Jeffrey Neely, GSA Official, To Remain Silent At Congressional Hearing

WASHINGTON -- A General Services Administration executive will assert his right to remain silent at a congressional hearing next week into the agency's spending practices, the official's lawyer said Friday.

It was learned that the official, Jeffrey Neely, also could face a possible criminal investigation.

Neely was placed on leave by the GSA's new leadership. He was commissioner for the Public Buildings Service in the Pacific Rim region, covering Arizona, California, Hawaii, Nevada and several other countries and territories.

As the executive largely responsible for an October, 2010 conference at a Las Vegas resort, Neely was subpoenaed to testify Monday before the House Oversight and Government Reform Committee.

The panel is one of four congressional committees investigating GSA spending – inquiries that began earlier this month when the agency's inspector general reported an $823,000 spending spree at the Las Vegas event.

A congressional committee official, who was not authorized to be quoted by name on the subject, confirmed Friday that the inspector general referred Neely to the Justice Department.

Whether the referral was directly connected to the conference is uncertain.

Neely's attorney for employment matters,, Robert DePriest, did not immediately comment.

His lawyer for the committee proceedings, Preston Burton, said Friday night that Neely will comply with the subpoena and appear Monday. Burton said he doesn't know whether a referral has been made.

Oversight committee chairman Darrell Issa, R-Calif., wrote Burton on Friday that the subpoena was issued after "you advised my staff that Mr. Neely would not appear voluntarily."

Issa said in the letter that Burton advised the committee "that if Mr. Neely is compelled to appear at the hearing, he will `assert his constitutional privilege to remain silent.'"

GSA Inspector General Brian Miller has told several congressional committees investigating the agency that there have been criminal referrals.

An internal government memo released Friday shows officials of the GSA were aware of a spending problem months before the scandal burst into public view this month.

The GSA's deputy administrator, Susan Brita, emailed agency officials last July that the inspector general found no substantive agenda for the conference. She said that expenses for a clown suit, bicycles used for a team-building exercise, tuxedos and a mind-reader didn't lend themselves to the claim of a substantive conference.

Brita also questioned why a regional administrator in charge of the conference received only a disciplinary letter that "is not even a slap on the wrist."

A major concern in the memo was how The Washington Post, with thousands of readers who are federal employees, would report the story.

A GSA spokesman declined to comment, saying the agency preferred to let the email speak for itself.

The email was sent to Robert Peck, then the head of the GSA's Public Building Service, with copies to his deputy, David Foley, and another top agency official, Stephen Leeds.

Peck and Leeds were fired after the inspector general issued a stinging report this month on the cost of the conference to taxpayers.

GSA administrator Martha Johnson resigned in the wake of the report. Eight GSA employees have been placed on administrative leave, including Foley. He is seen in a conference video giving an award to an employee who produced a rap video bragging about the conference spending.

The email by Brita, who remains at GSA, was made public by the House Oversight and Government Reform Committee, which will conduct the first of four hearings on GSA's spending practices next week. The agency is in charge of federal buildings and supplies and part of its mission is to save taxpayers money.

"The Obama administration has not been upfront with the American people about how long they've known about lavish spending abuses at GSA," said Issa, the committee chairman.

"It's clear that they were fretting about the political consequences and preparing for media scrutiny on abuses many months ago but didn't seem to take real actions until the release of the inspector general's report couldn't be delayed any longer," Issa said.

Brita wrote that a letter to Neely "should be crafted with a WAPO (Washington Post) mind frame." She said she had no doubt the Post would connect the lavish conference spending to a period of high unemployment and a down economy. She wondered what the reaction to the story would be from the public and Congress and questioned how GSA's political leadership would respond.

"Jeff is a seasoned SES (senior executive service employee) who is expected to display the highest standards of common sense, and prudent financial management," she wrote Peck.

"He did neither. Sorry, but your letter is not even a slap on the wrist," she wrote.

Here are a few key points/chronology about this GSA conference/scouting trip boondogle

#1 Somebody had to rat them out or the GSA IG would never had investigated this
#2 After the IG report came out, detailing the excessive spending for a conference that was found to have "NO substantive agenda" to include what looked to be procurement officials taking " bribes, kickbacks and other improprieties" absoutely nothing was done to the perps even though it is documented that the report and findings were sent to high level GSA officials AND the White House
#3 The perps were subsequently awarded bonuses
#4 The media did not expose this until after a Congressman's office brought it to their attention
#5 The Inspector General who uncovered the Las Vegas spending spree testified he's handed the case to the Justice Department. "We've recommended criminal charges," said Inspector General Brian Miller. "Bribes, all sorts of improprieties, possibly kickbacks," are currently under investigation, he said.
#6 Now lets see what Holder's Justice Department does. Probably nothing.

The GSA inspector general noted that during scouting trips, GSA “VIPs” “were shown upgraded suites that they received as a perk for GSA contracting with the M Resort” for the conference, and that the value of the discount that the M Resort offered GSA for the 40 nights was $21,540.

$21,540! Gee that's quite a nice perk/gift/gratuity that Neely and the rest of his GSA gang accepted in the form of these palatial expensive rooms that were ridiculously discounted to the "government rate". Taking gratuities and/or accepting expensive favors from a company by a person in a position of authority while in the procurement process - evaluating hotels, conference faciliteis and amenities in this case, is against the law.

I think it's nice to know that NEELY can steal our money, refuse to answer any questions about it, and get a paid leave of abcence durring the investigation. If they claim that they can't fire him emediately because of procedure, shouldn't Neely have at least been sent home without pay?

Don't get me started on congressional excess. Every congressman used to get a bucket of ice left at their door every morning even though in the 21st century and the miracle of mini-fridges it wasn't necessary. It was just one of those things that was started in the 1930's and nobody ever considered ending the practice.

Soooo, government employees busted and called to task for lavish spending, gross misuse of taxpayer funds, and going against the President's vow of eliminating government waste, fraud, and abuse is political theater??

The hearings will shine a light on the culture of entitlement and largess of government employees. Criminal charges may very well be issued. Heads will roll. The President will be embarassed, and rightly so.

I'm wondering why they're even having the hearings. If Issa is so against wasting money he should be the first one to stop the hearings. Let's face it, the cost should be taken taken care of by the Republican National Com. After all, with Issa running it, it will be a Republican campaign event.

When will Issa answer for his alleged ethics and other violations?

Here’s what he has, allegedly, done while investigating others:
- At the same time he railed against the Obama Administration’s green energy initiatives, he sought a Department of Energy loan for a major GOP campaign contributor.
- He’s continuing to protect his friend Rupert Murdoch by refusing to investigate the News Corp scandal, despite calls from his colleagues to do so.
- His office violated a federal judge’s order by releasing sealed information to the press about an ongoing investigation.
- Was it appropriate, for Rep. Issa to put pressure on the SEC to back off investigating Goldman Sachs amid allegations that it defrauded investors in the run-up to the financial crisis, while at the same time he personally held millions of dollars in Goldman Sachs assets?
- A Goldman Sachs vice president changed his name, and then later went to work for Issa to coordinate his effort to thwart regulations that affect Goldman Sachs’ bottom line.
- Was it appropriate for the Congressman to secure millions of dollars in congressional earmarks for roadwork that promised to improve traffic to the numerous commercial properties he owns north of San Diego?
- This speaks for itself.
