Dharun Ravi, Rutgers Webcam Defendant, Wants Hate Crime Convictions Dismissed

A former Rutgers University student who was found guilty of hate crimes for using a webcam to view his roommate kissing another man has asked a judge to overturn the jury's conviction.

In a legal filing Tuesday, Dharun Ravi's lawyers said the jury convicted him in March despite evidence that he was not guilty of invading the privacy or intimidating roommate Tyler Clementi, who killed himself days after the webcam was used.

And on the most disputed and serious charges – bias intimidation – the lawyers say the law was misused. On some of those counts, the jury found that Ravi did not mean to intimidate Clementi or the other man, but that Clementi reasonably believed he did. Jurors said as much both in their findings in court and in comments afterward to journalists. Copies of some news articles were included with the brief to support Ravi's lawyers' position.

"To criminalize a defendant for a victim's mistaken belief about the defendant's motive would turn the bias intimidation statute into a mockery of itself," wrote the lawyers, Steven Altman and Philip Nettl. It is standard practice for lawyers to ask for a judge to overturn a conviction after a jury delivers it. In Ravi's case, the request is for the judge to acquit Ravi entirely – or at least grant him a new trial.

The lawyers said that the jury was wrong on invasion of privacy charges because the snippets video that Ravi and others saw did not show sexual acts or nudity.

Prosecutors had no immediate comment on the court filing. But they're sure to have more to say in coming weeks as they file papers to recommend a sentence for Ravi.

He could face 10 years in prison when he's sentenced on May 21. And because he's a citizen of India, where he was born, Ravi could also be deported eventually because of the conviction.

The case has enflamed passions.

Almost immediately after his suicide in September 2010, Clementi came to be seen as a symbol of the bullying young gays can face. President Barack Obama spoke out about the case and talk-show host Ellen DeGeneres made it a key cause of hers.

Some have come to see Ravi as a victim of an overzealous legal system, a man convicted not so much for what he did but what happened afterward. Last month, former Gov. Jim McGreevey, who left office in 2004 after announcing he was gay, wrote an opinion piece in The Star-Ledger newspaper arguing against a prison sentence for him.

While there is much dispute in court and elsewhere about how the law should be applied in the case, there is little disagreement over the facts.

Jurors heard that Clementi and Ravi, both 18-year-old freshmen from well-off New Jersey suburbs who were assigned at random to be roommates, did not speak much.

A few weeks into the school year, Clementi asked Ravi for the room when he was planning to have over a man he'd met online. Jurors heard that Ravi was nervous about the iPad he'd left in their room and wondered what was going on, so he and a friend turned on his webcam and saw seconds of, as Ravi described in a tweet, his roommate "making out with a dude."

Two nights later, when Clementi asked for privacy again, Ravi obliged. This time, he told friends through text messages, tweets and in-person conversations how they could connect with his webcam to see what happened between Clementi and his guest, who testified at the trial but was only identified by the initials M.B. because he's considered the victim of a sex crime.

But the webcam was off that night.

By the time of that second rendezvous, Clementi had learned that Ravi had watched him and he initiated a request for a room change.

The next night, Clementi, a violinist, made his way to the George Washington Bridge and jumped to his death, leaving behind a final Facebook status: "jumping off the GW bridge, sorry."

Jurors found Ravi guilty of all 15 counts he faced, including bias intimidation, invasion of privacy and tampering with evidence and a witness to try to cover up the other crimes.

I must admit, I'm amazed at the degree to which a convict will misrepresent the truth to get out of justice being served. A young man is dead because of this perverted predator (Dharun Ravi). I sincerely hope the courts laugh him out in handcuffs and force him to serve every nanosecond of his sentence.

Unless ther is some evidence not included here I don't see how the jury convicted this guy. There was no evidence of intent to harm. I don't see how he was responsible for the guy commiting suicide.
He had no way of knowing his roommate was mentally ill.

I hate the charges of hate crimes -- if you shoot someone or kick them in the head and shout every possible curse word at them youre guilty of assault but god forbid if in your rightful rage at a person who sorely needs kicked in the head you shout a racial, nationality, or sex related epithet -- your sentence is doubled or tripled. And if you keep your mouth shut -- you can hate all you want -- the do-gooders are trying to legislate us to love each other -- and Im saying some people just arent lovable and I should be allowed my opinion and rage to hate them -- they are an anathema to my value system

You do have the right to hate them. You don't however have the right to commit a crime against them because you hate them. If you do don't be surprised when the punishment is doubled. Moreover, you would deserve it.

Perhaps the real culprit here is the Dean of Housing at Rutgers University. Throwing complete strangers together in a small room without some sort prescreening is just asking for this sort of trouble. Compounding the incompatibility is the pressure that comes with homework and studying for exams. Rutgers should be well aware of these problems and at least try to head them off before they occur.

I believe they are making him an example for all of the bullying that is going on right now. I do not agree that he was not a "Peeping Tom". Once he saw that he had footage of the act of his roomate, he should have discarded it, and not shown others. We all have done things in our youth that were stupid and we now later in life regret, so I am not quick to judge. He still needs to grow. He needs to be punished yes, but not as harsh as some of the people are stating in these comments. Kind of like Michael Vic, he needs to go now on to high schools and colleges, and tell his story so people can see the effects that bullying does have on not only the victim, but the person doing the bullying. To me, this is how he needs to make ammends.

Has anyone seen the Primetime interview with Ravi? The media fabricated a lot of the details.I dont believe he was a bully or a peeping tom. Maybe just immature. But the Clementi kid obviously had a lot of problems. Your not gonna throw yourself off of a bridge because your roommate saw a brief non sexual encounter with you and another man. He was already out of the closet. Funny how the suicide note wasnt allowed in court. I think Ravi is getting used as the whipping boy for the current bullying problem going on.

He didn't just watch - he told others how to connect to his webcam to watch as well - that was wrong and he should be punished for that. People from his country are killed for being gay - their culture does not accept gays. And it doesn't matter if he was out already - college peers can be unforgiving and cruel.

And his lawyer???? What is wrong with you? Every person no matter who they are, what they did or how we feel about their guilt or innocence is entitled to a rigorous defense. His lawyer is only doing his job, which is an important one. It is the duty of every attorney to pursue every legal avenue available to help their client. I'm sure you would want your lawyer to do the same if you were facing charges or being sued, or suing someone yourself.

A crime is a crime. Charge him as a peeping tom and send him home. What he did was a crime. But it was not a homicide. He did not kill him, beat him or threaten him. I think he would have done the same with a straight couple. If he did and the girl jumped the bridge it would not be called a hate crime.

I have the Japanese Society that has documented this Hate Crime against Japanese-Americans that live in USA. There is no secret they follow me all over the nation and there is no where else that I travelled to besides Mexico where they didn't follow me to and Jamaica. I have these programmers who use people in over 69 USA cities where they institute these programming behavioral modification that are illegal and UnConsitutional and the Wordl UN Tribunal Court case takes place in Amsterdam and my Uncle Tadeshi and cousin Kasihara both kendo masters will be there to witness all who did this to me for over 30 years in a free country who's ecocomy is worse than Zimbabwe now. How did we just let this happen and no one reallycares what we go through anywhere and Wikileaks knows about this programming used illegally wordwide.
