KINGSTON, Ontario — A jury on Sunday found three members of an Afghan family guilty of killing three teenage sisters and another woman in what the judge described as "cold-blooded, shameful murders" resulting from a "twisted concept of honor," ending a case that shocked and riveted Canadians.

Prosecutors said the defendants allegedly killed the three teenage sisters because they dishonored the family by defying its disciplinarian rules on dress, dating, socializing and using the Internet.

The jury took 15 hours to find Mohammad Shafia, 58; his wife Tooba Yahya, 42; and their son Hamed, 21, each guilty of four counts of first-degree murder. First-degree murder carries an automatic life sentence with no chance of parole for 25 years.

After the verdict was read, the three defendants again declared their innocence in the killings of sisters Zainab, 19, Sahar 17, and Geeti, 13, as well as Rona Amir Mohammad, 52, Shafia's childless first wife in a polygamous marriage.

Their bodies were found June 30, 2009, in a car submerged in a canal in Kingston, Ontario, where the family had stopped for the night on their way home to Montreal from Niagara Falls, Ontario.

The prosecution alleged it was a case of premeditated murder, staged to look like an accident after it was carried out. Prosecutors said the defendants drowned their victims elsewhere on the site, placed their bodies in the car and pushed it into the canal.

Ontario Superior Court Judge Robert Maranger said the evidence clearly supported the conviction.

"It is difficult to conceive of a more heinous, more despicable, more honorless crime," Maranger said. "The apparent reason behind these cold-blooded, shameful murders was that the four completely innocent victims offended your completely twisted concept of honor ... that has absolutely no place in any civilized society."

In a statement following the verdict, Canadian Justice Minister Rob Nicholson called honor killings a practice that is "barbaric and unacceptable in Canada."

Defense lawyers said the deaths were accidental. They said the Nissan car accidentally plunged into the canal after the eldest daughter, Zainab, took it for a joy ride with her sisters and her father's first wife. Hamed said he watched the accident, although he didn't call police from the scene.

After the jury returned the verdicts, Mohammad Shafia, speaking through a translator, said, "We are not criminal, we are not murderer, we didn't commit the murder and this is unjust."

His weeping wife, Tooba, also declared the verdict unjust, saying, "I am not a murderer, and I am a mother, a mother."

Their son, Hamed, speaking in English said, "I did not drown my sisters anywhere."

Hamed's lawyer, Patrick McCann, said he was disappointed with the verdict, but said his client will appeal and he believes the other two defendants will as well.

But prosecutor Gerard Laarhuis welcomed the verdict.

"This jury found that four strong, vivacious and freedom-loving women were murdered by their own family in the most troubling of circumstances," Laarhuis said outside court.

"This verdict sends a very clear message about our Canadian values and the core principles in a free and democratic society that all Canadians enjoy and even visitors to Canada enjoy," he said to cheers of approval from onlookers.

The family had left Afghanistan in 1992 and lived in Pakistan, Australia and Dubai before settling in Canada in 2007. Shafia, a wealthy businessman, married Yahya because his first wife could not have children.

Shafia's first wife was living with him and his second wife. The polygamous relationship, if revealed, could have resulted in their deportation.

The prosecution painted a picture of a household controlled by a domineering Shafia, with Hamed keeping his sisters in line and doling out discipline when his father was away on frequent business trips to Dubai.

The months leading up to the deaths were not happy ones in the Shafia household, according to evidence presented at trial. Zainab, the oldest daughter, was forbidden to attend school for a year because she had a young Pakistani-Canadian boyfriend, and she fled to a shelter, terrified of her father, the court was told.

The prosecution said her parents found condoms in Sahar's room as well as photos of her wearing short skirts and hugging her Christian boyfriend, a relationship she had kept secret. Geeti was becoming almost impossible to control: skipping school, failing classes, being sent home for wearing revealing clothes and stealing, while declaring to authority figures that she wanted to be placed in foster care, according to the prosecution.

Shafia's first wife wrote in a diary that her husband beat her and "made life a torture," while his second wife called her a servant.

The prosecution presented wire taps and mobile phone records from the Shafia family in court to support their honor killing allegation. The wiretaps, which capture Shafia spewing vitriol about his dead daughters, calling them treacherous and whores and invoking the devil to defecate on their graves, were a focal point of the trial.

"There can be no betrayal, no treachery, no violation more than this," Shafia said on one recording. "Even if they hoist me up onto the gallows ... nothing is more dear to me than my honor."

Defense lawyers argued that at no point in the intercepts do the accused say they drowned the victims.

Shafia's lawyer, Peter Kemp, said after the verdicts that he believes the comments his client made on the wiretaps may have weighed more heavily on the jury's minds than the physical evidence in the case.

"He wasn't convicted for what he did," Kemp said. "He was convicted for what he said."

Middle Eastern culture is known for honor killings, even Christian Arabs have participated in it. But at the center of most Arab thought is the Koran so it is predictable and justified to conclude that the practice of honor killing can find some Koranic support, even if it is merely implied in the book. What we in the West see is the killing of Van Gogh, the stoning of women in Iran for adultery, and now the call for the death of Hamza Kashgari because he has doubts about The Prophet. At some point, it is time for good Muslims to re-invent Islam to a 20th century religion. It is time to put away the old ways. It is time for the spirit of love to rule over the spirit of legalism and fundamentalism. If the truth be known, rational Western Muslims are probably more horrified by the prospects of Sharia Law than those of us on the outside who know less of its dangers. It is time for those Muslims to be the voice of modern Islam, which they are, I am sure. But they need to turn up the volume. They can no longer whisper; they need to shout the truth that Islam needs to enter the 20th century.

Of course there is a Koranic support of killing offsprings who ent astray. There is a story in the Koran (sura 18, verses 65 through 82 http://quran.com/18 ). In this story Moses meets a slave of Allah and asks for permission to follow him in order to learn what the slave of Allah have been taught of sound judgment. One part of this story is about slave of Allah killing a boy.
(18:74) So they set out, until when they met a boy, al-Khidh r killed him. [Moses] said, "Have you killed a pure soul for other than [having killed] a soul? You have certainly done a deplorable thing."

Later, the slave of Allah gives the explanation of his action:

(18:78) [Al-Khidh r] said, "This is parting between me and you. I will inform you of the interpretation of that about which you could not have patience. (18:80) And as for the boy, his parents were believers, and we feared that he would overburden them by transgression and disbelief. (18:81) So we intended that their Lord should substitute for them one better than him in purity and nearer to mercy.

This is a very telling story in the Koran about killing a child who transgressed and disbelieved. By the way, Sharia law, which is based on Koran and Sunna, does not retaliate against parents who kill their children.

Shame on those who try to present these honor murders as “domestic violence”. Domestic violence is not celebrated in the West, or in Christianity, Judaism, etc. and the perpetrators are ostracized and imprisoned.

Muslims who commit or assist in the honor murders consider their action as heroic and even view the murder as the fulfillment of a religious obligation. There is no social stigma attached to honor murderers in Islam.

In Islam, woman is a property of a man – first father and then husband. Often they are loving and kind, but not always. And when they are not, men are empowered by Koranic teaching and by Muslim tradition to act in a horribly barbaric and oppressive manner. Honor murder is a product of gender power imbalance intrinsic to Islam. Koran says men are in charge of women, they are in charge of women’s behavior. Islam does not say "go and kill women", but Islam prescribes to monitor, control and chastise women.

Murderers, whether they are committing an "honor" killing or otherwise, aren't celebrated anywhere. Those who kill their wives or daughters, do so to try to regain their honor/remove a stain from the family's reputation, but even if the murder accomplished that, it doesn't create anything worthy of celebration. Remember, they just killed a family member...

Christ, the dense mind of some. I have ceased to be amazed at the idiocy of some westerners nowadays. It is mindboggling to imagine how a people who is immersing in knowledge and education can be so utterly prejudiced and [down-right] MIND-NUMBINGLY stupid. This is not the Islam...this is the culture of some Islamic countries that in some parts are backwards. It is terrible but true. Islam itself does not encourage this whatsoever.

In fact it says if you think a woman is guilty of adultery you need four witnesses who physically see it with their own eyes...otherwise it is a sin to even talk about.

Whether the murder was calculated or an act of rage, the fact remains that this is a case of murder. The fact also remains that Islam does not condone such killings. Parents are not given the authority to act as a judge, jury and executioner.

Please stop labeling it as "Honor Killing." It is domestic violence of the worst kind. Same as when a man kills his ex-wife for a suspected affair. Presumably the women’s shelter mentioned in the story wasn’t created for Afghan immigrants alone? So if you’re going to call this an honor killing, then perhaps the other women in the shelter were subjected to “Honor Beatings.” Unfortunately this anti-woman mentality is not unique to tribal misinterpretations of Islam. Instead it is sadly endemic to many societies that fail to teach their men to be responsible for their own actions, and their women to expect better.

As deplorable as these murders are, claiming that this customs is barbaric it is an lot like the kettle calling the pot black, when on a regular basis you can find the same sort of family murders in the American culture.

Just think about this; when was the last time that you remember there not being week in which some gun tooting fanatic shot up his family in America?

Yes, Christianity, under the guise of the Catholic Church did commit atrocity in the form of the crusades, the inquisitions, pogroms and even supported Hitler in WWII, in the killing of the 6 millions Jews, and yes, even Judaism has blood in their hands, but we have "grown up", the Western civilizations no longer tolerate the killing in the name of Religions, some people, (Muslims) still carries killing, of their citizens if they believe those citizens have broken part of their Sharia laws, it is mostly used against females, and children...very few man receive these penalties, the only time man will be put to death is, if he no longer observe his Muslim faith, if he becomes a Christian, or choose any other religion beside Islam.
In the "modern world, we DO kill our unborn children for the "god" of inconvienance. I know I will reveice some hatemail for that short statement, but we all have our opinions and diverse as they may be, I will respect your opinion, if you respect mine.
