Miramonte Civil Cases Could Hamper Criminal Investigation, Says Sheriff's Department

LOS ANGELES -- The investigation into a former third-grade teacher charged with committing lewd acts on students could be hampered by the flood of civil cases related to the scandal and public statements made by alleged victims, according to Los Angeles County sheriff's detectives.

The charges against Berndt, 61, were made public Jan. 31. He faces 23 counts of lewd acts upon children, ages 6 to 10. Since the charges were announced, civil attorneys say they are representing more than 60 victims, the Times reported. Earlier this week two alleged victims appeared with their attorney on the "Dr. Phil" television show.

"The lawyers are making it that much more difficult," William McSweeney, chief of detectives for the Sheriff's Department, told the newspaper. "It is going to raise issues of credibility."

The civil attorneys have made claims about Berndt that are not contained in the original charges, including some accusations – repeated on "Dr. Phil" – that Berndt fed the alleged victims cookies with his semen on them.

Investigators say that although they suspect Berndt fed his semen to some students during "tasting games," they have no evidence to prove it.

Last week, one attorney suggested that another teacher at Miramonte was involved in the Berndt case. The department took the unusual step of publicly stating the teacher was not a suspect in the case.

Berndt's attorney has declined requests to discuss the case.

The civil attorneys say new alleged victims are continuing to come forward. Detectives are still investigating and are urging families to contact the Sheriff's Department before seeking private counsel.

In interviews with the Times over the past two weeks, plaintiffs' attorneys and some parents are have provided details and added new allegations that go well beyond the criminal complaint.

Prosecutors have the advantage of physical evidence, in the form of hundreds of photographs that Berndt allegedly took of his students.

At least two families said they were so disturbed by the photos that they raised concerns at the school. But there is little indication that the children complained about what was going on in Berndt's classroom.

"It's a grotesque form of eroticism," attorney Matthew McNicholas, who represents six alleged victims, told the Times. "That's why, for the most part, it doesn't register with these kids. . They just don't know how to comprehend it."

Meanwhile, superintendent John Deasy sent a video message to all 85,000 employees of the LA Unified School District, saying the allegations at Miramonte don't diminish their work.

"Just because a few members have done terrible things," Deasy said in the video posted Saturday by the LA Daily News, "that does not reflect on the amazing teachers, leadership and classified staff I see every day at LAUSD."

The four-minute video, titled "Breaking the Silence," encourages employees to learn from what Deasy calls the "tragedy" at Miramonte Elementary – starting with a review of the district's child abuse training.

Deasy also explains the status of the Miramonte staff and faculty who were replaced while the district investigates the allegations. The removed staff members have been relocated to a new, unopened high school nearby.

Deasy says they are being interviewed by police and district investigators and counselors, and attending professional development classes.

All will have the chance to return after the investigation, Deasy said.

I'm a teacher. I've got hundreds of photos of my students. We play a game every year where kids eat a pie, and donuts hanging from strings, with their hands tied behind their backs, there's video of it. I played these games when I was a student. There is a spoon with my DNA on it in my trash can right now.
I'm not defending these guys, but my point is wait for the facts people. That second guy already had one of his 2 accusers recant.

Very solid rhetoric. I'd agree with you, and I am sure the 2 teachers that have been arrested every day since this story broke are mostly innocent and all must be treated as such before proven otherwise. However , I work for the district and know how the discplinary and asset management offices operate. Berndt was sought by police because what the photo shop clerk saw was very disturbing. I am sure if we compared your photos to his you'd note a lurid quality in the angles and the the subject's positions. They'd be posed for optimal purpose and yours are probably spontaneous, occassionally out of focus , kids animated, happy. The districts efforts to sever the mans employment without contention was facilitated by illegal use of his credential which was supposed to be suspended by CTC, the promise of a good record and a large sum of $ innocent teacher's are terrorized, threatened, intimidated and their credentials are referred to CTC for revocation so the teacher will resign . I am not talking about a teacher accused of sexual misconduct or abuse. I mean whistle blowers , victims of admin. reprisals and veteren teachers who cost too much.mthey make up charges or decide teacher is crazy. No due process. Just paid hostages Buber stamped through and ruined.

The parents are outraged.
But more than half of them are hardly involved in their children's life. Send them off to school in the morning.
Then, they get out of school and all you ask is, "How was school?" "Good." "Oh, okay, good."

I mean, come on.
Do your part, too.
And I know that not all parents are like this.
I know there's those of you whom are great with your kids.

If 60 parents are willing to take the extraordinary step of participating in a lawsuit, I doubt it affects credibility. If anything, it makes it clear that it is a problem that cannot be brushed aside. Even if there was a civil judgement, how much money would each parent get?  Not much would be my guess.  But since the problem has been hidden for so long I would be pretty angry that a criminal investigation had not been done a long time ago and that one may not produce results after this amount of time.

So the accusation about the other teacher came from a civil attorney? WTH? Throw him or her in contempt. These attorneys and misguided parents are going to kill this case and if this guy actually did what he's accused that will be absolutely tragic.

These parents don't get it. You need to get a criminal case and the facts straight to stand a better chance of recieving monetary compensation in a civil case. If they interfere in the criminal case then they may damage the ultimate outcome of any civil cases that can come about. To the parents: let the police do their job first and get a conviction, then sue the heck out of the teacher and the district.

That's why the civil suit should wait. The chance of having evidence and witnesses being dismissed by the defense attorney is too great.

Did they file a case yet? I don't think so. The lawyer wants to win and he knows what you're saying too. The families needs the lawyer now for a proactive representation and protection. There's been threats of deportation.

What's the bloated burocracy doing now? Sulgs are all hiding out and taking daze off. Let's see, time for LAUSD to hire a high priced commission. Yup

To the teachers being accused now and graciously recused by police as this one here and many others is kind enough to Here and in other reports: keep these articles, get an Attorney and don't trust the union, which will likely abstain from representing any member accused of molesting children or failing to report it. Ask for help but do not be stunned if you bare ignored. If you do not recieve aid in a week or two, file a PERB ( forms are on line). If your rights are violated by Lausd file DFEH ( on line) and look for work elsewhere before they ruin you with suspension , record of admin lave,netc. If out cannot afford an attorney or need support contact us at www.perdaily.com

Why are the commenters here mostly illiterate? Did anyone read the article before blaming the police?

The article clearly stated that the Sheriff recommended that parents wait until the criminal trial is concluded before seeking a civil trial. This eliminates the chance that the defense attorneys will seek motions to dismiss on witnesses and evidence.

The sheriff's dept. has purportedly been investigating this case for nearly a year now so it should have had ample time to collect evidence before the matter became public. There may be a statute of limitations issue as to the civil suits.
