House Votes To Repeal CLASS Act, Part Of 2010 Obama Health Care Law

WASHINGTON -- The Republican-led House on Wednesday voted to repeal a financially troubled part of the 2010 health care law that was designed to provide affordable long-term care insurance.

The House vote comes months after the Obama administration suspended the Community Living Assistance Services and Support program, known as the CLASS Act.

Health and Human Services Secretary Kathleen Sebelius in October said she was unable to find a way to make the program financially solvent.

Still, the White House has said it does not support repealing the program, under which workers would pay a monthly premium during their careers and collect a daily cash benefit if they become disabled later in life.

Republicans have targeted the program as part of their overall goal of dismantling the health care overhaul law. Action on the bill in the Democratic-controlled Senate is uncertain.

"Republicans are committed to repealing and defunding it, piece by piece if necessary," House Speaker John Boehner, R-Ohio, said of the health care bill after the CLASS Act vote.

The House vote was 267-159, with 28 Democrats joining all 239 voting Republicans in support.

The Senate has ignored House votes in the past year to repeal the entire health care law or to block funding for parts of it. One of the few changes Congress has been able to bring about concerned a requirement for small businesses to file more health care paperwork.

The CLASS Act was supposed to address the crisis in long-term care coverage. Currently some 10 million Americans need long-term care, and that number is expected to hit 15 million by 2020. But only about 8 percent of people buy private long-term care insurance.

Under the voluntary program, a priority of the late Sen. Edward Kennedy, monthly premiums would be used to finance benefits of at least $50 a day for those needing long-term care. The money would go for services at home or to help with nursing home bills.

But government actuaries determined that unless a large number of healthy people signed up, premiums would have to soar to unaffordable levels to meet the growing needs of the disabled.

Experts have concluded, said Rep. Phil Gingrey, R-Ga., that "the CLASS program can't be operated without mandatory participation so as to ensure its solvency." Unless it is terminated, he said, "it poses a clear danger to the fiscal health of our budget and to the American taxpayer."

The administration finally has come to the conclusion "that we knew even before the bill passed, that this was unsustainable, it was unworkable, it was fatally flawed," said the bill's sponsor, Rep. Charles Boustany, R-La.

But Rep. Henry Waxman, D-Calif., said the Republican goal was to "tear down and dismantle programs that provide health care in the United States." He said "the solution is to amend the program to make it work, not just repeal it and leave nothing in its place."

I do hope they decide to fine-tune it rather than repeal it. If they repeal it, it will NOT be replaced with anything else. And, in terms of LTC, something does need to be done. It seems there are two choices: 1) Put your elderly in a home - which for most means that, after the money runs out, they take your home, etc. and then state/federal monies kick in. 2) You take care of your parents, get little or no  Read More...

The per person Medicare Part B insurance premium will increase from the present monthly fee of $96.40, rising to: $104.20 in 2012; $120.20 in 2013; And $247.00 in 2014. These are provisions incorporated in the Obamacare legislation, purposely delayed so as not to 'confuse' the 2012 re-election campaigns. Thanks for nothing...

This article does not say why the Class Ast is not financially solvent. We have all of the this name calling about the Republicans wanting all of the poor people to suffer and die and on the other hand the democrats want everything given to them. The reason this will never work is because we will never get enough young people to pay premiums every month for something that may happen in the future. If what I read is correct the premiums could be anywhere from $97 to $300 a month and in some cases more. If you would get more than 10% of healthy 30 year old people to sign up I would be surprised. This is never going to work when you have a huge influx of older people right now and no younger ones paying into it. Would you as a healthy 30 year old do this. I would not.

So the republicans fully understand that if nothing is done then there will be a crisis in long term care. But they also understand that there is a problem with the current proposal. But rather than fix the current proposal the republican fix is to to nothing.

Therefore, base on the republican logic, they are inf avor of doing nothing and allowing a crisis in long therm care to exist.

Yet they truly believe that they will win in Novermber 2012.

Actually I read that article about a week ago and I don't watch KO unless he is on. I will give you my personal experience as it relates to the subject.

No, they have low I Qs and I have been exposed to that for years within my own family. The same siblings that come to me for some of the simplest advice and have me drive 300 miles one way to help them through a difficult process are some of the most racist and right wing people alive. I am talking Glen Beck groupies. They cannot however answer any questions I ask about the issue we would be discussing. They had no facts and would not under any circumstance accept anything I told them or look it up to prove what I was telling them. Yes I would say that the article was very accurate.

The system is so screwed up. My Mom is a perfect example. She is 86; she has advanced dementia, inflammatory spinal arthritis and osteoarthritis. Otherwise, her over all heath is good. She does not need skilled nursing care, but she does require a very high level of assistance. We have drained 2 generations of savings on 10 years of assisted living. So, mom now lives with me. Her income provides for a geriatric aide for 5 hours a day while I’m at work, a 9 hour day plus travel time. Having inherited Mom’s spine, soon the time will come when I will not be able to do the lifting needed to transition or transport her. About $1000 - $1500 and month is what I’m looking at needing. So I contact the “help lines”. This is their answer, there is a small amount of money available for “in community” assistance. There is a 2 year waiting list to apply, then another 18-24 months to wait for the medical assistance folks to approve her. And after all that the benefit is negligible…….So the alternative offered by the system…..just put my Mom in a nursing home, at a much higher level of care and cost than she needs…..but that’s all they’ve got. I need a grand to keep her at home, and the only “help” available is a $6-7000 nursing home bill to the state.

HOW DOES THIS MAKE SENSE ????????????

This is the law of the land, the result of an effort going back over 100 years and with Constitutional prescidence going back 200 years to a law enacted by John Adams. It will not be repealed, only changed and modified but those who oppose it have their talking points and will not be disueded from doing what is right and therefore they must be ignorned in the face of reason and the benefity of the nation.

The union reform acts are going to be a pivotal point for a lot of people, not because they wanted unions, but because these changes will affect the pay and benefits of non union workers as well. Unions pushed companies to pay fairly and made wages more competitive among non-union companies. Unions have not been the problem with businesses. Corporate greed has been the problem.
