Indiana Lawmakers Advance Drug Testing For Welfare Applicants And Themselves

The Indiana House of Representatives approved a bill Tuesday that would drug test people who apply for welfare, along with members of the Indiana General Assembly.

"I feel it is imperative that your tax dollars go to those who are truly trying to better themselves. We must provide incentives for people to bring themselves out of poverty and to do the right thing,” said Rep. Jud McMillin (R-Brookville), the bill's sponsor, in a statement. "I am excited to help our state become a national leader on this important issue."

McMillin initially proposed a pilot program for drug testing only welfare applicants, but last week state Rep. Ryan Dvorak (D-South Bend) amended the bill to include drug and alcohol testing for lawmakers. It's a legislative counterattack employed by Democrats in several of the 30-plus states where Republicans are pushing drug tests for the poor and jobless.

Indiana is the first state where lawmaker drug testing has actually advanced, though the measure's fate in the state senate is uncertain. McMillin told HuffPost that he has senate sponsors who he expects to pick up the bill and help it move forward.

McMillin withdrew his bill on Friday, saying Dvorak's amendment likely violated the Constitution. On Monday, he came back with a new version of the legislation that softened the lawmaker drug testing provision. Instead of blanket testing for every member of the General Assembly, the new version of the bill lets lawmakers opt in to a system of random screening similar to the one for families seeking cash assistance. (If they don't consent, they lose their parking spaces and other perks.)

Though House Republicans said the testing provisions mirror each other, the bill has different standards for "reasonable suspicion" for a lawmaker and a welfare applicant. The latter can be reasonably suspected of drug use if he or she has been convicted of a crime, charged with a drug offense, or "failed to attend a scheduled meeting or complete online requirements regarding [welfare] assistance."

The bill gives leaders in the General Assembly leeway to form "reasonable suspicion" that a lawmaker is using illegal drugs, but while it mentions convictions and drug charges, it does not specifically say whether lawmakers who miss scheduled votes or hearings will be considered suspicious.

McMillan said he favored making missed votes cause for reasonable suspicion, but that the broader measure might not have passed if it included the stricter language.

"Many people felt it was too much," he said in an interview.

He added that his new bill is tougher than Dvorak's proposal because it would make lawmakers' drug test results public.

In Indiana in 2011, 18,602 families had received welfare cash assistance as of December, 33 percent fewer than the previous year, according to the latest report by the state government. An eligible family of four must have dependent children, can't earn more than $712.25 per month, or possess assets worth more than $1,000. The maximum monthly benefit for a family of four is $346.

Dvorak said opt-out provisions for both welfare applicants and lawmakers make the bill toothless, and that Republicans are only pursuing it to send a political message about getting tough on poor people receiving government benefits.

"It's a bill that does nothing with a hard line message," he said. "I just think it's a complete joke."

Drug testing perspective employee's is Un Constitutional also, without just cause. Frankly it amuses and irritates me that people don't see that obvious fact. and BTW I am very much against drug abuse.

But in all seriousness, when did Republicans become the party of fluffy feel good ideology. Do they honestly believe the sole purpose of welfare is to help people pull themselves out of poverty? How naive.

Show me someone who would rather do drugs than keep their welfare check and I'll show you someone who just lost their last incentive not to rob you. Welfare costs taxpayers about 1/5th what prison does and forgoes the nasty 'innocent person shot by desperate crackhead' step.

This is going to blow up huge. Crime rates will definately be goin up. I live next to a community that is majorily on welfare. Not all, but most. When you take away these benefits in an already impoverished society it's not going to be good in the end. WE'RE ALL GOING TO SUFFER, EVEN THOSE WHO DON'T COLLECT WELFARE. Do you realize that all these people losing benefits are going to make up for it somehow. Do you really thin they're going to go to work? NO THEY'RE GOING TO GO TO CRIME. Drug testing for welfare recipients is a big political fallacy. Drug test kits to help pass drug tests are widely available on the internet check out http://www.passyoururinetest.com Why would anyone think welfare applicants would not spend their application fee of $45 on these products to pass their tests?

Since welfare recipients can afford a drug test then I assume you think they can also afford getting a birth certificate to get a voter I.D. I have read some of the comments here and I would say some are missing the point. If they pass this bill you all better read up on you contitition it is fed funded and it say actical 14 no bill will be pass that exempts them from a any bill passed. And what is going to happen to all the money ear marked for the people if they kick you off the welfare program, they will use it for what ever they want to use it for I.E. thier own pockets and the money will for ever vanish just like the 5 cents a gallon fuel tax that was passed by the goverment back in 1968 for bidges and dams

Lets put the money back into Social Security so those who ACTUALLY worked and had it "stored away" by the crack heads in Washington will actually benefit from their "savings".
I am a firm believer in helping folks who need help. I think most people are. I do not believe in allowing and enabling the irresponsible.

This was never about saving money,just a ploy to add a cost to taxpayers under the guise that pregnant females and young mothers abuse drugs, The key to the drug testing success is to keep the public misinformed on who and what type a person is on welfare.trade agreements that support a wage that allows for childcare would drastically reduce any need for a welfare system.

Nope not any different. It is up to the Companies if they want to drug test you and if you refuse you are walked to the door. This testing of welfare recipients is up to the state as it should be and if you refuse you should be cut off from all aide for ever. Yes I support it completely. And yes we have drug testing where I work and yes I have been tested as has others and yes some of lost their jobs because they came back postive as it should be.

Indiana, haven't you learned from other states that this does not work? (i.e., Florida). With the small percentage of positives you will get, it costs more to run the program than what you would save in denying benefits!

Gov Scott had signed over his testing labs into his wifes name before running for gov of Florida. It was a transparent attempt to siphon money from the treasury and into his pocket. He was stopped.

I've been very aware of this. However the GOP has been blaming blacks for decades. I havent heard not one person on the right say most people on welfare are white.
