BP Oil Spill: Judge Rules Company Liable For Civil Penalties

NEW ORLEANS (AP) — A federal judge ruled Wednesday that BP PLC and one of its minority partners in the blown-out Macondo well are liable for civil penalties under the Clean Water Act for their roles in the nation's worst offshore oil spill.

U.S. District Judge Carl Barbier also ruled that Deepwater Horizon rig owner Transocean Ltd. may be liable under the same law as an "operator" of the well. The judge, however, said he couldn't decide before a trial scheduled to start Feb. 27 whether Transocean meets the definition of that term.

The Justice Department argued that BP, minority partner Anadarko Petroleum Corp. and Transocean are each liable for per-barrel civil penalties for oil discharged from the well.

Barbier rejected Anadarko's argument that oil discharged from Transocean's rig, not the well.

"Pressure within the earth drove hydrocarbons up the Macondo Well, through the (blowout preventer), and finally out the riser," the judge wrote. "Thus, the uncontrolled movement of oil began in the well. The riser and (blowout preventer), by contrast, were merely passive conduits through which oil flowed."

Barbier also ruled that BP and Anadarko — but not Transocean — are "responsible parties" under the Oil Pollution Act for oil that flowed from beneath the surface of the water.

Transocean said the ruling is a "vital win" for the company and for the "long-term viability of the industry's operator-contractor model."

"This decision states clearly that BP is the responsible party and reaffirms the long-standing legal, regulatory and economic framework that has been employed by parties in the offshore oil and gas industry for decades," the company said in a statement.

In response to the ruling, BP spokesman Daren Beaudo noted that the company already has paid out billions of dollars in claims to individuals, businesses and governments.

"Long before this motion and its resolution today, BP had committed to paying all legitimate claims and helping economic and environmental restoration efforts in the Gulf Coast. BP continues to stand behind that commitment," Beaudo said in a statement.

Anadarko, which owned a 25 percent share in the well, agreed last year to pay $4 billion to BP as part of a settlement

MOEX Offshore 2007 LLC, BP's other minority partner, agreed last week to pay $90 million in a settlement with the federal government and Gulf states over the spill. The agreement included the largest civil penalty ever recovered under the Clean Water Act, but that record is likely to be shattered if BP reaches its own settlement with the Justice Department.

The trial slated to start next week is designed to identify the causes of the blowout that triggered an explosion on the Deepwater Horizon on April 20, 2010. Eleven workers died in the blast.

Great! Now the trick will be getting them to pay! For livelyhoods lost and ruined and for the enviormental damage. Good luck on that. These companies will spend billions to keep from paying one dime to anyone else. It is like trying to break into a vault. It will be decades before they pay anything and then, they hope, that most people will die off and the enviroment cleans itself!

The judge left out that We The People owned that oil and natuural gas that was released in the GOM. We contracted with BP to produce our oil. BP was acting under the rules that We established. We The People knew that BP was a bad risk because of their past errors. We The People were to be the customers of this oil. We The People were planning on taxing this oil. We The People would have been the greatest beneficiaries of this oil. Without our Demand, this well would not have been drilled. We The People are lucky to be able to be Deniers. We The People were lucky to be allowed to sell our stock in BP before any judgements were announced. We The People are free to continue to pollute this planet without any constraint.

We the people contract with "others" all the time to produce goods and services for which we pay and we expect that they will exercise due diligence with regards to safety in the production of those products. On the other hand we are told by the GOP (Grand Oil Party) that we are regulating the poor babies to death and that if we want to freeeeeee up the engine of economic growth we must reduce regulations Hence we have economic and environmental disasters like the BP blowout, the derivative generated recession and the Greek debt crisis. In response to this the GOP blames the victims and says we only need to deregulate some more.

What has been done that addresses the issue of the next spill? Is there a requirement that an actual disaster reponse mechanism be put in place. At the end of this there was quite a bit of press on citrifugal oil/water separators that were supposedly highly effective at getting to the oil before it hit shore. The oil industry (all players) should have to fund a fleet of barges that are stationed within a one day travel to any potential drilling/well site experiencing a spill.

When an industry is pulling in 10's of billions of profits per year there is no valid arguement against them funding a capable rapid response fleet that is pre-equipped with these separators.

We The People make over a trillion dollars a year in the petroleum business. We The People profit more than the entire Industry combined, at least according to US Government-approved financial reports. Maybe we should do something to ensure that our oil doesn't get spilled before we purchase the products and spill them on our highways and spew them into the air.

The oil is being sold in the world market benefiting investors and oil barons (Koch Brothers etc..). We the people are not profiting, those the few are.

and lastly SCREW OIL AND COAL! We should have been beyond this technology a long time ago.

So what? They fine these corporate polluters a few days profit and say they did their job. How about the damages this oil spill created and will continue to propagate on our (yes, I said OUR) environment? Just because they hid it underwater does not mean it is not damaging the very fabric of our oceans. I'll believe in JUSTICE when I see the bodies of these corporate mongers wash up on the beach with the dolphins!

How about the fact that We The People spill millions of gallons of oil, gasoline, diesel and antifreeze each year on our roads made of the same stuff that they want to pump through the proposed Keystone Pipeline?
How about the fact that We The People killed all of the coral reefs in the Gulf of Mexico with our sunscreen?
How about the fact that We The People created a huge Dead Zone in the Gulf of Mexico with our fertilizers?
I'll believe in justice when the oceans cover half of the US due to our greed and wanton pollution. We still purchase close to a million gasoline-powered vehicles a month after 40 years of warning that they are bad for the environment and out economy. We say, "The Devil (industry) made me do it."

How about the fact that they want the pipeline to go through our nation's bread belt. If that oil leaks into the soil, it can end up in the nations largest aquifer, the Ogallala which is the primary water source for those crops.

We will see if how this plays out, but I still feel that all parties involved in this disaster should not be allowed to drill for United States oil for at least ten years as punishment for destroying lives and livelihoods for years to come.

We should find the millions of Americans that sold their BP stock a few days after the BP Blow out. They were owners of BP at the time.
