Same-Sex Couple Wins Immigration Relief, Despite Defense Of Marriage Act

WASHINGTON -- The Defense of Marriage Act is intact, but at least two same-sex married couples have been granted a reprieve, at least temporarily, from policies that could separate them based on immigration status.

Tim Smulian, a 65-year-old South African citizen, found out on Wednesday that he will be allowed to stay in the United States for at least one year under "deferred action" on his immigration documents. Smulian is married legally to Edwin Blesch, a 71-year-old U.S. citizen, but for years has spent six months in the country, and then six months away because he could only obtain a tourist visa.

"We do see it as the beginning of the light at the end of the tunnel," Blesch said. "We were getting pretty hopeless for a while there. This is a wonderful development for us, and it takes away the day-to-day worry every morning when we get up, 'What's going to happen now?'"

Under the Defense of Marriage Act, there is little relief for binational same-sex couples who want to remain together in the U.S. While straight men and women may sponsor their foreign-born spouses to receive a green cards -- a difficult task, but not an impossible one -- federal law denies the same rights to gay couples, even if they are legally married in their state.

Smulian and Blesch were among the first gay couples to be granted relief by the Obama administration from deportation. Bradford Wells and Anthony John Makk received similar news in January that they could remain in the U.S. For Smulian and Blesch, the effort took two years, during which the couple received pro bono legal support from Immigration Equality, an organization that pushes for fairness for gays and lesbians in immigration law. New York Democrats Rep. Tim Bishop and Sens. Kirsten Gillibrand and Chuck Schumer also took up the cause, pushing immigration authorities to allow Smulian more time in the country.

Bishop made the call to Smulian and Blesch on Wednesday, the first word that their efforts had succeeded.

"He was so wonderful, you can't believe," Blesch said Thursday of the phone call with Bishop. "He was elated himself, like we were elated."

Three months ago, the men said they were afraid they would be apart when one had an emergency -- they both have some health problems -- because Smulian needed to spend time outside the U.S. between each tourist visa. They also were given little information about whether their attempts to extend Smulian's visa would be successful.

"We're living on a tightwire wondering whether they are going to accept the extension or say, 'No, get out right away,'" Blesch said in November. "They keep you guessing, and it's very upsetting."

The deferred action is not permanent; it will expire in a year. But they hope that it can be extended and that the Defense of Marriage Act will end so that gay couples can remain together under immigration law.

"We feel that this is a wonderful personal victory, but we're saddened that it can't be translated nationally," Blesch said.

Although the Obama administration announced last year that it will no longer defend the Defense of Marriage Act in court, the law remains in place. For now, though, some hope the Obama administration will take similar steps as they did with Smulian and Blesch, based on a prosecutorial discretion policy that should allow some immigrants to stay in the U.S.

Gillibrand and Immigration Equality Executive Director Rachel B. Tiven said in statements on Thursday that they will continue to push for equal rights for LGBT immigrant families.

"I am relieved to hear that Tim and Edwin are no longer living in fear of separation at a time when they need each other the most," Gillibrand said. "Loving, committed couples deserve access to all the same immigration rights and protections as straight couples."

and this is WHY, it's so IMPORTANT for DOMA to be gotten RID OF.....it's KEEPING same-sex couples from being treated the SAME as hetro-sexual couples.......it's just NOT RIGHT.......GAY MARRIAGE is NOT going to HURT hetrosexual marriage.....unless those in those marriages ALLOW it to happen.

i ask everyone to TRY and place themselves in these couples shoes....and think about HOW you'd feel if you were TOLD that you COULDN'T have your LOVE with you in YOUR country, just because of their "gender"?

STAND UP FOR WHAT'S RIGHT: RQUAL CIVIL RIGHTS FOR EVERYONE, which includes GAY RIGHTS!

A bit weak to say that they got reprieve though. It's good for a year, and they already have six months' stay legally now, so... it's really just a reprieve for ONE LOUSY TRIP. Could that six months be important? It already is, but let's not go BSing about it. The ruling is weak. Why just one year?

Thank you for covering this story, and correctly articulating the inadequacies of State only sanctioned marriages. In 2006 I had to move to the north of England in order to be with my partner, as England recognized our union and the US does not - I'm a US citizen, born and bred in the US!
Please continue to cover this very important discrimination in US law. There are thousands of US citizens who have either been forced apart or forced to leave "the land of the free" in order to be with their partners.

It's insane that we have to live this way. Still, I'm happy you both have made a home in the UK. If this isn't resolved soon we may also be looking for a third country to move to. Are we living in 2012 or 1812?

i'm beginning to wonder myself.....it's WRONG that couples of the same gender are bing treated like gum on the bottom of someone's shoes......i'm NOT even gay.....and it ANGERS me on EVERYONE'S side.....if the GOP have their way......being gay will once again be a CRIME.....and jail time will be the penality for it.

First, they did follow the law, or did you not read the article. No one was here illegally, he was here on a tourist visa and legally got a deferred action. Nothing illegal about any of those actions, including their marriage.

Second, who exactly was the illegal you refer too?

Third, call it "gay rights" all you want, the reality is that it's equal rights and that's all anyone is asking for.

Some not so classic...Edwin is American and Tim is South African. Tim spends six months each year in the United States on a tourist visa. Edwin wants to be able to sponsor Tim so that Tim can get a green card. They have been given a legal, temporary waiver. Some classic...As they grow older the possibility that one of them will have a health crisis while apart preys on them. Many do have empathy for an older couple that just wants to be together as their legally taken marriage vows proclaimed, until death do they part. As to whether gay rights are strictly a liberal cause, many conservatives would disagree. Gay rights are human rights and support for human rights are found on both sides of the political aisle.

I think the whole purpose of the article just flew over your head. They ARE legal. They follow the law, the foreign partenr can only stay up to six months in the States, then must leave for at least six months before he's allowed back in. He's not being deported, They are being granted an exception to that ridiculous rule.

My foreign born wife was given permanent residential status because she married me, a US citizen.

This is not unusual and should be given to any legally married couple regardless of sexual orientation.

I am in a similar situation. I am an American who married my South African partner in South Africa. He stayed with me in Texas on his tourist visa. When it expired, the government would not extend it. We were forced to leave the US and settle in South Africa. It is really nice here but we want to be home in the States. All of our family is in Houston. Now we starting the daunting task of fighting the US government so that I can sponsor him for residency. Trying to work with the consulate her in Cape Town is like pulling teeth. We have a long uphill battle ahead of us, just for the right to live together as any normal married couple. And the US is supposed to be the most free country in the world. Laughable!

I'm an American with a Brazilian partner. We have to live in Brazil where I was granted a permanent visa based on our civil union here. I can understand what you are going through. We are very fortunate to have a good life here, but I'd love to have the same right as straaight people do to bring my spouse to my own country.

While I do not agree with your lifestyle (I am struggling to come to accept it), I agree with Cacey. I lived in Texas for 10 LONG years, I now live in New Mexico. New Mexico is a much better place; more sane and tolerant. And, its the next state over from crazy Texas; not that far.

I'm hesitant to say it, but while I hope you are able to return to the US as a couple, going to Texas will be like jumping from the frying pan into the fire. Find another state, a sane one.that provides equal rights for all its citizens.
