EXCLUSIVE: Obama To Announce Mortgage Crisis Unit Chaired By New York Attorney General Schneiderman

WASHINGTON -- During his State of the Union address tonight, President Obama will announce the creation of a special unit to investigate misconduct and illegalities that contributed to both the financial collapse and the mortgage crisis.

The office, part of a new Unit on Mortgage Origination and Securitization Abuses, will be chaired by Eric Schneiderman, the New York attorney general, according to a White House official.

Schneiderman is an increasingly beloved figure among progressives for his criticism of a proposed settlement between the 50 state attorneys general and the five largest banks. His presence atop this new special unit could give it immediate legitimacy among those who have criticized the president for being too hesitant in going after the banks and resolving the mortgage crisis. He will be in attendance at Tuesday night's State of the Union address.

"The goal of this joint investigation will be threefold: to hold accountable any institutions that violated the law; to compensate victims and help provide relief for homeowners struggling from the collapse of the housing market, caused in part by this wrongdoing; and to help us finally turn the page on this destructive period in our nation’s history," reads a White House document outlining the objectives.

"This is a big achievement and something the entire progressive advocacy community wanted [with respect to] housing policy," added the White House official.

The unit will not supersede the efforts already underway by the Department of Justice. Instead, it will operate as part of the president's Financial Fraud Enforcement Task Force. In addition to Schneiderman, the unit will be co-chaired by Lanny Breuer, assistant attorney general at the Criminal Division of the Department of Justice, Robert Khuzami, director of enforcement at the SEC; John Walsh, a U.S. attorney in Colorado, and Tony West, assistant attorney general in the Civil Division at DOJ.

News of the new mortgage unit comes amidst reports of a potential settlement between the five biggest banks, the Obama administration and the state attorneys general. Under the deal, banks would agree to follow existing laws against abusive foreclosures and set aside $25 billion to both help homeowners who are underwater on their homes or who were wrongfully foreclosed. The agreement has been in the works for months, with disagreements over the level of legal immunity granted to banks accused of wrongdoing, and the scope of violations covered by the deal.

Critics of the pending settlement have argued that the president should couple the financial relief for homeowners with a robust law enforcement effort targeting lawbreaking by big banks. Schneiderman has been among the settlement's most prominent critics for months, insisting that a deal not release bankers from criminal charges, and urging AGs to look into violations outside the foreclosure process, including issuing fraudulent loans and improprieties in the packaging of those loans into complex bonds that would become toxic assets.

UPDATE: Schneiderman's office sends over the following statement from the Attorney General.

I would like to thank President Obama for his leadership in the creation of a coordinated investigation that marshals state and federal resources to bring justice for the victims of the misconduct that caused the mortgage crisis.

In coordination with our federal partners, our office will continue its steadfast commitment to holding those responsible for the economic crisis accountable, providing meaningful relief for homeowners commensurate with the scale of the misconduct, and getting our economy moving again.

The American people deserve a robust and comprehensive investigation into the global financial meltdown to ensure nothing like it ever happens again, and today's announcement is a major step in the right direction.

Let's drag the completion into my next 4 years as shoe-in for reelection and like with the telecom industry in the 1st year of my 2nd term, I will grant full immunity.

25 billion settlement amounts to $1800 per homeowner not even a good mortgage payment. Some lost it all --- house, credit, dignity, life savings. There were some homeowners who dipped into their retirement funds to try to hang on to their house until they found a job. This is a disgrace.

The five largest banks he took campaign donations from already for reelection. One he is hosting the DNC convention in the city of their corporate headquarter. Now he is working on behalf of the people? Obama is an opportunist and will use anyone and anything to get what he wants. He could careless about the american people the timing couldn't make it more obvious.

He just launched a Justice Departments full out investigation of the banks. I would like to see a thank you once in awhile rather than pre-judging every move he makes. It's sickening and just irritating.

Two things here.......

First doesn't the NY AG have enough to do now in NY, If I were a NY Taxpayer I would want him working form me not Obama!

Lastly.......Isn't this locking the barn after the horse is gone???? This should have been done years ago. I guess the vail of secrecy and transparancy is being lifted now that election time is here.

Has anyone noticed that home sellers during the bubble actually ended up with almost all of the money lost by the banks and current homeowners? All those crazy buyers in 2005,06 and 07 put a lot of money into homesellers' hands.

And how much more effective it will be in this case, forming a committee whose findings can only possibly surface after a wide-ranging settlement granting legal immunity to the banks and all parties involved in the very mortgage frauds being examined has been signed sealed and delivered.

Seems as though it would have been even better timing if the previous adminstration would have initiated it. It was being swept under the rug during that time, giving Bush time to get out and leave the mess for whomever.

I am totally nauseated at this. Not that it isn't needed. Not that it shouldn't happen. Only that it is about three years later, and, needless to say, some evidence of the massive fraud and abuse between regulators, securitization experts, mortgage banks (many of which are now out of business for various reasons), and many other involved parties, has vanished. Of course this needs to be done. Of course everything that has been done by the President, Congress and the FED is completely and utterly wrong and destructive, not to mention immoral, regarding the "resolution" of this massive economic crisis. Back in the 1980's, during the S&L crisis, Bill Seidman, tasked with its resolution, put lots of people in jail, put the violating S&L's in receivership, put all of the bad loans with the Resolution Trust Company, and, within about a year and a half, we were on the other side of this nasty time. The financial crisis of 2007 to date, is, of course, an order of magnitude greater. However, just imagine if we had conditioned the "bailout" on the banks refinancing every delinquent mortgage, reinstituted Glass-Steagall, and broken up the violators or put them in jail or out of business. Things wouldn't have been worse, and could have gotten a lot better a lot sooner.

Lanny Breuer & Eric Holder worked at a Lawfirm that represented Big Banks. That story was on HuffPost a few days ago. Nothing will come of this for the people, another slap on the wrist.

as someone said not too long ago....if there was a child drowning and Obama walked across the water and saved him, today you folks would be saying....Obama can't swim!!! No matter what this man does it's not right for you. you'd rather have some clown who wants to take away social security from seniors, take away heat and food from the poor, rewrite the history books to whitewash your misdeeds, return us to pre-civil rights, prevent american citizens from voting, give more money to the rich, accelerate foreclosures, take away our clean air and clean water, turn our democracy into a theocracy, etc., etc. etc. and all in the name of smaller government.PLEASE!!!!

in other words no matter what he does he can't please you. so you know what he should move ahead with what he thinks is right. i used to tell people all the time.....I'm going forward. you are welcome to come with me or you can stay where you are but I'm going forward. that's what the President needs to do.

you know that old saying....if you're a part of the solution then you're a part of the problem. based on your response I'd say that YOU are a part of the problem so if we're not moving forward look to yourself and to your leadership who feel it's more important to fight the president than to fight our country's problems. we will do it without you...never fear.

as to who is this man...HE IS YOUR PRESIDENT and the fact that you can't support him while he is in office says more about you than it does about him.

i assume also, based on what you wrote, that you are one of the birther nuts whose mind is so warped by hate that you can't even accept an official and customary document from the state of Hawaii.

Right, right, hit on all those wedge issues and ignore elephant in the room. Obama was responsible for cleaning up the financial mess, instead we get a whitewash. I'll wait for a third party to come along. I may even vote for Paul if he is on the ballot, and I'm progressive. There is no integrity left in the two party system.

WHITEWASH! please explain. We've had 22 consecutive months of private sector job growth. ANd let's be clear that he inherited the worst financial crisis since the great depression, so it was going to take time, but if you look at the evidence, it's improving. Dow Jones has doubled, jobless claims reach a four year low, construction is rising, and people completely glossed over the fact that he launched a full out investigation of the banks by the Justice Department, in addition to Richard Cordray's confirmation.

I'm sick of this behavior form the left trying to find something to hate about the guy. It's disgusting, and doesn't move us forward-----Which is KEY TO BEING A PROGRESSIVE IN THE FIRST PLACE. It's not about having exactly the right positions, talking a good game about the poor, civil rights, etc. It's about doing things that are going to move you forward and make this country better, and our solutions have been anything but that. We forget often that progressivism is also about the long term goal.

While these latest moves by the President are appreciated, I can't help but think that they are just another form of "politics as usual." Now, had he done these things when he first arrived on the scene, I'd have been impressed and grateful. But doing them now smacks of nothing more than a re-election effort. Too little, too late. But what are our options?
