Kamala Harris: National Mortgage Deal Still Not Good Enough For California

One day after New York Attorney General Eric Schneiderman was named co-chairman of a federal mortgage fraud task force, California Attorney General Kamala Harris announced that she still refuses to join the national foreclosure settlement currently under negotiation among the Obama administration, the state attorneys general and the nation's five largest banks.

"We've reviewed the details of the latest settlement proposal from the banks, and we believe it is inadequate for California," said Shum Preston, spokesman for the California Department of Justice in a statement released Wednesday. "Our state has been clear about what any multistate settlement must contain: transparency, relief going to the most distressed homeowners, and meaningful enforcement that ensures accountability. At this point, this deal does not suffice for California."

One major issue still undecided is the extent to which banks will be released from liability for misconduct in the mortgage market, say sources familiar with the negotiations. If a broad release is granted, states couldn't pursue their own civil investigations of bank misdeeds.

Another ongoing concern is that the financial benefit that homeowners would receive from the settlement seems too small, say sources familiar with the negotiations.

The deal has been in the works since October 2010, when attorneys general from all 50 states banded together with the federal government to punish five large financial institutions -- Bank of America, JPMorgan Chase, Citigroup, Wells Fargo and Ally Financial -- for mortgage-related misconduct, including robo-signing and failure to provide mortgage modifications to eligible homeowners. In addition to a monetary penalty, the deal is expected to reform the mortgage servicing industry and offer relief to homeowners in the form of mortgage modifications, principal writedowns, refinancing and other options.

Both Harris and Schneiderman walked away from the negotiations over concerns that the deal would be too soft on the banks.

In his State of the Union address on Tuesday night, President Barack Obama announced the formation of a financial crimes unit, under which "federal prosecutors and leading state attorneys general [will] expand our investigations into the abusive lending and packaging of risky mortgages that led to the housing crisis. This new unit will hold accountable those who broke the law, speed assistance to homeowners, and help turn the page on an era of recklessness that hurt so many Americans."

Schneiderman is one of five men selected to co-chair the new unit, which is part of a larger Financial Fraud Enforcement Task Force, a sprawling cross-agency investigative effort established by Obama in November 2009 to "hold accountable those who helped bring about the last financial crisis as well as those who would attempt to take advantage of the efforts at economic recovery."

With representatives from more than 20 federal agencies and 94 U.S. Attorney's Offices, the task force has disappointed critics, who argue that it's chosen to pursue relatively small fraudsters while leaving alone the major offenders, including the CEOs of banks that wrongfully foreclosed on struggling homeowners.

"Look at what happened with WorldCom. ... Those guys were committing fraud at their own companies, and still they went to jail for what they did," said a prominent securities lawyer, referring to the fates of CEO Bernard Ebbers and other WorldCom executives.

In comparison, "these financial shenanigans had an impact way beyond any one company, and these guys are still walking around free," said the lawyer. "There's just not been much effort to hold Wall Street or any of these other guys accountable."

Rare to see someone has determined and focused! Ms. Harris is going to move up the ladder and those who miss the chance of her service will loose out. I only hope the final decision benefits the people and not the policitians. We know the bank lobbists own ...stock and barral Washingtion! The past decisions and laws only move to benefit the banking industry ... now that means every industry in the cuff to follow, insurance, mortgage, ..more. Give credit where credit is due, if she does sign and agree to the settlement I am sure she will make statements as to why...if not... she is going to be interesting to follow during her battle with the other AG'S who to will not give in to the papers on the table. Jobs, ....we need jobs and enforcement to go after the evildoers...

Before any deal can be struck regarding the modification of mortgages the identity of who truly owns the mortgage and who has the lawful right to modify anything must be determined. The conflict of interest (and fraud of those middle parties who have been engaged in sham modification and sham foreclosure for their own enrichment) needs to be fully exposed.

Giving mortgages to people that can't pay them off and selling the mortgage to others as a AAA is wrong. The government (aka the taxpayer) is writing most of the mortgages now and should not be loaning without at least 20% down and a very through credit check. Let's not do this again.

They can settle for money now or wait years and years and years for court litigation to end, spending millions and millions of dollars on attorneys fees and the banks will drag this through the courtsystem so deep it will make your heads spin. She is a fool.

If a long court battle is what it takes for victimized homeowners to see justice, so be it. The banks will have to pay their own legal fees, and will have a years-long PR nightmare to boot. That is why they're so desperate for a settlement. If you genuinely believed in that tagline you have, you would not be so quick to call Kamala Harris a 'fool'.

The California Department of Justice has cut funding to task forces responsible for investigating gang members, violent crimes, and parolees in rural areas of California. Instead Kamala Harris would rather focus on investigating non-violent crimes that gain her attention. This is at the same time as "public safety realignment," where the state government is cutting the funds to supervise parolees and hold violent criminals in prison.

She is not a law enforcement officer as her job description states, but a career politician who doesn't mind lots of violent criminals running free at the expense of getting some high profile mortgage brokers. Also many of the big players that she is targeting now did nothing illegal. The housing crisis was not caused by tons of mortgage brokers committing illegal acts, but tons of mortgage brokers exploiting loopholes put in by Congressmen who have been bought and paid for. Kamala Harris is just window dressing so it looks like she is somewhat competent.

We have far more people in the slammer now than ever before and consequently, crime rates are down.
Financial crimes do serious harm . In fact ,you might argue that financial crimes that cause people to lose their money and real property cause them to move from upscale neighborhoods to the ghetto where they might become a violent crime victim.Crimes were committed at many levels in the foreclosure crisis. It is a crime to lie on a mortgage application . It is a crime to commit fraud by rating bad loans AAA and selling them as CDOs.It is securites fraud to misrepresent the securities one sells .
We could save money by reducing the salaries and pensions in Calif since our public employees are overpaid and underworked .

It's easy to blame the problems on government employees because Wall Street has perpetuated the myth that they are overpaid. The truth is they are not, and the pay is seen as being high due to the mandatory overtime.

Also the number of people incarcerated is actually going down in CA. This is at the same time as the level of supervision of criminals is also dropping, and unemployment is high. For the California AG to ignore this elephant in the room (and cut money to it), while funding something else is a recipe for disaster.

I am glad I voted for Harris. Stick to it! I am tired of companies fined chump change and then, lo and behold, nothing changes.

And, what's with having all the men in charge? These guys in the banking industry at the top couldn't see beyond their toes, and its been proven that women are great leaders because they do save, do think ahead and plan.

The economy runs on 50-50%. Can we see some women up there, let's go, come on men.

Women got the right to vote over a hundred years ago, can we move on now?

In The Godfather, it was said that Vito Corleone "had all the judges and politicians in his pocket". And in Godfather Part II, Hyman Roth spoke of a "partnership" with a friendly government. Racketeering is alive and well in the U.S. except that it has become bigger and more sophisticated. TARP is a flagrant example of a partnership between government and racketeering and the proposed settlement which Ms. Harris opposes is a further example. A thorough investigation of the racket is going to reveal what? Politicians who were in the racketeers' pockets for one thing. Now, we can't have that, can we?
