SAN FRANCISCO -- Netflix pressed the rewind button on its fourth-quarter earnings after settling allegations that the video subscription service violated a consumer-privacy law.

Accounting for the $9 million settlement resulted in a 14 percent decrease in the fourth-quarter net income that Netflix Inc. reported Jan. 25.

The bottom line for the final three months of last year now comes to $35.2 million, or 64 cents per share, down from the previously reported $40.7 million, or 73 cents per share. The company, which is based in Los Gatos, disclosed the change in a regulatory filing late Friday.

Netflix's stock price has surged 23 percent since the fourth-quarter results were released, partly because the company's earnings were substantially above analysts' average estimate of 57 cents per share. But investors mostly were impressed with Netflix's fourth-quarter gain of 600,000 subscribers – a number unaffected by Friday's accounting adjustment

The upturn in subscribers indicated that Netflix had bounced back from a public-relations nightmare triggered by a 60 percent increase in its U.S. prices last September. Netflix expects to sustain a loss this year as it pays higher licensing fees for video and establishes its service in Latin America, the United Kingdom and Ireland.

The $9 million legal settlement rids Netflix of another potential headache.

A lawsuit on behalf of Virginia residents Jeff Milans and Peter Comstock alleged Netflix had been breaking a 24-year-old law by retaining records of the DVDs and Internet video that its subscribers watched for up to two years after they cancelled their plans. The complaint, filed in San Francisco federal court, cited the Video Privacy Protection Act, which was passed in 1988 to prevent video rental services from sharing information about what their current and former customers have been watching.

The class-action lawsuit asserted Netflix violated a section of the law requiring personally identifiable information to be destroyed within a year "from the date that the information is no longer necessary for the purpose for which it was collected."

Retaining former customers' viewing records allows Netflix to restore their old video queues and make better recommendations if they reactivate their subscriptions.

In a statement Friday, Netflix said it didn't make any admission of wrongdoing in the settlement. No other details were disclosed in a settlement notice filed Friday in federal court. In most class-action settlements, attorneys filing the case usually are paid a large portion of any money that is paid out.

Sean Reis, an attorney representing Milans and Comstock, didn't immediately return phone calls Friday.

Netflix has been lobbying Congress to revise the Video Privacy Protection so it can introduce a feature on Facebook's online social network that would allow its U.S. subscribers to automatically let their family and friends know what they have been watching. Netflix already offers the Facebook tool in the 46 other countries it operates, but all but more than 90 percent of its roughly 26 million subscribers are in the U.S.

"This matter is unrelated to the company's concerns about the ambiguities contained in the VPPA," Netflix spokesman Steve Swasey said.

Netflix shares closed Friday at $123.93, down 91 cents.

A few weeks ago I received a notice of a class action suit against Netflix because of some deal they made with Walmart over the sales of DVDs. Something about Walmart not selling DVDs until they were available through Netflix. I didn't respond to it. Did anyone else get that notice?

The sad thing is that previous netflix users will hardly get any of that money. I myself am thankful that I have never used netflix, and have been an avid user of Hulu and Redbox that have both worked great. I don't see netflix ever recovering from this and they are going to need to come up with a lot more money to pay users back and do a little damage control.

I have both Netflix AND Hulu. I pay a whopping $25 a month and am happy to do sp rather then the $70 DISH wants for 3 tv's plus local stations. . As to Hulu - ever look at their list of movies?? There are so many that are so bad they are like what would be left over in a store that was closing down and you could not give away for free....horrible. I could never survive just on Hulu. I have kept the DVDs from Netflix as it often takes a while for movies to allow streaming. I like the option and could never do Redbox as it is a 25 minute drive in our rural area just to get to one! My laptop is hooked up to my 55" TV so that I can watch all the TV shows I want too. Just go to CBS, ABC, NBC or FOX -- forget TNT as for them you need to have an account with only the providers they list. So you still have to pay to watch them, no big loss tho.

I have had Netflix and no TV provider for over 3 years now and have no complaints. But I also am not one who sits in front of the TV all day. I really like Netflix and feel they offer a very decent fee for their services AND no contracts!!

We're using Crackle (free) and Amazon Streaming ( free with our Prime membership).

We also stream VuDu occasionally. Saves the 10 mile trip to the nearest RedBox as we

live in the country.

It's nice to have options.

Say what you want about HULU, but I think it's great. I started renting from RedBox but I don't like having to bring movies back by 9pm the following night or get charged . And, I have watched FAR BETTER movies on HULU than what I rented from RedBox. /abd a friend wanted to stream a movie via Netflix that I wdatched on HULU but it wasn't available for streaming. I have watched terrific movies on Hulu..Don't have to mail or wait for anything and can watch anytime. Commercials don't bother me, they are only 30-60 seconds with timer You can watch most past episodes of shows. Wouldn't trade HULU for Red ot Net.

I stopped using redbox when they charged me 104 dollars for two movies that I brought back and they tried to only give me 52 dollars back so I went and marked it as fraudulent and got a police report and my bank gave me my 104 dollars back.....I was pis.sed they were polite about it untill I told them no I want all my money back I don't care what your records show....been abou two months nothing on my credit report just yet about it and they are blocked to hit my bank account so...I they can get bent...

I have been a member of Netflix for years.... AND have had No problem. I rec'd DVDs and watched streaming videos. So Much Better watching what I wanted to watch and not that 'stuff' on TV now adays.
-- some argue movies aren't the new ones - As for me, most of the 'new' movies aren't worth watching anyway! - but that's how I see it!

- I then switched to just streaming videos 'cause it was just simpler (& no DVDs in the mail). And again, no problems.
i love the convenience of watching when & how often i want to. PLUS i don't have to go to a box to figure out what i want to watch (or go online to researve a dvd) AND, more importantly, i don't have to rush back to return the DVD!

I agree. Once the contract with DISH is up in October I'm dropping them like a bad habit and watching my Netflix.

Plenty of content there and they add new stuff all the time.

I had Hulu plus for a week and fed up with the commercials. Needless to say, I cancelled it and never went back. I am not sure why people dislike Netflix. It's the best thing in the streaming video now. I can select my choice, play and watch it in mere three seconds. It only costs me $7.99/month.

This sounds like a purely frivolous money grab lawsuit to me. What's wrong with Netflix storing former members' old rental queues? It's not like they're storing their social security numbers or bank account information. It's actually convenient for the customer because a lot of people cancel their subscriptions, then return. If they don't return, the information eventually gets discarded. Who cares if Ms. Paula Sims watched Men in Black from 07/12/2010-7/19/2010 and Avatar from 9/23/2010-9/27/2010, anyway? How ridiculous.

I would guess one if you are just suspending and re-activating. But knowing Netflix, and their need to post positive results, they are probably counting 3 NEW accounts. lol
