Maryland Gay Marriage Bill Approved By State Senate

Maryland Gay Marriage

SARAH BREITENBACH   02/23/12 08:56 PM ET  AP

ANNAPOLIS, Md. — Gay marriage is all but legalized in Maryland after the legislature gave its final OK Thursday to the law that's being sent to Gov. Martin O'Malley, who said he expects to sign it sometime this week.

The state Senate voted 25-22 for the law. The vote comes less than a week after the House of Delegates barely passed the measure.

Maryland will become the eighth state to allow gay marriage when O'Malley – who sponsored the bill – signs the legislation. The Democrat made the measure a priority this session after it stalled last year.

"This issue has taken a lot of energy, as well it should, and I'm very proud of the House of Delegates and also the Senate for resolving this issue on the side of human dignity, and I look forward to signing the bill," O'Malley said in a brief interview after the Senate vote.

Opponents, though, have vowed to bring the measure to referendum in November. They will need to gather at least 55,726 valid signatures of Maryland voters to put it on the ballot and can begin collecting names now that the bill has passed both chambers.

Some churches and clergy members have spoken out against the bill, saying it threatens religious freedoms and violates their tradition of defining marriage as between a man and a woman.

"The enormous public outcry that this legislation has generated – voiced by Marylanders that span political, racial, social and religious backgrounds – demonstrates a clear need to take this issue to a vote of the people," Maryland Catholic Conference spokeswoman Kathy Dempsey said in a statement. "Every time this issue has been brought to a statewide vote, the people have upheld traditional marriage."

Leaders at the Human Rights Campaign, a group that joined a coalition of organizations to advocate for the bill, said they expect opponents will gather the required number of signatures.

"There remains a lot of work to do between now and November to make marriage equality a reality in Maryland," Joe Solmonese, HRC president said in a statement released Thursday. "Along with coalition partners, we look forward to educating and engaging voters about what this bill does: It strengthens all Maryland families and protects religious liberty."

Senators rejected some amendments to the legislation Thursday. Proponents warned that amending the bill could kill it because gathering enough support for altered legislation in the House would be difficult.

Last year senators passed a similar measure by 25-21, but the bill died in the House after delegates rescinded their initial support citing concerns that it could violate religious liberties of churches and business owners who do not support same-sex unions.

Sen. Allan Kittleman, the only Senate Republican to vote in favor of the legislation, said he is proud of his decision and not concerned about political consequences down the road.

"You don't worry about politics when you're dealing with the civil rights issue of your generation," said Kittleman, R-Howard, the son of the late Sen. Robert Kittleman, who was known for civil rights advocacy.

Christy and Marie Neff, who married in Washington, D.C., where same-sex marriage has been legal since 2010, stood outside the Senate chamber Thursday evening as crowds surrounded O'Malley and other key supporters.

The couple, who lives in Annapolis, has lobbied lawmakers to support the bill in recent years.

"This is our victory and we're going to savor this because you can only really jump one hurdle at a time," Christy Neff said. "So we're going to savor this and then if they bring it to referendum, we'll match that effort with the same sort of effort we did today."

My son is gay and I mean Really gay. Everyday I swear that kid tries to wear every color of the rainbow (face palm). He makes me laugh constantly. Some of his little antics and mannerism just crack me up. It really makes my day when I get to see him try and squeeze into those skin tight jeans.

He laughs at me when I'm flirting with the neighbor. Calls me gross when I go on a date or when I tell him I gave her a kiss good night. Last week he put glitter in my car air vents, so when I turned the heat on a billion pieces of glitter flew out at me. I have yet to get him back for that.

It's just me and him, and that may make the difference.
But we have a great time and I couldn't imagine life with out him.
Still, the reality is I won't be here forever. And I pray everyday that the good Lord takes me first.

But to know this funny, intelligent, handsome, gay kid, will live in a Country. Where he is not allowed the rights, of every other American.
Is truly sad.

What a great post. I hope you show it to your son, he deserves to see it and feel the love I get through what your wrote. I am confident that one day he will see equal rights and that you may get to see him marry the man of his dreams. In the mean time just keep being the great Dad you appear to be.

Oh, he knows. He likes to hold it against me too.
I'll tell him "love ya son" and he says"Ew gross, you love a guy?"
It was funny for the first year. Now, 3 years later, I've requested he learns a new one.

But, I posted because I had read a few comments on how parents have a hard time dealing with the "sexuality" of their child. Granted, I did two. Me and Jake (son) kind of lost touch when he came out at 14. We were just feeling very awkward around each other, I guess.

Then a few months later, my wife and two oldest sons were lost in a car accident. I don't think I have left Jake's side since then. As I surely never plan too. But, I wanted to let people know that there are worse things in this world than your child's sexuality. Granted, you may have to work at a relationship with him/her. Yet, I would have much rather had to work at it, then be forced together through tragedy.

But when you are. It truly opens the eyes to whats truly important, and whats not.

Thank You for you kind words.
Respectfully,
Professor Holland.

Annie, when you can point out anywhere in the Gospels of Jesus Christ where he actually says that homosexuality is wrong, that homosexuality is a sin, or that homosexuality will send you to hell, then maybe your comment about "spreading the Gospel" would mean something. Problem is, Jesus never said word one about being homosexual. Jesus was an advocate of loving thy neighbor, not of judging them.He was concerned with people's souls not their sex lives. Maybe you should try to learn from his example.

"The People's Republic of Maryland is now officially a God-forsaken state. "

What makes you say that? Are you upset that we won't pick and choose from the Book of God's Love, 8 obscure passages that ratify your human hatred?? I think the God-forsaken are those who forge God's Signature to bigotry.

I don't hate anyone. That's your stock answer to anyone who disagrees with you. I didn't quote anything from the Bible which apparently condemns homosexuality rather harshly. I simply view it as a disorder which needs to be treated not treated as normal. You don't give a driver's license to a blind person nor a marriage license to two people who cannot constitute a marriage.

I really don't understand why you post these comments. I'm a heterosexual who happens to be a gay rights activist. There are many of us out there. We are fighting to help our fellow human beings. This comment of yours is no better than the awful comments made by Annie. It's hateful and rude.
01:53 PM on 02/27/2012
No it isn't!

The point that I was trying to get a cross is why defend marriage so much if most end up in divorce?

Even if it becomes in the US legal for gays to get married they will also be getting divorce as well. Because we're all human and not everyone is made for everyone.

What gets to me is that my partner & l being together 25 YEARS and we can't get married.

But Kim Kardashian can marry for 72 Days & Britney Spears for 24 Hours.

In my 25 YEAR relationship my brother & cousin have marry 3 times too.

What's wrong with the picture?

Is called frustration.

My message is NOT to bash Heterosexual marriage but to let them know that we're equal, that some gay couples can last as much as straight couples and that others and most of them these days end up in divorce, to the point that they made it into a TV Show.

Thanks for your support and I didn't mean to offend anyone. I wish this stupid battle would just end for good. We already have millions of problems to keep adding up.

GOD BLESS YOU!

How does this issue affect your life? Your personal distaste is not a reason to deny rights to a portion of law-abiding, tax-paying citizens.

Change 2010 likes to reference "historical facts" by David Barton. This christian revisionist "historian" is disingenuous as they come. For example, in his DVD "American Heritage", he likes to rile up the evangelicals who apparently have not enough knowledge to catch him telling only half the truth. He complains that in this day and age, the 3% overrule the 97% and this is indicative of something tragic and something to be alarmed about. Now if he was a honest historian he would be well aware of at least 2 specific comments by Jefferson and Madison relating how a majority could in a democracy use our form of government as a tool to implement tyranny. But the framers using the constitutional republic form of government placed the Judicial powers separate from the Legislative powers with the Judicial branch being the "check" against discriminatory laws. This fact alone would explain to David Barton why the 3% can overrule the 97%. Now if he knows this, why is he leaving out half the facts? He is being disingenuous when he tries to make something that was engineered by the framers to be something good, into something that looks bad. So, evangelicals bone up on your American Government classes so you don't get fished in.

Fundamentalist lack of education and hatred for anyone that isn't like them. A group like that is tailor made for a "historian" like David Barton. If you really want to see revisionism, you should check out sites like Vision to America. As revisionist as they come.

I believe in a god (and goddess) just not your god. So your bible verses do not apply to me nor do I pay them any mind. When are you going to realise that there are other religions in the country (or even no belief at all) and that their rights are equal to yours?

As long as you are fine with yourself. My God gave us a free will to do what we want. It is up to the person to decide if he or she wants to follow His word. You yourself might not believe in this God,but he is real. One day there will be a day of judgement and it will be up to Him to decide if He believes you. Your right,we all have rights under the constitution, but gay marriage is not in there. I guess it can be amended to your liking, but it will never be accepted by most of the American people or me.

Maryland Catholic Conference spokeswoman Kathy Dempsey speaking on political matters is in violation of the separation of church and state and the Catholic Church in Maryland should be stripped of its tax exempt status at once for the violation along with any other church that takes a stand against this political item. You want the state to keep its nose out or your right to deny reproductive health care to your employees then you keep yours out of who has the right to get married in our state.

Yes, one can speak out.

But there is no reason why any religion should be able to do so tax free.

Time to tax them -- and assess the taxes retroactively, too.

Marriage is a civil contract - that's why you have to get a license from the state. If anyone wants to add religious dimensions and get into the realm of "sacredness", anyone is free to do so. Many people are married without any reference to religion and those marriages are as legally valid as any other. End of story.
