Texas Loses Entire Women's Health Program Over Planned Parenthood Law

Rick Perry Womens Health

The Department of Health and Human Services announced on Thursday that it will cut off all Medicaid funding for family planning to the state of Texas, following Gov. Rick Perry's (R) decision to implement a new law that excludes Planned Parenthood from the state's Medicaid Women's Health Program.

Cindy Mann, director of the Center for Medicaid and State Operations (CMSO), wrote Texas health officials a letter on Thursday explaining that the state broke federal Medicaid rules by discriminating against qualified family planning providers and thus would be losing the entire program, which provides cancer screenings, contraceptives and basic health care to 130,000 low-income women each year.

"We very much regret the state's decision to implement this rule, which will prevent women enrolled in the program from receiving services from the trusted health care providers they have chosen and relied upon for their care," she wrote. "In light of Texas' actions, CMS is not in a position to extend or renew the current [Medicaid contract]."

The federal government pays for nearly 90 percent of Texas' $40 million Women's Health Program, and nearly half of the program's providers in Texas are Planned Parenthood clinics. But the new law that went into effect earlier this month disqualified Planned Parenthood from participating in the program because some of its clinics provide abortions, even though no state or federal money can be used to pay for those abortions.

According to Medicaid law, Mann said, a state cannot restrict women's ability to choose a provider simply because that provider offers separate services -- in this case, abortion -- that aren’t even paid for by the Medicaid program.

Perry wrote a letter to President Obama earlier this month accusing his administration of "mandating which health providers the state of Texas must use" in order to "continue to support abortion providers like Planned Parenthood." He vowed to continue the Women's Health Program in Texas without Planned Parenthood and without federal money, although he has yet to outline how his state will come up with money.

But an HHS spokesperson told reporters on Thursday that this was not Obama's decision and that the administration's hands are tied on the issue. “Medicaid law is very clear; a state may not restrict patients’ choice of providers of services like mammograms and other cancer screenings, if those providers are qualified to deliver care covered by Medicaid. Patients, not state government officials, should be able to choose the doctors and other health care providers that are best for them and their families. In 2005, Texas requested this same authority to restrict patients’ choices, and the Bush Administration did not grant it to them either.”

CORRECTION: An earlier version of this article said that Texas' Women's Health Program costs $40 billion. The correct number is $40 million. We regret the error.

I was going to say, why is he grumbling about Obama and blaming it on his policy when they weren't able to do it under Bush, either?

This is very sad for the people of Texas. Because Perry is a big government tyrant that wants to control healthcare, all of the people of that state lose.

I cannot wait for the day when it will be possible for men to incubate and bear children. Then they can put their money where their mouth is, so to speak, and really rescue children instead of simply attempting to oppress women.

Love to see Mr. Perry preggers with his 12th or 13th.

To Texas Republicans:
You are not going to put Women back into your Box!! You might try to go back to keeping women under your thumb, pregnant and barefoot, but you lost that battle a long time ago. You despise women so much that you are fine with women not receiving medical care.
I should not be so surprised because you tore down medicaid for children, admitted privatization did not work in 2007, and then never put the system back together again.

Thanks again Texas for even more women voting the Democratic ticket!!!
And this will be the last time you discriminate against Hispanics as well - the soon to be new American majority.

The irony here was that Rick robbed the education budget to make the required medicaid payments and then bragged how he balanced the budget.

Don't be concerned - - it's just women and children. Texas doesn't care about them.

this is truly abominable. i live in texas, and let me tell you, there might not be a state who needs planned parenthood and the women's health program *more*. we have one of the highest teen pregnancy rates in the nation, an epidemic of babies born with Fetal Alcohol Syndrome due to cultural beliefs about abortion and lack of information on how to have healthy pregnancies, and the least educated kids on sex that you could imagine.

this is going to cook up a whole new crock-pot of trouble for us in texas. :(

With his defunding of so many of the educational programs you have in Texas, the kids there won't only be the least educated on sex, they'll be the least educated on everything. I have a lot of extended family living in Texas, and even though most of them are conservatives, they agree that Perry is a mess and they didn't vote for him. Who are these yahoos that do? (. . .and no, I can't convince them that being a conservative is part of the problem.. . Would if I could.)

The abuse of women has been going on for so long, that many women believe abortion is a good thing. That is sad.

Nobody ANYWHERE has ever thought abortion was a "good" thing. It is a difficult choice in any circumstance but it's still a choice that is guaranteed by law.

Who have you heard state that abortion is a "good thing." I would wager you no one. What you will hear, if you decide to actually listen, is that family planning, which could include contraception, and freedom of choice, which could include abortion, and women's health care decisions decided by each woman involved is a good thing. Old white men, not capable of knowing what women experience, trying to tell women what to do about their reproductive health care, is NOT a good thing. Government inserting itself into women's private lives is not a good thing. (Government good ol' boy spying on you is a bad thing. Making religious dogma the law of the land is a bad thing.)

He is so fond of the death penalty. Now he's signing death warrants on thousands of women. The Republicans are winning the war and the death toll is mounting!

Republicans are also losing women's votes, including votes of former supporters. There will be enough healthy women and men to take up the cause.

Republican lawmakers are really lawbreakers who are costing taxpayers' time, money, standards of living and quality of life, while denying the vast majority fundamental rights. The people GET IT! There will be a tremendous backlash against the GOP.

I hope the women in Texas are paying attention. This is just one example of the widespread misogyny displayed by many of the elected officials in our state. Texas women and those who respect women should carefully research and get to know the people who are asking for our votes this November. (This includes federal, state, and local candidates.)

The Texas Republican Party Platform adopted this year includes this:
"Knowledge-Based Education – We oppose the teaching of Higher Order Thinking Skills (HOTS) (values clarification), critical thinking skills and similar programs..."

We certainly wouldn't want our Texas children to be able to think for themselves. They might grow up and realize that the state's political "leaders" are just leading them right off a cliff.
