Zimmerman Makes Court Appearance In Trayvon Martin Shooting

SANFORD, Fla. — After weeks in hiding, George Zimmerman made his first courtroom appearance Thursday in the shooting of 17-year-old Trayvon Martin, and prosecutors outlined their murder case in court papers, saying the neighborhood watch volunteer followed and confronted the black teenager after a police dispatcher told him not to.

The brief outline, contained in an affidavit filed in support of the second-degree murder charges, appeared to contradict Zimmerman's claim that Martin attacked him after he had turned away and was returning to his vehicle.

In the affidavit, prosecutors also said that Martin's mother identified cries for help heard in the background of a 911 call as her son's. There had been some question as to whether Martin or Zimmerman was the one crying out.

The account of the shooting was released as Zimmerman, 28, appeared at a four-minute hearing in a jailhouse courtroom, setting in motion what could be a long, drawn-out process, or an abrupt and disappointingly short one for the Martin family because of the strong legal protections contained in Florida's "stand your ground" law on self-defense.

During the hearing, Zimmerman stood up straight, held his head high and wore a gray jail jumpsuit. He spoke only to answer "Yes, sir" twice after he was asked basic questions from the judge, who was not in the courtroom but on closed-circuit TV. The defendant's hair was shaved down to stubble and he had a thin goatee. His hands were shackled in front of him.

He did not enter a plea; that will happen at his arraignment, which was set for May 29. Zimmerman's attorney, Mark O'Mara, has said his client will plead not guilty. A bail hearing for Zimmerman probably will be held April 20, O'Mara said late Thursday.

To prove second-degree murder, prosecutors must show that Zimmerman committed an "imminently dangerous" act that showed a "depraved" lack of regard for human life. The charge carries a mandatory sentence of 25 years in prison and a maximum of life.

The special prosecutor in the case, Angela Corey, has refused to explain exactly how she arrived at the charge. But in the affidavit, prosecutors said Zimmerman spotted Martin while patrolling his gated community, got out of his vehicle and followed the young man.

Prosecutors said in the affidavit that Zimmerman "profiled" Martin, who was unarmed and wasn't committing a crime.

"Zimmerman ... observed Martin and assumed Martin was a criminal," the affidavit said. "Zimmerman felt Martin did not belong in the gated community and called the police."

Prosecutors interviewed a friend of Martin's who was talking to him over the phone moments before the shooting. His parents' lawyer has said that Martin was talking to his girlfriend back in Miami.

"During this time, Martin was on the phone with a friend and described to her what was happening," the affidavit said. "The witness advised that Martin was scared because he was being followed through the complex by an unknown male and didn't know why."

During a recorded call to a police dispatcher, Zimmerman "made reference to people he felt had committed and gotten away with break-ins in his neighborhood. Later while talking about Martin, Zimmerman stated `these a------s, they always get away' and also said `these f-----g punks,' said the affidavit, available at . http://apne.ws/Itn7Nu

It continued: "When the police dispatcher realized Zimmerman was pursuing Martin, he instructed Zimmerman not to do that and that the responding officer would meet him. Zimmerman disregarded the police dispatcher and continued to follow Martin who was trying to return to his home."

"Zimmerman confronted Martin and a struggle ensued," prosecutors said in their account.

The account provided no details on the struggle other than to say that witnesses heard numerous calls for help and that Martin's mother reviewed the 911 recordings and recognized her son's cry.

Zimmerman told authorities that Martin attacked him as he going back to his vehicle, punched him in the face, knocked him down and began slamming head against the sidewalk.

At Thursday's hearing, the case was assigned to Circuit Judge Jessica Recksiedler, a 39-year-old former assistant state attorney from Sanford who was elected to the bench in 2010. Zimmerman is being held without bail at the county jail.

For all the relief among civil rights activists over the arrest, legal experts warned there is a real chance the case could get thrown out before it ever goes to trial because of Florida's "stand your ground" law, which gives people a broad right to use deadly force without having to retreat from a fight.

At a pretrial hearing, Zimmerman's lawyers would only have to prove by a preponderance of evidence – a relatively low legal standard – that he acted in self-defense in order to get a judge to toss out the second-murder charges. And if that fails and the case does go to trial, the defense can raise the argument all over again.

There's a "high likelihood it could be dismissed by the judge even before the jury gets to hear the case," Florida defense attorney Richard Hornsby said. Karin Moore, an assistant professor of law at Florida A&M University, said the law "puts a tremendous burden on the state to prove that it wasn't self-defense."

At some point soon, Zimmerman's lawyer is expected to ask the judge for a hearing on "stand your ground."

"It is going to be a facet of this defense, I'm sure," O'Mara said in an interview. "That statute has some troublesome portions to it, and we're now going to have some conversations and discussions about it as a state. But right now it is the law of Florida and it is the law that is going to have an impact on this case."

Martin family and their lawyer acknowledged the arrest is just a first step.

"I think that it will start the process that we are pushing for," said Martin's father, Tracy Martin, "but we can't just stop because we have an arrest. We got to keep pushing to get a conviction, and after a conviction we have to certainly continue to push to get a stiff sentence."

Martin family attorney Ben Crump said he wants to make the repeal or the amending of "stand your ground" laws in Florida and other states to be a big part of Trayvon Martin's legacy. "We're not the wild, wild west," Crump said.

As for Zimmerman, O'Mara said after the court appearance: "He is tired. He has gone through some tribulations. He is facing second-degree murder charges now. He is frightened. That would frighten any of us."

"He has a lot of hatred focused on him right now," the defense attorney said. "I'm hoping that the hatred settles down now that we're moving forward."

Well Zimmerman got a low bond. The prosecutor says he wants to try this case in the courtroom. But it has been tried by the talking heads in the media already. They have twisted this case in every way possible. But the media has filed suit to get all the evidence or the lack of any evidence from the state. Many defence lawyer's are openly stateing. That this case is weak. Is this why they wont it kept secret? Well it wont be long and we will have all the witness list's and the police report's. Some people already have the paper work from the Seminole County D.A.. Well they filed report's before "SOMEONE" decided they need another prosicutor on this case. To get the result's they wanted. I want to see these paper's explained away. 2 diffrent D.A office's come up with 2 diffrent finding of fact's. This should be funny. D.A against D.A.... Jax. D.A Vs. This case has given us al on opportunity to reflect on many facets. The most being media manipulation. We accept the medias view with out question as we close our minds to any more reasonable options. Some will fight to preserve the medias version with silly child like tactics. They will flag certain comments and in their mind justify that they found them offensive on a precieved infraction of some loosely written rule. I question ones dignity when games as such are played and leave it at that. It is not worth a verbal argument.

I was always told as a child "Don't start none, won't be none"....you only get back whatever you put out....you type respectful things you get respect back... you type bad things and put people down....you get comments flagged....it's just like being a guest in someone's home...you start calling someone's kid bad names instead of trying to be respectful or disobey any of the rules of that person's house then OUT YOU GO.....same principle applies here....

You feel it is disrespectful to have another opinion? I just believe we should be looking at why this happened. So one factor would of course be what was the Juvenile suspect doing when he was spotted by the community activist .ow we look at his past . he had an involvement in drugs, Graffiti and carried burglary tools. Then as I read I find out there was no investigation into what he was doing. The only investigation was into the shooting. In my area when some one is called in as a suspect . it is investigated . Sure his untmley death rules out a proper interrogation.However shouldn't bushes and garbage cans of been checked for stashed contraband ? For all we know he told the girl on the phone where he stashed any thing hr may of had and the father or brother retrieved it.. the area was not locked down. allowing for the rumor that it was a racially motivated suspectaion or the young man

I just don't understand Matt's point of view at all.

Does he not know/understand that George Zimmerman has domestic violence activity in his past? Does he know that George Zimmerman is currently accused of a violent crime as we speak?

All were found quilty, and have been sentenced. The Christian and Newson families get to sit through another trial because the Judge on the case has been removed from bench because of misconduct and using drugs. Because of his misconduct all convicted felons are seeking a new trial, at a big cost to TN. Hope this answers your question about white victims.

I wonder what Yrayvon Martin was up to when he caught the eye of a community activist.. in the past T has been involved with weed, graffiti and had burglary tools. I know- I know ...he had skittles..does any one know if the police checked bushes and garbage cans for any burglary tools or drugs he could of stashed before he went back to alledgitly attack The watch man. or did the police fail to investigate? Did they violate the community watch mans rights? Is a suspected crime not investigated? Does any one know ?

keep in mind, if you are "defending yourself" the law only allows for you to stop or kill the attacker the first time around, meaning..... if you shoot the attacker because you are defending yourself and he/she goes down thats it. once the subject is down you are no longer protected under the self defense law, anything you do after the first time is considered a criminal act. when you take down a person who is trying to harm you and they are down you cant go ahead and jump on them and start beating the crap out of them

The Zimmerman family is going through a lot of Heart ache. They have some being charged with Murder and they have to be worried about George. There are those that will say that he should not have anyone worring about him. But that is what a family does when they have a family member in Jail accused of such a crime.

I agree the family is hurting, but at least they can still talk to him...Trayvon's family does not have that luxury.....I hope this is all settled honestly and fairly...though I don't know how since the media released information that should have been confidential until everything was investigated and it doesn't sound like the police department didn't handle this well either...such a sad case.....

They may also have some pride think about it. G.Z. put his own life in danger in pursuit of who he believed to be the Burglar who was preying on the neighbor hood. .The fact that G.Z not being a very big young man , did not stop him as T.M had a good 3 inches on him. There is nothing to be embarrassed about. As much as I dislike Zim based on my own reasons .. for one , If I was stealing some thing .. I always hated the community do-gooders ever since one caught me breaking into a school in my youth. I felt anger for him . yes I could of done a Trayvon styled attack .but I was scared.. .

If he didn't want to be a cop why would he ask his old neighbor in Virginia to write a letter of recommendation for him after he graduated HS and moved to florida?

His college courses were for entering law enforcement.

He applied to, was accepted and attended the citizens’ police academy in Sanford back in 08. His application can be found online where he talks up his familiarity with the law...you know his PARENTS.

Georgie has been bucking to be a cop for awhile. Just never got there. Wonder why. He gets the letter of recommendation, but doesn't apply.

private time, rain or shine, people, not just teens, will walk in snow, rain.. just to amble on, talking on phone, get out. teens have alot of inner energy, hormonal flux.. They tell men with bad tempers to take a walk, in marriages, partnerships.. the thing is, suspect or not let the police do their job, if they are late, they will return another time, & watch.:)

You are absolutely correct. The crime appears to have been racially motivated. Anyone defending what George Zimmerman did is thinking rationally.

It is still early. The Prosecution will have to prove their case. What most people here that are defending George Zimmerman seem to really want George Zimmerman to be set free without a trial.

Everyone...stop bickering like little schoolgirls....the trial is coming up whatever evidence that has been gathered will be presented...unfortunately the media got some of it mixed up and people have turned into total airheads over this.....The question I hope is asked is why did the watchman leave his vehicle to follow Trayvon and how did he get himself in a position to be that close to the young man if he was that suspicious????? I think that will put a heavy burden on how to decide whether he made the right decisions or not....and if he is found not guilty he still has to live with what happened and no one else...and then no one's opinion will matter because none of what we say will change what happened that night....

I would think he felt Trayvon warranted following. It is obvious that Trayvon felt G.Z. warranted being jumped. We may never know what Trayvon was trying to hide that night due to a botched up police investigation. If Trayvon had any tools on him, that would of been leaked too. that's why they knew he went to get treats, talk on phone, heading home. they held on to his phone way long after parents couldn't find son." So, he was not doing anything bad, just ambling , talking, & heading home. Many walk in snow, rain, to get out, some enjoy it > adults."

There is a such thing as a trial and court of law....any additional evidence that has surfaced (and not made public at this time) will be introduced to the case and all of this guessing, thinking, wondering and fantasizing about what you think Trayvon was or was not doing according to the gospel of rugar is not showing objectivity but a one man witch hunt with nothing but speculation, heresay and an automatic judgement that is being handed down by someone who has NO AUTHORITY WHATSOEVER in this case...the boy was already judged, convicted and executed without a trial, a judge or jury....I think Trayvon deserves at least the dignity of letting his side be told in court before further judgement is tossed out on him....I still feel the watchman handled this irresponsibly but the FULL SPECTRUM OF THE EVIDENCE has yet to be released.....stop being so judgemental and let the rest of the facts speak for themselves...

Hi, I have been off this thread a few days, kenny, I think he will not go to Trial, as the evidence is more serious than what we know. Witness Statements, Officers, Autopsy, Ballistics, Trajectory.. he will skip trial at last moment, take his 15, to 20. hopefully no bond either. if he is so scared, the safest would be to remain in custody? f&f.

Not true, Trayvon was called names, & his character, he just turned 17. Who knows where he was at, in his life, he was a normal teen, who was going to grow, evolve.. like most of us. G.Z. 28, was no teen. had a Violent record, which I notice you never address.
