Ohio Teen Sentenced In Rape Of Child At McDonald's

CINCINNATI -- A 13-year-old boy who admitted raping a 5-year-old girl at a McDonald's play area in southwest Ohio has been sentenced to an inpatient treatment facility for at least six months.

The Hamilton County Juvenile Court administrator says the boy must successfully complete treatment before his release from the secured center. The judge on Tuesday also placed the teen on probation.

The boy last month entered the juvenile equivalent of a guilty plea to the rape charge in Cincinnati.

Authorities say the assault occurred Oct. 29 at a McDonald's in the Cincinnati suburb of Anderson Township. They say the girl's grandmother was nearby in the restaurant at the time.

The boy's parents brought him to authorities after a security camera photo of the suspect was released.

This kid was given a lenient sentence because he's white. He would have been sent to prison had he been black.

sounds like all adults involved were quick to do something about it once they were aware. hopefully both of these children can get all the help they need to ovecome this horrible situation.

You are correct. This is just the first of many times he will be caught and prosecuted. The unfortunate part is there will be many victims between each arrest. These bozos learn from their mistakes and make corrections.When he's finally sent to adult confinement he will meet up with those just like him; when that happens they will get together and trade "war stories" about their exploits, in full detail. They get their jollies by listening to the stories of others. They also exchange trade secrets, like other specialized criminals, like the dos and don'ts of the "job"

It's a shame that he is to be written off at such a young age but these guys rarely change, they just get better and more violent with time.
Guaranteed, this kid is blaming that little girl and his parents for his current situation and that will be added to his reasons for doing what he will surely do.
Six months therapy? What a sad,sorry joke. Hell, The shrinks can't cure smoking or overeating in six months, are they going to give him ECT? I doubt it, he is just 13 and he must be given the opportunity to change; there is that faint chance that he will. Hope springs eternal.

I hope they will investigate whether or not he has been abused!! That is a very common root cause of such behavior, and if it happens to him in the facility, all bets are off.

In some states this boy would have been charged as an adult. In this case, the right decision was made. Treatment will work if the boy can admit his responsibility to the younger child. Someone needs also to look into the child's background as he was likely sexually abused himself. How else did he learn to do what he did?

How did he learn it? First, it's not something any human being needs to be taught. Second, any youth with access to the internet knows all there is to know. You didn't know the difference between what is right and wrong at age 13? Any sensible teen knows this is a horrific act. I'm not saying he should get twenty years at the state pen, but this verdict is far too light. A five-year-old girl was raped, her virginity and innocence stolen.

The relatively insignificant sentences handed out to juveniles is the reason many families of juvenile victims don't pursue justice further. To do so would require the victim (in this case a 5 year old) to confront their abusers in court and relive everything that was done to them as well as be subject to a possibly rigorous cross-examination by the defense. Given the reality of the leniency of the eventual sentence, many opt to spare their children further damage by dealing with the trauma privately through therapy.

she is going to face this daily for the rest of her life ..she is a very brave girl some day justice has to be found for her..... the system failed her ....i wonder if the next time he rapes the victim will get justice ?

Firstly, the parents of the 13 year old turned him in...so there was no court case or need for the victim to have to testify. Secondly, judges in many states often accept young victim's testimony to be recorded so they don't have to face the perpetrator...You may be right about wanting the victim to avoid testifying if a recorded testimony, but that would more likely be to protecting the victim, and I don't know of any parents who don't pursue justice for their victim children because of "insignificant sentences". Getting the perpetrator on the sex offender registry to protect other children is often cited as being most important to many parents and victims, and they aren't going to not testify because of insignificant sentences. That reason may be cited with adult victims, but not children. Read some statistics charities and the justice department if you need more confirmation.

Actually, I speak from experience. My nephew was molested in the mens room at a local WalMart. His attacker was 13. The prosecutor in the case told us that because of his age and the laws the perpetraitor would likely face about 6 mos in a juvenile treatment facility. His records would be sealed and he would not be required to register as a sex offender.

First of all, I would never leave my 5-year old unattended anywhere, including a McDonald's playground. Grandma was not doing right by that child. Second, seems like investigators ought to check out the boy's family - his behavior didn't happen in a vacuum, and I would not be surprised to hear he'd been sexually assaulted by a family member or family friend himself. I am amazed in this day and age by how many parents and other caregivers still leave their children unattended, then are shocked, shocked I tell you!, when something bad happens. Keep a dam# eye on your kids. It's not rocket science, but does require some basic effort. Geez.

My, aren't you a judgmental helicopter parent. Around here, kids that age walk to school "unattended."

Point to some statistic showing me how "common" child on child rape is at that age. It is shocking because it so rarely occurs in public. If you want to live in fear of what is so rare as to be statistically unmeasurable, and work to erase all risk in your kid's life, don't be shocked when your kid turns out all screwed up.

However statistically miniscule isn't it still a good idea to watch out for your kids? The trauma this little girl endured will likely be with her for a lifetime. Isn't it primarily a parent's job to protect their children? I personally would not a let a 5 year old walk to school by themselves. Not when children even older than that are abducted off the streets everyday...Since when did using some common sense to protect your child make a person a 'helicopter' parent?

Sorry but in this world there is no way in cold helll my child is walking to school alone. And before you retort, no I don't still breast-feed my six and eight year old or give them baby food too; I just cannot trust the goodness of other people to secure the saftey of my children. SweetTart is right. Keep an eye on your kids especially in public.
Sorry you think we live in fear but its purely idiotic to not protect your children because 'rape in public' is so uncommon. Try telling that to that little girl.

Around here the McDonalds play areas have tables where the parents eat while they watch their children, it says the grandmother was close by, probably sitting at a table watching her grandchild play. Once the children go into one of the tunnels or little cubby holes, you cant see them but you can see the only entrance in and out of the play area which makes you think if your child was bieng abducted you would be able to see and do something about it. Parents watch out for other adults that would harm their children, it probably didnt cross her mind that a child would do something like that to another child. More than likely she thought her grandchild was safe playing with other kids while she sat nearby.

Some people are just sick individuals and just plain immature.First I have some moron bothered by the fact that I wrote that this story made me speechless when I read it and now I see people on here actually making jokes about this situation.If this was your 5 year old would you want people making jokes.Some people are just heartless its sad really to think you get some kind of sick humor out of what happened to this poor child.A 13 year old boy forcing himself on a 5 yr old girl is not in any way funny to me.That poor little girl never stood a chance against him..how awful she must have felt to be so defenseless and not understanding what was happening to her and having no choice but to just let it happen knowing she could not fight him off! Most of you probably never felt what its like to be defenseless against another and having no way to stop it until he decided when he was finished.Now because of this boy this little girl will have to deal with this for the rest of her life. Take it from me my family is dealing with a similar situation regarding my niece its been 5 years but it still hurts like hell and everyone is still suffering over it including my niece who is now 12.My heart is hurting for this child. No child should ever go through this.

The boy is lucky he is only 13 because if he was a few years older the charges would of probably been a lot harsher. But for the good people in the world it is not good because the sentence should of been worse because a boy who rapes a 5 year old will rape again because we know rapists never stop. I'm sure his parents and lawyers say he is a good boy he just didn't know and made a little mistake. One American law that sucks is someones sentence can be much smaller when you are younger. Sentences should be the same for all ages whether your 13, 35, or 99.

That's idiotic. A 13 year old does not understand the consequences of his actions to nearly, nearly the same extent a 35 year old does. Children ARE NOT adults. They just aren't. Analysis of the functioning of their brains will indeed show you this, and has been shown too many times to count. Also, children who are sent to adult prisons, who are put in prison for long amounts of time (the same amount that an adult would be) LEARN how to commit crimes from the adults that they come to DEPEND on inside. They basically end up with 'parents' in prison... adult criminals who take them on to 'protect' them, either in return for sex or maybe because they have children on the outside. What do they learn from these substitute criminal parents? How to commit crimes. How to be violent. Not only that, but children in prison for a long time will absolutely not know how to function on the outside. Children can be rehabiliated and become successful members of society. A child's mistake, that they make out of emotional pain from their own abuse, or simply out of immaturity/not knowing the gravity of the crime they commit, should not cause them to lose their whole lives. Not when they CAN be successfully rehabilitated, educated, and incorporated back into society.
