A federal appeals court upheld a Maine law that could reveal the donors who financed a $1.8 million movement that helped overturn the state's gay marriage law.

The court rejected arguments from the National Organization for Marriage that being forced to disclose donors who backed the effort was a violation of First Amendment speech rights.

The court's decision on Tuesday means the National Organization for Marriage, which advocates that marriage be defined as being between a man and a woman, could have to reveal the names of people who gave more than $100 to its campaign efforts against same-sex marriage in Maine.

The Maine law says that groups that spend more than $5,000 "for the purpose of initiating or influencing" a referendum must disclose the names of their donors.

The decision by a panel on the U.S. Court of Appeals for the First Circuit in Boston clears the way for the state to conduct an inquiry into whether the group was indeed raising money to influence the ballot initiative.

A lawyer for the conservative group said it would appeal the case to the U.S. Supreme Court.

Maine's legislature legalized same-sex marriage in 2009 but the law was overturned that same year by a "people's veto" in a referendum 53 percent to 47 percent.

As part of that campaign, the Washington D.C.-based National Organization for Marriage steered hundreds of thousands of dollars in contributions to Stand for Marriage Maine.

The group's lawyer, James Bopp Jr., said it was unfair that advocacy organizations should face the same disclosure requirements as political action committees.

"The homosexual lobby has launched a nationwide campaign to harass supporters of traditional marriage," he said. "When they disclose who they are they can reasonably expect to be harassed."

Thomas Knowlton, Maine's assistant attorney general, said the state was pleased that the constitutionality of the law had been upheld.

The same court ruled against the National Organization for Marriage last year in a related case involving disclosure of contributions to individual candidates. The U.S. Supreme Court is expected to decide whether to hear that case by the end of the month.

Same-sex marriage proponents have collected more than 100,000 signatures to put gay marriage back on the Maine ballot again this year.

In neighboring New Hampshire, which legalized gay marriage in 2009, Republicans who control super-majorities in the state legislature are considering a bill that would repeal same-sex marriage.

Six states plus the District of Columbia currently recognize same-sex marriage: New York, Massachusetts, Connecticut, New Hampshire, Vermont and Iowa. Washington's senate was expected to approve a bill legalizing same-sex marriage in that state on Wednesday, and that state's governor also was expected to sign the bill into law.

As in California, those donors' names, addresses, and workplaces will appear on websites in an attempt at blacklisting, intimidation, and discrimination...

if same-sex marriage is such a noble cause, why do they resort to ignoble methods?

We're tired of the vatican and the LDS spending millions on public policy and propaganda full of lies and then getting rewarded with tax exempt status as religious organizations. The law in Maine says donors have to be disclosed.

Putting aside whether any lies were told, due to the history of belligerence once donors have been disclosed, I think we would both agree that Maine's law enforcement officials need to step up and protect these donors from undue violence, discrimination, and intimidation.

People have a right to know who is attacking their rights.

It is against the American soul to use the law to restrict the rights of citizens, when the country was founded on the desire to protect those rights - especially when done by people shielded from consequence or accountability, people free to be irresponsible or tyrannical.

If the anti-gay marriage lobby is proud of their position they shouldn't have any reticence in revealing their contributors. So far as I know the pro-gay marriage lobby doesn't. That they vehemently do is proof that they are both cowardly and hypocritical. If you contribute to a political-type cause you should be willing to be identified, especially if it's a significant contribution. Their atty, James Bopp, is a long-time lawyer for all kinds of radical right-wing causes including the most extreme anti-abortion, forced-pregnancy lobby. Personally I don't favor the legalization of gay marriage if it's opposed by a majority of the people; if it favored, I have no problem with it; if it were put to a referendum (which would be good) I'd vote FOR it. But make no mistake, the anti-gay marriage movement is primarily motivated and populated by homophobic bigots epitomized by presidential candidates like Santorum and Gingrich and formerly Bachmann and Perry. Nobody's fooled.

Let's take this to the next level about NOM...Like their counter part another FAITH BASED group that targets MD's that perform abortions, these people are worried that if their names are released that they and their families will be targeted...this is the EXACT same thing they do to the Families of the Doctors..protesting in front of the school of 1 doctors son, calling their homes and picketing their homes and business..

Well, to quote the Bible, "Do unto them as you would wish them to do unto you" So what goes around comes around and Karma is a Mean B-tch...

I say expose these people for the liars and hate mongers for which they are..

An I recently heard that the Prochoice is NOW protesting and picketing the homes, schools and business of these groups that advoacte the murder of these doctors...and Guess what the PRO LIFE group does not like it..how odd...I wonder why...pay back !!

A double standard? If someone in Maine is convicted and sentenced for murder but appeals to the US Supreme Court, is it permissible for them to run around free until the Court decides. If not, then why can NOM disregard the state court ruling that they have turn over the donation name list, until the Supreme Court may or may not listen to the appeal?

So, what are they afraid of? I suspect they're afraid that the public, as a whole, will find out that NOM is a front organization for the Catholic and Mormon churches, digging their claws into secular political processes, which might jeopardize their tax-exempt status.

Not to mention that it will turn off any number of Christians who are neither Catholic nor Mormon.

Most important, however, is that they hold themselves above the law and blame the "Homosexual Lobby" for forcing them to observe the same laws as other mortals. Every time they did this, in every state in which they worked, the courts have ordered them to reveal their donors. They have never won a single case to hide who really owns NOM. But they still have not complied.

Why are their leaders not in jail for contempt of court?

Here is the deal, if it comes to pass and I am not saying it will that the money is coming from religious organizations like the Mormon and Catholic churches...then I say very clearly and this includes Jewish orgaizations mixing in to political forum..that WE the people Demand that they loose their tax exempt status..

You cannot have it both ways NOM...you are either fish or Fowl...but the light is coming on and YOU must disclose. YOU are a PAC and stop trying to fool us...we are smarter than THAT..

If it does not affect you personally, you shouldn't have a say. If gays want to get married they should get married. If heterosexuals don't want gays to get married, gays should be allowed to get married. Again if it does not affect you personally you shouldn't have a say.

A lvoing, committed relationship between two gays has never adversely affected me in my 68 years of life. Folks should mind their own marital business and support an open and welcoming community that treats all members with dignity and respect.
