Congress Revolts On Obama Plan That Would Ban 'Buy American'

A trade agreement currently under negotiation contains language that could potentially ban "Buy American" provisions, crimping American manufacturing.

WASHINGTON -- A group of 68 House Democrats and one Republican sent a letter to President Barack Obama on Thursday urging him to reconsider an element of the controversial free trade agreement currently being negotiated by the administration. If approved in its current form, the pact would effectively ban "Buy American" policies in government contracting.

Although the deal, known as the Trans-Pacific Partnership, has received relatively little media attention in the United States, it has sparked international friction among consumer groups and environmental activists who worry that terms demanded by the Obama administration will eliminate important public protections. Domestically, however, the deal's primary source of political tension is from a portion that could ban "Buy American" provisions -- a restriction that opponents emphasize would crimp U.S. jobs.

Since the 1930s, the American government has offered preferential treatment to American producers in the awarding of federal contracts. If a domestic producer offers the government a more expensive bid than a foreign producer, it can still be awarded the contract under certain circumstances, but more recent free trade agreements have granted other nations the same negotiating status as domestic firms. The Obama administration is currently pushing to grant the several nations involved in the Trans-Pacific deal the same privileged status, according to the Thursday letter.

"We do not believe this approach is in the best interests of U.S. manufacturers and U.S. workers," the letter reads. "Of special concern is the prospect that firms established in TPP countries, such as the many Chinese firms in Vietnam, could obtain waivers from Buy American policies. This could result in large sums of U.S. tax dollars being invested to strengthen other countries' manufacturing sectors, rather than our own."

The letter from members of Congress to the administration marks a rare glimpse inside the typically secretive trade negotiation process. The terms of the free trade negotiations, including the Trans-Pacific pact, are withheld from the public, even though the governments of all the countries involved have access to them. Many major U.S. corporations have access to the draft negotiation texts through their positions on advisory boards to the Office of the U.S. Trade Representative, the White House agency which negotiates trade deals.

"Buy American" provisions do not help all U.S. firms equally. Corporations headquartered in the U.S. that offshore most of their manufacturing operations do not benefit from the system designed to promote domestic production in the way that companies with actual U.S. manufacturing operations do.

Public interest groups also worry that the same trade policies that could ban Buy American breaks will also prevent the U.S. government from making environmental or public health stipulations in federal contracts. The current language barring preferential treatment for American goods is so broad as to limit government specifications on goods to purely functional aspects. When contracting for paper, for instance, the government could specify that it wants to buy paper of the dimensions 8.5" by 11" -- but it could not require that the paper be composed of recycled materials or use non-toxic dye.

The potential "Buy American" ban also conflicts with a top theme of Obama's re-election campaign -- boosting U.S. manufacturing. In February, the administration proposed fixing a tax loophole that has been exploited by oil and gas companies in order to provide breaks to domestic manufacturers. The tax proposal is not expected to gain any traction during an election year, however, although prospects for the trade agreement are much stronger. Last year, Congress approved three free trade deals initially negotiated by President George W. Bush that Obama had decided to support.

The White House was not immediately available for comment.

USTR spokeswoman Carol Guthrie told HuffPost that the administration is seeking "fair, transparent, predictable and non-discriminatory" contracting rules.

"The U.S. aim in covering government procurement under the TPP is to provide new market opportunities for U.S. goods, services, and suppliers," Guthrie said.

And you don't think a Mitt Romney Adminstration would do the same thing?

I think the lesson we ALL need to learn it that it's TOO F-ING LATE!! We were sold down the river 20 years ago. What don't you get? It was Clinton, then Bush now Obama. It has nothing to do with party anymore it has to do with "THE GLOBAL ECONOMY" that seems to have smacked Americans in the face ....a little too late.

The sad part is the Middle Class paid the biggest price in this "new" economy. But, it's not new. We closed our eyes when American companies first went to Mexico for cheap manufacturing, but it wasn't CHEAP ENOUGH for PROFIT MAKING so they partnered with CHINA. It doesn't matter who's President (well it does but) who ever it is will have tied hands when it comes to favoring America.

It's not enough to keep saying you're #1 in everything when you're really not. We let the garment factory owner and the car makers and the assorted crap factory owner and the toy manufaturer business and the textile mill owner decide our fate when they moved their operations overseas and we didn't do JACK. We didn't penalize them or tax them or nothin'. It's too late, we're in it now.

The corporations working the puppet strings of congress would never allow them to even consider punishing companies that increase profit at the cost of our economy. Tariffs were a part of our trade policy for over one hundred years until Reagan the Contract on America crowd destroyed most of them.

I guess we will see more of bridges like the one in San Fransico built by Chinese contractors and shipped to the U.S. This was agreed to by a Republican Governor. Talk about bipartisanship. Both sides screwing over the American Worker.

Sure it will "boost U.S Manufacturing .In other conutries, not ours.It has nothing to do with bringing jobs back to the U.S where they belong. Companies shut down their manufacturing plants here so they could get cheap labor overseas.Since the late 80's early 90's we have lost 6.5 million manufacturing jobs since 1989.
Our taxes dollars have gone toward helping these war-torn countries with jobs and health care along with building schools...
Dell has announced that it will be closing its last large U.S. manufacturing facility in Winston-Salem, North Carolina in November. About 900 jobs will be lost and the company has announced plans to dramatically expand its operations in China with an investment of over $100 billion over the next decade.
According to a new study conducted by the Economic Policy Institute, if the U.S. trade deficit with China continues to increase at its current rate, the U.S. economy will lose over half a million jobs this year alone. Ford Motor Company recently announced the closure of a factory that produces the Ford Ranger in St. Paul, Minnesota. Approximately 750 good paying middle class jobs are going to be lost because making Ford Rangers in Minnesota does not fit in with Ford's new "global" manufacturing strategy!!!

Awesome post. Thank you. I have never seen an administration so destructive to its own people. The Keystone Pipeline could have created so many jobs and now this!! It's like, whose side is he on? Certainly not looking out for America. Please pray for this country. There are so many issues that we just cannot do it without divine intervention. Please read II Chronicles 7:14. The Good Lord can restore our land IF we will humble ourselves, repent and ask Him for help. Crazy times that make no common sense.

The Keystone Pipeline would by the companies own estimate only create 5k to 6K temporary jobs. Ask yourself why would they want to extend the pipeline to the gulf of Mexico when there are refineries closer? It is because, Keystone oil would be designated for EXPORT!! It is a fact and admitted to by the company that wants to build the pipeline. It would by-pass the midwest increasing the cost of fuel for most of mid-America.

I stopped believing that congress was listening to the people of this country years ago. It's obvious they mostly couldn't care less about us. There may still be a few who aren't under corporate control, but certainly not enough to make a difference. Our democracy as envisioned by the founders effectively died with the Citizen's United ruling.

It's like when I bought a garden hose at Home Depot(Made in China), the label said that it was hazardous to drink from it? I thought, well, I would like to water a garden and fill the dog bowl up. What's the problem with putting poison in the manufacturing process? Americans can make them cheaper without the poisons. I say ban chinese vaccines too. Over forty vaccines come from china, with the US Government inspectors checking every 13 years. That's why they have to force vaccinations on you. It like russian roulette.
