Daniel Chong, Man Forgotten In Cell For Days, Files $20 Million Claim Against DEA

Daniel Chong, the 23-year-old UC San Diego student who spent nearly five days behind bars without food or water, wants $20 million from the Drug Enforcement Administration for the epic "accident."

The Los Angeles Times reports that Chong -- who had to drink his own urine to survive in his 5-foot-by-10-foot cell -- filed paperwork on Wednesday because his treatment constitutes torture under United States and international law.

Chong was detained on April 20 while he was at the house of alleged ecstasy dealers. He wasn't charged with any crime -- though his lawyer told police he was at the house smoking marijuana -- but he was forgotten and left in his holding cell.

He was found more than four days later when an agent randomly opened the door, the Associated Press reported. Chong told reporters that the bewildered agent asked, "Where'd you come from?"

The DEA apologized publicly for the flop, calling it an "accident."

During his time inside the cell, Chong said he had drank his own urine to stay hydrated, considered suicide, ate glass and broke his own glasses to carve the words "Sorry Mom" into his arm.

"I pretty much lost my mind," he said on Wednesday.

He spent five days in the hospital for dehydration, kidney failure, cramps and a perforated esophagus -- an injury consistent with eating glass. He had lost 15 pounds.

"He is glad to be alive," Chong's lawyer, Gene Iredale told the Los Angeles Times. "He wants to make sure that what happened to him doesn't happen to anyone else."

I read Tom Hn's post, and was so bewildered by the asininity of it, I couldn't help but read it again a couple more times just to make sure I wasn't missing something. Your response not only made me laugh, it kept from wasting time pawning the guy.

I completely agree with this guy suing and I am sure a judge and jury will agree that this guy deserves a check. He needs to get a fat check! Because there is no way in hell someone forgets about me, i have to drink my own urine and resort to almost killing myself without someone being held liable. I feel really bad that we are in the 21st century here and have amazing technology but there are still people out there that are complete mental midgets. These are the people responsible for fighting the drug war and cant even keep up with the people they arrest and detain. Civil rights are a thing of the past I swear.....like really I think people can honestly give two sh*ts about civil rights anymore.

Number one, I'm not a "he" people, so I'd really appreciate people not assuming my gender. Number two, yes, to many it sounds impossible that I survived two months without eating and drinking because I'm so sick. Funny how the ones who want to diss that and become insulting, have never gone through it.I'm obviously a survivor and barely. I'm a heck of a lot tougher than I thought. Number three, I've never gotten in a situation where I've ever been arrested. He was. He smoked illegal pot, he was allegedly according to the article with drug dealers. HE got himself arrested so he's no victim and have no sympathy for him. But never once did you find me name calling him. Like me or hate my guts, I won't be subjected to abusive name calling posters and I'll file as many complaints as needed to not only stop them from name calling me, but abusing guidelines. I've been here a year, people. I've disagreed with a lot of people. But one thing I've never done is name call anyone or insult their intelligence. Civility WILL be observed. Ignoring a poster who wants to start fights is one thing. Abusive name calling posters is something I won't tolerate. I guess that's why I've not been allowed to be a monitor. I won't show favoritism. I have no more words on this matter.

So it's alright to deny the Constitutional Rights of any American if they use a substance that was criminalized for purely political reasons. Do you believe in torture too?

If Nixon truly cared about the health and welfare of the American people he would have put nicotine in Schedule 1 of the Controlled Substance Act instead of cannabis. Nixon really didn't care about the drugs. He needed to give law enforcement the tools to usurp the Fourth Amendment Rights of a fast growing targeted vocal minority group that just happened to openly use cannabis, the anti Viet Nam protesters.

Cannabis has been used for thousands of years as a safe, non-addictive medicinal herb. Even our first President used what our third President called "Sweet Indian Hemp" to treat the chronic pain of his famously bad teeth. My 83 year old mother has been legally using cannabis to treat the chronic pain from a fibromyalgia like condition that did not respond well to the opiates her doctor prescribed.

So it is just fine for you that this kid almost lost his life because he used cannabis which was criminalized by a big fat Unconstitutional lie?

where in the world is this place? how can you forget someone is in a cell unless you closed for 5 days and no one was around. sounds to me like he pissed someone off, and the person said, "ok I'll show you"..............

I am truly saddened by this story. This does not seem real. There was a lot of negligence unless this was done purposefully.IT sounds like one of those science fiction movies.
How does a cell in a DEA facility have a white powder in it on the floor which just happens to turn out to be meth?
Why is a person who is about to be released put into a cell with handcuffs?
How was he able to put a piece of his jacket under the door and no one not be curious?
There were five other holding cells and why is it he is screaming and no one responded?
This sounds like a poorly run, unclean facility.
Also where would a person need to do to go to a restroom even if they were only going to be there a short time?
A lot of people in this facility need to be fired,or demoted and replaced with competent people.

It's time to disband the DEA. In fact we will not be a truly free country until the failed war on drugs has been ended, the DEA has been disbanded and hemp is again growing unfettered in our fields.

Accident. Let's see how that flies in court. It was false imprisonment and gross negligence that very nearly cost this guy his life.

I hope he wins, and I hope the people responsible for this atrocity are fired. We don't treat child predators this badly, and this guy's worst (provable) crime was being at a party where drugs were present? Come on. The DEA has made too many mistakes, but this one is just terrifyingly callous. They didn't screw up a raid - they FORGOT about an innocent man!

Why does everyone think $20 million is so much? In this economy that's pocket change to the 1%, and would put you in the category of "well off" if you're not on of those bastards. $20 million is barely enough for this treatment, and if ya'll were stressed, disillusioned, debt-ridden students you'd smoke too. This is a better use of the money then whatever the government planned to waste it on. No one knows what he'll spend it on, and it's not your business. When someone deserves compensation for near-lethal neglect, they should get it no questions asked. It's not the defendant's prerogative to control this man's use of his own money.

I dunno about 20 million, but he obviously deserves serious compensation for what he went through which may have psychologically hurt him in unpredictable ways. And more importantly someone needs to be held accountable so that nothing like this can ever happen agian.
