Ted Nugent Guilty Plea Expected For Killing Too Many Bears

ANCHORAGE, Alaska — Rocker Ted Nugent is scheduled for a court hearing in Alaska on Tuesday, when he is expected to plead guilty to transporting a black bear he illegally killed.

The conservative activist and gun rights advocate signed a plea agreement with federal prosecutors that was filed Friday in U.S. District Court. Nugent was set to participate by telephone in Tuesday's U.S. District Court proceeding in the southeast Alaska town of Ketchikan, his attorney said.

The plea agreement says Nugent illegally shot and killed the bear in May 2009 on Sukkwan Island in southeast Alaska days after he wounded a bear in a bow hunt, which counted toward a state seasonal limit of one bear for that location. The agreement says Nugent knowingly possessed and transported the bear in misdemeanor violation of the Lacey Act.

According to the agreement, the six-day hunt was filmed for Nugent's Outdoor Channel television show "Spirit of the Wild."

Nugent's Anchorage attorney, Wayne Anthony Ross, said Monday that his client didn't know he was breaking the law, which went into effect four or five years ago. Ross, an assistant hunting guide in Alaska, said he didn't know about the rule either.

Besides, the first bear left only traces of blood, as if it had just been scraped by the projectile, according to Ross.

Nugent is going with a guilty plea, however, because "the law is the law," Ross said.

"What are you going to do about it – a magician act?" he said. "The fact that we didn't know about it doesn't change it."

Broadcasting footage of the hunt on his TV show also shows Nugent didn't know he was in the wrong, said Ross, who sits with Nugent on the National Rifle Association's board of directors.

"It's kind of embarrassing for him because he practices ethical hunting and advocated ethical hunting and gets caught up in a crazy law that none of us have heard about," Ross said.

A call seeking comment from assistant U.S. Attorney Jack Schmidt was not immediately returned Monday.

Nugent, who signed the document April 14, agreed to pay a $10,000 fine, according to the document, which says he also agreed to a two-year probation, including a special condition that he not hunt or fish in Alaska or Forest Service properties for one year. He also agreed to create a public service announcement that would be broadcast on his show every second week for one year, the document states.

Nugent also agreed to pay the state $600 for the bear that was taken illegally, according to the document.

A plea agreement would have to be approved by a judge.

Nugent, famed for his 1977 hit "Cat Scratch Fever," drew the attention of the Secret Service last week after he rallied support for Republican presidential candidate Mitt Romney and said of the Obama administration: "We need to ride into that battlefield and chop their heads off in November." His comments were made during a National Rifle Association meeting in St. Louis.

Nugent discussed the matter with two agents on Thursday while in Oklahoma, the singer said on his website. Nugent said he was just speaking figuratively and that he didn't threaten anyone's life or advocate violence.

A Secret Service spokesman has said the issue has been resolved.

With hunting, Nugent has run afoul of the law before.

In August 2010, California revoked Nugent's deer hunting license after he pleaded no contest to misdemeanor charges of deer-baiting and not having a properly signed tag.

Nugent's loss of that deer hunting license through June 2012 allows 34 other states to revoke the same privilege under the Interstate Wildlife Violator Compact. Each state, however, can interpret and enforce the agreement differently.

I saw T.N. on a hunting show last week. a rerun. he was hunting with another tv hunter that hunts exotic wildlife that is transported to fenced in acreage. I already had discuss for this dude for unfair and ethical sportsmanship. like shooting fish in a barrel. Baiting to kill is not ethical. I'm glad NUGENT got caught in his cheating. I agree with Alaska's law so goofs out there aren't making wildlife suffer from wild shots. I am not in favor of bow hunting either. I'm sure many an animal has suffered unto death from infection and inflamed areas of their bodies. It seems cruel to hunt this way. and nugent not looking after his first shot attempt makes him unethical and a responsible hunter. WHITE MAN SPEAKS WITH FORKED TONGUE WHEN HE PORTRAYS HIMSELF A GREAT HUNTER AND DISREGUARDS THE LAWS OF THE LAND HE HUNTS ON.

The NRA's spokesman is a game violator. Not the kind of hunting family I grew up in. Poaching is not cool. He knew when he took that second shot he was wrong.

As a hunter I can understand how easy it is to make a mistake regarding the local game laws in WNC I can bait on private land but not on public or fed land. Something as simple as not knowing exactly where the line is on property you are hunting and you could be unintentionally committing a federal offense. The laws are strict and sometimes so anal retentive you need an attorney to decipher exactly what the hell they are trying to convey. My point is its very easy to make a mistake as a hunter, he is doing what he needs to to make it right and that is all anyone could ask. Sometimes these things get blown out of proportion by animal rights people and the like. Hunters like myself are ethical follow all the rules and guidelines wait for a quick clean kill so the animal does not suffer, and waste little or none of the animal. For that you should respect those of us who are ethical just like we respect that some people don't think hunting is right.

Go read up on Michigan's "Invasive Species Order". Some of these laws are leading to the slaughter of animals by the feds. Also, you do realize that the feds are kicking in doors, pre-dawn, weapons drawn over technicalities and benign incidents like moving an animal from federal land across to state owned land.

There's alot more to this story than being told. Charges are coming from the Feds in retaliation for Ted's recent comments. Also overreaching regulations allow gov agencies to kill a farmers pigs while others make it a felony if you "put down" calves that were born deformed or are in serious pain. Back to the story, funny to read some of the comments here even given the fact that Ted is more than happy to comply with the laws once it was brought to his attention. Some of these laws even his own lawyer from Alaska have not heard of.

So good of you to highlight the inadequacy of Ted and his hired help, in knowing the regulations where they decide to hunt, amongst other things. These men sit on the board of the NRA...tells us a lot. Why the side attack on Govt Agencies, which has nothing at all to do with this topic. The charges are in retaliation....really? Grow up, this isn't the playground. If the charges weren't for actually breaking the law then he wouldn't be pleading guilty. Although even then they had to bargain over whether he attended court...what was the impediment, too busy writing his next whacko speech against the President?

Even the local judge in this case never heard of this law. The Feds brought these charges not the state. An agent even stated they were out to get Nugent. Pre-dawn, guns drawn, door wrecking entries for Teds friends just to try and dig up dirt? Insane.

I don't think much of the guide, if he doesn't know the appropriate hunting laws. Also, ignorance is no excuse for this. If you hunt (or whatever), you are responsible for knowing what you can and can't do.

And without the laws, you wouldn't have any bears to hunt. Bear-hunting is very popular in AK, especially with Asians coming over for them, as they think bear gall bladders are the best thing since Viagra. You'd have people potting at cubs, young bears, pregnant sows, etc. Libertarianism may sound like a good thing, but the consequences can be horrific for everybody else concerned.
