GRAHAM, Wash. -- Days after a judge ruled against him in a child custody hearing, a father and his two young sons were killed Sunday when police said he intentionally blew up a house with all three inside – a tragic ending to a bizarre case that began more than two years ago when the man's wife went mysteriously missing in Utah.

A social worker brought the two boys to Josh Powell's home for what was to be a supervised visit, and Powell let his sons inside – but then blocked the social worker from entering, Graham Fire and Rescue Chief Gary Franz told The Associated Press.

The social worker called her supervisors to report that she could smell gas, and moments later the home exploded.

Sgt. Ed Troyer, Pierce County sheriff's spokesman, said emails that Powell sent authorities seemed to confirm that Powell planned the deadly blast. Troyer didn't elaborate on the contents of the emails, but said they make police believe "this is intentional, this is planned...this is a double murder-suicide."

Authorities were removing three bodies from the home Sunday evening as fire crews and police continued to search the rubble. Troyer said it appeared some sort of accelerant was used to make the house burn faster.

Jeffrey Bassett, who represented Powell in the custody case, said he received a brief email from his client just minutes before Powell and the two boys died. It said, "I'm sorry, goodbye."

The email arrived at 12:05 p.m. Sunday, about 10 minutes before the explosion, but he didn't see it until two hours later, when others told him Josh and the boys had been killed. He said he knew Josh was upset after being ordered to undergo a psycho-sexual evaluation recently, but he didn't see this coming.

Powell was under investigation in the disappearance of his 28-year-old wife Susan from their West Valley City, Utah, home in December 2009. He claimed he had taken the boys on a midnight excursion in freezing temperatures when she vanished.

The children, 5-year-old Braden and 7-year-old Charles, had been living with Susan Powell's parents since Josh Powell's father, Steven, was arrested on child porn and voyeurism charges last fall. There were no accusations concerning Steven Powell and his grandchildren. Troyer said Steven Powell was put on suicide watch in custody after he was told of the deadly blast.

"Steve Powell didn't seem very upset by the news, but was angry towards authorities who notified him," Troyer said.

On Wednesday, a judge had denied an attempt by Josh Powell to regain custody, saying she wouldn't consider returning the two boys to their father until he underwent a psycho-sexual evaluation. A psychologist recommended the evaluation based on undisclosed materials Utah police discovered on Josh Powell's computer in 2009.

Sherry Hill, a spokeswoman for the state Department of Social and Health Services, said the social worker who was with the children was not a Child Protective Services employee but a contract worker with a private agency that supervises visits for the state.

"The visit supervisor for this particular agency had taken the children to the home. When she does that, she sits through the visit and might take notes on her observations," Hill said. "She pulled up in the car, and the kids ran out ahead of her. He closed the door and locked it. She wasn't able to get in, and that's when she smelled gas."

Lawyer Steve Downing, who represented Susan Powell's parents, Chuck and Judy Cox, in the custody fight, said: "It's the most horrifying thing you can imagine happening ...The Coxes are absolutely devastated. They were always very fearful of him doing something like this, and he did it."

Bassett said he represented Powell free of charge because "every parent deserves the right to an attorney." Powell called or emailed him at least once a day, and often more than that, and in their conversations "he never once admitted doing anything regarding Susan. In fact, he denied it."

Sgt. Mike Powell of the West Valley City Police Department in Utah, which is handling the investigation into Susan Powell's disappearance, said it was too soon to say how Josh Powell's death may impact their probe.

"Quite frankly, this has obviously quickly unfolded up in Washington and we're obviously just working through the details ourselves here," said Powell, who is not related to the family.

Kirk Graves, 39, of West Jordan, Utah, whose wife is Josh Powell's sister, said they were stunned by the news.

"We never contemplated the idea he would do something like this. You just don't expect it from a father," he said. "His world was falling apart around him and he was going to lose his boys and get arrested for Susan's disappearance. He's a narcissist and he has no love for anyone but himself.

The day of the hearing last Wednesday, Josh Powell submitted a six-page affidavit attesting to his love of the boys and his competence as a caregiver and insisting that it was time for the boys to come home.

"For over four months already, my interactions with my sons and many other aspects of my character have been investigated and documented by CPS," he wrote. "I have proven myself as a fit and loving father who provides a stable home even in the face of great adversity. ... It is time for my sons to come home."

Pierce County sheriff's deputies and Graham firefighters work through the wreckage of a home in Graham, Wash. where the bodies of Josh Powell and his two sons were found on Feb. 5, 2012 in a double-homicide suicide. The boys had just been brought by a Child Protective Services worker to Powell's home for a supervised visit when police say the dad deliberately blew up the house. A judge had denied the previous week a request by Powell to regain custody of his sons, who had been living with the parents of his missing wife, Susan.

  • Pierce County sheriff's officials said it appears Josh Powell used an accelerant to increase the power of a gas fire that he intentionally set to kill himself and his two sons inside his Graham, Wash., home on Feb. 5, 2012. The saga of the Powell family began in 2009 when Josh Powell reported that his wife, Susan, had gone missing. That night he claimed he took his sons on an overnight camping trip in freezing temperatures.

I don't understand how if he "loved" his sons, why would he brutally assault them and set fire to them... it is a messed up world and I hope the best to the families and friends of the victims. the boys are in a better place now though.. which is all that we could ever hope for them. God bless the loved ones of Susan and the boys. You are dearly missed. but now, you are above, looking down upon us in a better, holier place.

There Josh Powell apologists on this forum that are trying to paint him as a victim of "man-haters", family court and media. From all that I've seen and heard throughout my long life, those who whine the loudest about their victimhood and that of their confederates, usually are the victimizers themselves. You can confront them with the facts, but they are so wrapped up in self-justification and self-pity, that they are incapable of mature judgement and thus have to deflect the blame upon others. There are many Josh Powells out there, both men and women. Some of them have been posting here. Don't waste your time trying to argue with them, they are beyond help. But we need to do all we can to protect innocent people from such as these.

Right, OneMom, he is a narcissist. That's not to say that there aren't some parents who have been treated unfairly by the legal and court system. I happen to know some people who've been through that. But some of the comments I've read on this story show a disturbing tendency to echo the attitude that Josh Powell and his family have shown throughout this case. And that both frightens and disgusts me. Greatly.

Unfortunately, I know all too well how screwed up our family court system is. Things need to change or these cases will multiply. The courts need to start putting what is REALLY in the best interest of the children first.

Wow. I wonder how that social worker is doing right now. I can't imagine how someone could possibly manipulate their children's trust in such a horrible way.
03:13 PM on 02/08/2012
I DONT KNOW WHY HE WAS ALLOWED SUPERVISED VISITS WHEN HE DID NOT GET A PHYSCO SEXUAL EVALATION AND WAS A SUSPECT FOR MURDERING HIS WIFE.
CHILD WEL-FARE SHOULD BE OVER HAULED, THIS PROVES SOMEONE IS NOT DOING THEIR JOB. AT LEAST THESE KIDS ARE IN HEAVEN INSTEAD OF HELL, THAT THEY SPENT ON THIS EARTH.
03:04 PM on 02/08/2012
This was a sick act to include his children in the blast - he needed to go. I can't imagine how Susan Powell's parents are dealing with such a loss after losing their daughter two years ago. Blessings to the parents for strength to get through this.
07:10 PM on 02/08/2012
I agree...to lose their daughter and now their grandsons!!! I have a little 2 1/2 year old grandson and I can not even imagine. My heart breaks for them.

Does anyone understand that sentence? HP, hire people who can write. He was arrested but there were no accusations. Okay, then
10:02 AM on 02/08/2012
"he never once admitted doing anything regarding Susan. In fact, he denied it." Said his lawyer, defending his reasoning for seeking the meeting with the children. Oh well then - I guess that WAS enough to assume innocence. Ridiculous statement!

Courts far too often put children in harms way and the children have no say. They did not want to see him. If the Judge had an inkling of concern (and who wouldn't have?) why not create safer conditions and arrange for them to meet in a secure neutral setting where the children's safety is a 100% priority? This has occurred many times before - where is the lesson learned - children need a voice. Is this too much to ask????
12:54 PM on 02/08/2012
Of course he denied it--but a man who would do what he just did would have no problem with lying, would he? It is just tragic that he was allowed to have those little boys anywhere near him.

Just another good Mormon.

You have to wonder what are the psychological effects of being a good Mormon. You are expected to go door to door to solicit new members, having people yell at you and slam the door in your face all day. All that negative energy has to go somewhere.

Police could probably solve a lot of crimes if they took DNA samples of all of the LDS members.

Antidepressant drugs are prescribed in Utah more often than in any other state, at a rate nearly twice the national average. That is curiously significant and disturbing.

Well the church strongly supports going door to door to convert people as well as busing members to other states to fight against things such as gay marriage.

You have to wonder about people who would belong to such a church.

Why I would probably not vote for a Mormon, as they have no issues with combining matters of church and state.

Wonder why it took the first responders so long to get there?

The social worker tried to help. He slammed the door in her face and murdered them. First responders seem to have blown off the situation as a non emergency at first.
09:07 AM on 02/09/2012
She tried to go in with the children, as this was supposed to be a supervised visit, or so I understood. He shut and locked the door in her face as she stood behind the boys waiting for them to get inside. She was there only a few minutes before the blast--obviously he had everything ready, including the hatchet to hit his little boys in the head with before he blew them up. First responders probably got there as soon as they could, and even if they had been present on the scene would probably not have been able to save the children once they were inside that house--it was apparently just a matter of a few minutes before the explosion occurred.

Well, he killed himself too so if you were right behind him you'd be dead as well. Sorry, couldln't help myself. I live in Seattle, and this story made me sick. But you can't blame the police. They get ONE SHOT at getting it right (when they arrest the criminal) but you'd think after all this time, they would have had their ducks in a row. Another sickie takes innocent lives and doesn't live to tell the truth. Of course, he had plenty of time to tell the truth and didn't.
