go duck hunting, at a private reserve in Texas. he even had a friend fly them down. He claims that they did not talk about the case???? Why did he not recuse himself??/ he cast a shadow of doubt on the "supreme courts" ethics.
Clarenc Thomas is another, for ten years he did not fill in part of a form that the Judges are to file every year. The question was other income or wifes. His wife made over $6000,000 those years.
If he can't be honest or doesn't know he is to fill that in, is he smart enough to serve on the most powerfull court in our land.
Justice Roberts has the most corrupted , least respected court in American history.

what else is he going to say...he is intelligent, articulate, professional...and he comes up with the condescending "Turn off your TV" comment. Is he kidding me?? Did he miss the whole propaganda campaigns of the 30's and 40's that changed the world landscape. He opened up the political landscape to be controlled by the corporations and the "haves" and put a 150 pound bag of rocks on the backs of the have-nots and all he can say is "turn off the TV." Can you scream, "OUT OF TOUCH!"

So we're NOT supposed to "blame the court" for deciding there is no legally meaningful distinction between the terms "person" and "profit-motivated conglomeration," nor any distinction between the terms "speech" and "money"?

Seriously, it's extraordinary to think any rational, sensible person could read the words, "Congress shall make no law...abridging the freedom of speech, or of the press" and extract the meaning, "Congress shall make no law regulating the amount of money a corporation can spend to affect public elections or to influence legislation."

This Rehnquist/Roberts court makes a persuasive claim to being the worst in American history.

I'm not "TRYING" ANYTHING. You were born 8 years AFTER my mother in law so maybe things changed in those 8 years. Remember, she was born in 1930 at the height of the Great Depression. YOU were born in 1938 at the tail END of the Great Depression. A LOT of things changed in that 8 years streach. Either way, she doesn't have a birth certificate and I don't care one WIT if you think my story hold water or not. I KNOW what is going on in my family. YOU do NOT !

My take is not that he's stupid at all but he is intellectually dishonest. He believes in the social hierarchy as it is and is the present class system with the owners of capital subtly and not so subtly subject to different laws and different consequences than the rest of us and he will NOT let fairplay, justice, and indeed the Constitution, undercut his faith.

I am afraid you are right on target. It is a shame when someone in such a position exceeds their authority in conflict with the constitution. But to some the constitution is only a "guideline".

I guess by his reasoning, Scalia would tell people concerned about toxic chemicals contaminating their drinking water (as a result of his corporate buddies dumping), "Well if you don't like it, don't turn on your water tap". Such slimeballs.
