Al Sharpton Considering Suit Against NYPD Over Allegations It Spied On Him

A day after a Huffington Post blogger and NYPD gadfly Len Levitt wrote a post alleging that the New York City Police Department planted spies inside the Rev. Al Sharpton's National Action Network headquarters in Harlem, Sharpton has threatened to sue the city.

According to Levitt, the NYPD also has allegedly tried in the past to discredit Sharpton by spreading rumors that he is gay.

In the post, Levitt, a veteran police reporter and author, alleges that an NYPD informant was inserted inside NAN headquarters to gather information about any large-scale protests being planned in response to the acquittal of police officers involved in the killing of Sean Bell, an unarmed black man who was killed just hours before his wedding.

The confidential informant attended a NAN meeting on May 3, 2008, and reported back to the NYPD's Intelligence Division, according to information that Levitt said he obtained from a police document that was marked "secret."

According to Paul J. Browne, NYPD's head spokesman, the intelligence unit was in fact involved in intelligence gathering inside the National Action Network headquarters during that meeting.

But, Browne said, they weren't after any dirt on Sharpton or his organization.

"Neither the Rev. Sharpton nor the National Action Network, but a separate individual who was present was the subject of the NYPD Intelligence Division's interest at the May 3, 2008 meeting in question," Browne said in an email to The Huffington Post.

Levitt said the document also included a detailed description of NAN's protest plans, the names of prominent blacks who would participate and the locations where protesters would gather on the day of the planned protests.

But perhaps the most shocking claims made in Levitt's post are those around an NYPD plot to discredit Sharpton by spreading rumors, beginning in the '80s, that he was homosexual.

According to Levitt, "Two undercover police officers who spied on black protest groups in the 1980s told this reporter in 1998 that the department was so intent on discrediting Sharpton that they were tasked by their superiors to spread rumors that he was homosexual."

In a statement released this afternoon, NAN attorney Michael Hardy said the organization might sue the city over the allegations.

"We are weighing all legal options, including whether there was a violation of federal consent decrees," Hardy said.

A number of high-profile African-American leaders chimed in on what a NAN spokeswoman called a "blatant attempt to discredit Rev. Al Sharpton with malicious and defamatory falsities, including that he is homosexual."

"The NYPD's spying actions are an intolerable abuse by law enforcement, and remind us of the bad days when J. Edgar Hoover recklessly spied on Dr. King and other Civil Rights leaders in the 1960s," said Marc Morial, president of the National Urban League, in a joint statement released by the leaders and the National Action Network. "It's time for NYPD to disclose the full extent and nature of its spying operation on all Civil Rights organizations. We will not stand for a return to this abuse of process in the 21st century."

Benjamin Jealous, president of National Association for the Advancement of Colored People said in the statement, "If NYPD is spying on civil rights leaders, it is outrageous and must be stopped."

Rev. Jesse L. Jackson Sr., added: "African American leaders have historically been the subject of unlawful spying by law enforcement officials seeking to discredit our leaders and our movement. The revelation about the New York Police Department spying on Rev. Al Sharpton and the National Action Network in 2008 are wrong -- Police Commissioner Kelly, as he promised over a year ago, must issue a full fact finding report on the matter, fully disclose the spying activities of the police department and make restitution to Rev. Sharpton and NAN for this invasion of privacy."

Even music mogul Russell Simmons added his two cents, saying that he was "deeply concerned" about the reports and that "It is troubling to think that those who are ordered to protect us are in fact working against us."

The NYPD has come under fire recently for revelations made by the Associated Press that it had been using secret surveillance on Muslim communities.

"The unjust investigations and targeting of civil rights organizations is unacceptable," Melanie Campbell, president of National Coalition on Black Civic Participation and Black Women's Roundtable, said in the joint statement. "We stand with NAN and others in the civil rights community calling for NYPD to be transparent about the nature of this investigation immediately."

It is unclear, based on recent judge's opinions on the rules that govern police surveillance, whether or not the NYPD was operating within its guidelines when it allegedly sent an informant into NAN meetings. The rules are "vague enough that no one seems to be able to determine now exactly what the department can and cannot legally do," Levitt wrote.

Browne, the NYPD's spokesman, had no immediate comment regarding the allegations of spreading rumors that Sharpton was homosexual.

investigate how he sets up family members and associates to get credit cards in their names , then he adds himself as a supplemental card holder, then he has them claim their employment and income from one of his many 'organizations" and then after they hit the high mark, the 'basic" then files for bk and sharpton scores yet another 100k hit- pathetic.

Al has been out of the lime light lately. So he has to get some attention focused on him. But than again if he was spied on our big brother government shuold be taken to task.

I'm confused! Anyone that was in the forefront of the civil right campaign new that they were being spied on by federal, state and local agencies. It was part of the cost of being an activist. Ernest Withers who photographed almost every civil right participant was an informant for the FBI. So one has to wonder why Rev Sharpton finds it surprising that he was being watched by the local police force?
From a personal stand point, if I claimed to be an activist for civil rights then I would be upset if they didn't spy on me because that would mean that I was irrelevant and had no impact in my community.

Let's look at who the true "politically motivated investigators" are these days - Obama. He's developed a # of programs for spying on those he thinks are his enemies (e.g. anyone who disagrees w/ him.) I've listed them below:
1) He's launched a program called "Truth Teams," w/ several websites (AttackWatcch & KeepingGOPHonest) with goals of finding damaging material about Republicans & encouraging supporters to "report" instances of supposed anti-Obama speech.
2) A close relationship between the White House & a far left liberal organization called Media Matters has recently been revealed. Primary goals of Media Matters are to dig up dirt on Fox News employees, Republicans or anyone else who fails to support Obama policies. The organization is also apparently a conduit for the mainstream media, virtually supplying their liberal materials on a daily basis. How convenient for Obama!
3) Obama's passed polices allowing his administration to spy on selected internet sites. Homeland Security is now monitoring for what they call possible national "threats,"w/ ridiculous criteria such as anyone who's stored food & supplies for 7 days. Basically, these policies were implemented w/ the purpose of trying to intimidate & shut down adversarial speech.
Not since Woodrow Wilson has any president been so paranoid, inscure & immature as to encourage others to spy on supposed enemies. It also reveals the extreme narcissism of this president.

the nypd intelligence division was not spying on sharpton or nan,it was spying on a person of interest that was involved with nan,so now dont you feel bad about over reacting?sit down and have whatever you have when you have a paranoid melt down cause everthing is ok now.

Shocking...........No! One of the most racist and dangerous police departments in america patrol the city that never sleeps. Think of Amadou Diallo,Sean Bell, Eloise Bumpers, just to name a few all murdered by a trigger happy police department that is trained supposedly to serve and protect but more then likely will kill you in the process.Commisioner Kelly should have been gone a long time ago; it was former mayor Rudy Gulliani who set the tone by giving the men in blue free reign shot first and ask no questions. Now you must know that most of the informants had to be black which is really a shame that in these days and times we've got negro's who have no backbone and will do anything for a dollar.

Amadou Diallo's mother was there with Sharpton and leading the women who gathered to give support to Sean Bell's fiancee. All of them had been victimized by the loss of a child or other family member at the hands of the NYPD.
Giuliani on the other hand set the tone for setting up John McCain whom he knew very well and was an inveterate gambler who never paid back a dime for gratis hotel accomodations when Rudy took him to casinos; and this was revealed by an Italian informant who used to work in the Mayor's office back before Guiliani was being heroic and was just on the third wife, a relationship which severed his children's filial allegiance.

Like COINTELPRO ever went away. You know it is bad when the best they can do is infiltrate NAN, let's face it, they only take action when they story is one they can be sure to get coverage on. Maybe crime needs to return to NY it appears the police have too much time on their hands for non-criminal activity. Either that or it is time for a new round of sensitivity training or no you can't just shoot them cuz they're black training.
