Best Buy Employee Allegedly Outs Straight Customer On Facebook

Leaving a phone unattended among friends can mean opening yourself up to being messed with in the form of ridiculous status updates, tweets or texts. Still, one would think that leaving a phone in the hands of a Best Buy employee would safeguard a person from such pranks, but not so, says Colorado customer Rich Dewberry.

ABC7 News Denver is reporting that Dewberry dropped his phone off at Best Buy for a repair and that, when it couldn't be fixed, he was given a new one. But at some point in the transition from the old phone -- which was logged in to Facebook -- and the new one, a status update had been posted to Dewberry's account that said, "I am gay, Im coming out."

"The phone just started ringing constantly after that, from ex-spouse to friends," Dewberry told the Denver news station, adding that he has subsequently had to tell people he hasn't seen in years that he is not in fact gay.

"I feel I've been humiliated, you know, I mean, my reputation has been tarnished," he said.

Dewberry told ABC7 News that Best Buy assured him that the employee had since been fired, but he's still considering taking legal action against the retailer. Best Buy issued the following statement to ABC7 News in response to the incident:

"Each year, every employee of Best Buy is asked to review and sign our Code of Ethics, which includes details on how they are expected to handle customer information."

The Consumerist had an additional suggestion for the retailer: "Maybe it's time to beef up that section on how not to invade customer privacy and wreak social networking havoc."

Earlier this year, Forbes contributor Larry Downes went so far as to predict that Best Buy would eventually go out of business, mainly as a result of its poor customer service.

"Walk into one of the company’s retail locations or shop online. And try, really try, not to lose your temper," Downes wrote. "Their 'people' are not knowledgeable; they are annoying."

This guy really only embarrassed himself when he went public. for all we know he probly posted it for publicity. best buy costumer service is only bad if you don't go into the store knowing what you will and will not purchase.

Best Buy customer service is really bad..plus Colorado is so unkind to consumers. The guy is probably out to embarrass the company as much as they embarrassed him. Sadly Colorado has really small caps for lawsuits like this. He won't win much in court..but he can damage their reputation. or whats left of it. Personally when it comes to cell phones we have caught them in many blatant lies and totally misinformed. To call the abuse they inflict on customers as service is nuts and an insult to good customer service folks everywhere!

Clearly, this is a disturbing event, having your social networking sites hacked. It created inconvenience for the man.

But the hyperbole of, "My reputation is tarnished" is ridiculous. If he truly feels that being gay would tarnish him in some way, that is sad.

While I personally have had same-sex realtionships and have a deep love for my strictly homosexual best friend I don't think that it was ridiculous. He isn't saying that being gay is horrible, only that it effected him. I know gay people who would have said something similar if someone convinced others they were really straight.

I think this is a pretty big deal. Violating a customer's personal privacy and accessing their data of any kind is huge. I would have the person who illegally accessed the data arrested and charged. Yeah, I know....we have bigger problems, but talk about needing to send a message. It could have been a much more serious breach. When doing IT work, even reading a person's email while troubleshooting an email problem is a no no.

Who cares if someone calls you gay, straight or bi? There's nothing wrong with any sort of sexual preference. Now, if Dewberry had been called something really derogatory, like a Tea Party member, I can see where he might be upset.

Not only would be derogatory and humiliating to be associated with the Tea Party, would ruin their future, even for a job interview, because this will give rise to your thoughts are as incongruous as those of their candidates, I show you an example: "People ask me, 'What are you going to do to develop jobs in your state?' Well, that's not my job as a U.S. senator." —Sharron Angle, May 14, 2010

This actually happened in April of 2011. Why did it take him a year to become outraged?
Could it have anything to do with getting some e-publicity and having BB pay him some cash to make him fell all better about his "outrage"?

[insert lawyer joke here]
04:29 PM on 05/04/2012
jim: On what do you base your claim that Mr. Dewberry took "a year to become outraged."? I've read that he filed a complaint with the Best Buy manager the following day after he got his phone back. Where did you find conflicting information?
05:38 PM on 05/04/2012
He called and filed a complaint with the store the next day, is that correct?

years ago i went to best buy to get an e-machine computer with a friend who is on disability and could afford very little. the guy who came to help, the dept manager, talked the product down and was constantly talking up more expensive systems.
Finally, I just had to ask; 'If they are such crap, why are they on your shelves?' He wasn't ready to be called out on being a huckster for the bottom line and took a moment to recover and blame it on the corporation ordering for the store.
Thanks bud. really serving your customer's needs.

Best Buy is liable for their employees actions and he has a nice lawsuit on his hands.

Well, he could both post a redaction on facebook, and delete the post. And he could try to sue facebook... because that would make as much sense.

It is basically the same as having his phone stolen.

That he is worried about being seen as gay, and stating that is "tarnishes" his reputation, makes me have little sympathy for him. Instead of potentially understanding that this is the kind of thing all gay people have to deal with, he decided to make it an attack.

Is his livelihood being threatened? Is he in danger of losing his job? Maybe in danger of being excommunicated, or losing his kids, or his status as a scoutmaster? Again, now he may understand what all gay people have to deal with.

You need to deal with it because you are gay. He doesn't because he's not.
09:41 AM on 05/04/2012
Please show us one lgbt who was involuntarily and falsely "outed" as straight on FB via a stolen phone.

LOL --this is NOT an issue gay people have to deal with all the time.

You don't get it, Caper. Gay people have to suffer with people's false concept of who they are. Sort of like you're showing right now.

The situation should be taken as a learning experience. Gay people have to deal with similar issues on a regular basis. Who's the wimp now...?
