Mark Berndt Arrest: Officials Question How Los Angeles Teacher's Alleged Child Abuse Went Undetected

LOS ANGELES — Prosecutors declined to file attempted fondling charges 18 years ago against an elementary school teacher now suspected of taking bondage-style photographs of children in his class, saying that they didn't have enough evidence.

The investigation came after a 10-year-old girl claimed elementary school teacher Mark Berndt reached toward her genitals during class and she pushed his hand away, sheriff's Sgt. Dan Scott said Thursday.

The details of the case and other claims by two former students about strange behavior by Berndt surfaced just three days after his arrest.

The allegations raised further questions about why he wasn't disciplined by school officials, who have been lambasted by some parents for waiting a year to reveal Berndt was suspected of photographing children for sexual thrills.

Only parents of children identified as victims were told by authorities about the most recent investigation.

School officials and investigators said proper procedures were followed to investigate and build a case against the teacher.

Scott said the incident involving the 10-year-old girl occurred in September 1993 but wasn't reported by her mother to officials at Miramonte Elementary School until the following January, after her daughter had seen an "Oprah" show about inappropriate touching.

School officials notified the Los Angeles County sheriff's department, which submitted evidence to prosecutors. They opted not to file a charge of committing a lewd act on a minor under the age of 14. Berndt was never arrested.

"Based on what I read, it was a thorough and complete investigation," said Scott, who noted the investigator who handled the case has retired.

Sandi Gibbons, a district attorney spokeswoman, said in a statement the case was rejected because there was insufficient evidence to prove a crime had occurred. The statement did not elaborate.

Berndt denied the allegation at the time.

Earlier, two women who said they were former students of Berndt told the Times that complaints were made about his odd behavior as far back as 1990.

Los Angeles Unified School District Supt. John Deasy told the newspaper he was struggling to determine how the alleged behavior went undetected for so long.

"How do I make sense out of the fact that this took place over a number of years and no one seemed to know about that?" Deasy said. "I'm definitely trying to understand how someone could not have known."

Berndt, 61, remained jailed on $23 million bail on felony charges of committing lewd acts on 23 boys and girls, ages 6 to 10, between 2005 and 2010. He could face multiple life sentences if convicted.

Using a cheap camera, Berndt is suspected of snapping nearly 400 photographs of Miramonte students, some with a giant Madagascar cockroach from a classroom terrarium on their faces.

Others were blindfolded or had clear tape over their mouths, and some were given sperm-laced cookies to eat as treats in the photo sessions that were treated like games, Scott said.

Some of Berndt's students defended him, saying he was a kind and generous teacher.

Angelica Zuniga, a 16-year-old high school junior, was in third grade in 2003 when she had Berndt as a teacher. She said he never asked her or others to do anything strange or to play any inappropriate games.

"They're calling him `monster.' He's just not that kind of person," Angelica said. "He was one of the most amazing teachers out there. He's dedicated his life to us, and I want to stick up for him."

The latest investigation of Berndt began in the fall of 2010 when a film processor became suspicious about the photographs and turned them over to Redondo Beach police, who on Dec. 2, 2010, handed them over to the sheriff's department, Scott said.

Berndt, who taught at Miramonte for more than 30 years ago, was removed from classwork in January 2011 and fired within the month.

This guy was truly awful, but teachers do lousy things to kids every day that aren't as bad, but that they should get in trouble for. Most of the time, kids just don't say anything. Last Friday, for example, a kid in one of my son's science classes kept asking to go to the bathroom. For whatever reason, the teacher kept saying no. The kid finally said he was "going to puke" and the teacher let him go. Sure enough, he barely made it to the bathroom before vomiting. Kids regularly have their rights trampled by adults in school, from lunch aids who tell them to eat things they don't want to, to teachers who deny bathroom access. No wonder they don't speak up when something goes terribly wrong like this. The best things parents can do is ask their kid every day how their day went and ask about things they notice. I saw bruises on my kid once and it took about an hour of me pestering him about where they came from for him to tell me. Turns out some other kid pushed and shoved him so badly in a stairwell, he was left with big bruises. The bully got in trouble after I complained, but if I had looked the other way, it could have escalated!

Well, it looks like they did find child porn at the very least. It's kind of hard to deny photographic evidence. The evidence must be pretty compelling to have such a high bond!

This sicko is still collecting 4000/mo pension and healthcare for life. This nut case has been doing stuff to kids since 1991! There are going to be lots of big lawsuits coming forth. Since teachers police themselves and he was left teaching all this time, perhaps the suits should be paid out of the teacher's pension fund - watch how quick this kind of stuff stops!

The students that are sticking up for this teacher were the lucky ones to not have been abused by him. This can happen, and some are just lucky to not have the teacher "notice" them. All in the same classroom. Maybe at the time, they did not know yet ate some of his cookies!

Yes, these sickos know how to target kids that are less likely to tell. It amazes me when people stick up for someone on this basis. I've seen it happen with siblings: 'well he didn't molest me, so I know he didn't molest my sister' sort of stuff. The sister was probably a more timid child that was easily manipulated by the creep. Those poor vulnerable children are like blood on the water to these sharks!!

Reminds me of my 5th grade teacher, sick, demented except mine hated girls and was always disciplining boys by making them sit in humilitating positions with their hair in pigtails. Not kidding here, during the time that principles had paddles with holes to hit kids with. I forged my mom's name to try to get myself out of that class, so very many years ago. The school is still there, and when I pass it, I cringe to think of how many years he was a teacher. How many students? With this guy, how many kids?

My 15yr old daughters math & science teacher (under 30 & male) tried to friend her on Facebook, and I told her no, highly inappropriate.This dweeb had the nerve to call me at home and question my " heavy-handed " parenting skills, and told me several other parents had no problem with it (several being 3, I found out after talking to others ).
I told him that I'd be happy to come down to the school and talk about it face-to-face with the principal, and maybe a sheriffs deputy. He dropped it. Another parent reported it to the school, but to no end. The Administrators said they'd have a "serious discussion" with him, and moved my daughter from his classes. End of the issue as far as they're concerned.

I'd report it to the superintendent and demand to know what the outcome was. If you don't get a satisfactory answer, share your concerns with the school board in an open meeting. You could be protecting other children from inappropriate behavior in the long run! Look at this case - the teacher was suspected of something back in 1993, but the complaint was not handled correctly. How much abuse could have been prevented if it was taken care of properly back then?

If you are hurt, peeved at the School. you must call a meeting, or get a few parents together, talk, show documentation anything. Get Parents to demand at least, that he is put on NOTICE" any untoward activity toward ANY student will be cause for Immediate dismissal."

Sexual predators are everywhere. Red flag individuals that are strongly linked with sexual assault are:
1. Step-fathers, step -brothers, cousins and boyfriends.
2. Youth ministers
3. Camp counselors.
4. Big Brother types
5. Charismatic men who want to "save wayward and lost boys"
6. Men of the cloth (don’t be fooled for a second that it’s only a Roman Catholic thing)
7. Pre teen and teenage boys that are overweight and have self esteem issues. Their anger often is channeled in a sexually aggressive manner.

Basically TRUST NO ONE because man is an evil creature that strikes when least expected (Roman 3:10-14)

I've been saying that for years. Clearly we're all so worried about protecting the unborn that we let our living children be treated as a burden with underfunded schools rampant with abuse and mediocrity while we pour time and money on trying to restrict women's rights.

What if, and this is much more likely than your theory, the school board knew the teacher's union would sue for this guys job, back pay, pension and benefits if they tried to fire this guy?

Why did it take "months" to determine that there was semen on the spoon? I imagine funding plays some part in this, but how much? And if it's a significant part, what are the citizens and politicians of Los Angeles doing to change the situation? These are some of the questions parents there should be asking, if they aren't already.
