Kalsum Pangkey, a 56-year-old undocumented immigrant from Indonesia, went to an Immigration and Customs Enforcement office on April 25 to report that she was ready to leave the U.S. and pay her way back to her country.

The authorities locked her in detention, where she remains. She had gone to the ICE office to say she would voluntarily depart and asked for a stay of deportation for a few months to arrange for the move.

"She told them she has the money, she wanted to pay the ticket, and the government still kept her," said her nephew, Arthur Jemmy, 36, who also fled Indonesia. "That's terrible."

Pangkey entered the U.S. legally on a six-month tourist visa in 1997, but her immigration status lapsed because she missed a one-year deadline to apply for asylum. She works here and sends money back to family in Indonesia, part of the reason why she asked to be allowed to stay for a few more months.

That request for a stay of deportation was denied by ICE last week, immediately sending Pangkey into immigrant detention. She is one of thousands of Indonesians who fled to the U.S. in the late-1990s and early-2000s because of violence against ethnic Chinese Christians and others. Many are now in the U.S. without documents because they failed to apply for asylum within the eligibility period.

When immigration agents told her she would be detained, she and a friend immediately tried to call an airline to arrange a flight back to Indonesia, hoping Pangkey could avoid ICE custody. They found a flight for the next day, but an immigration agent told them Pangkey would have to be detained until then, the friend, who asked not to be named because she did not wish to be publicly involved, said in a letter provided to HuffPost.

If she left the next day, Pangkey would need to buy her own ticket. But the ICE agent told her that if she stayed in detention for a week, the government would pay her way back, according to the friend's letter. Pangkey decided to take the free trip.

Nine days later, though, she is still in detention, even though she has a clean criminal record and could be eligible for alternatives to detention, such as an ankle bracelet, or prosecutorial discretion by President Barack Obama's administration that allows some immigrants to stay.

ICE spokeswoman Barbara Gonzalez said she couldn't comment on a specific detention case. She said the agency bases detention decisions on a number of factors and "is committed to ensuring that its limited resources are focused on the removal of those who pose a threat to public safety such as criminal aliens and national security threats, as well as repeat immigration law violators, recent border entrants, and fugitives from immigration court."

Pangkey is being aided by a small movement led by a New Jersey pastor, the Rev. Seth Kaper-Dale, to help Indonesian immigrants who are slated for deportation. His church, the Reformed Church of Highland Park, has welcomed five undocumented immigrants to live there. Law enforcement and immigration agents typically won't enter churches searching for suspects.

Kaper-Dale, along with Reps. Carolyn Maloney (D-N.Y.) and Chris Smith (R-N.J.), is pushing legislation that would allow Indonesians who entered the U.S. from January 1997 to November 2002 to have their asylum cases considered, despite missing the one-year ICE deadline.

Pangkey's detention adds to recent disappointments for the Indonesians in the U.S. Six Indonesian immigrants who lived near the church were deported recently and two others left for Indonesia on their own. Others under the church's protection are doing better. Saul Timisela has lived in the church for more than two months and Arthur Jemmy and Silfia Tobing, who are married, entered the church in mid-April. Jemmy, Pangkey's nephew, has been staying in the church for about two weeks.

The immigrants living in the church are all Christians who left Indonesia and entered the U.S. legally after violence against Christians in their homeland. Pangkey is Muslim, but has many Christian family members, including Jemmy.

Kaper-Dale said cases like Pangkey's make him question whether ICE is focused on removing people who pose a U.S. threat.

"What it shows us is that any thought that there is a case-by-case reality to this has sort of gone out the window," Kaper-Dale said. "When somebody who is ready to leave and comes in showing the money that she's ready to leave is still sent away, that suggests to us that at this point we can't really work with ICE."

You can keep them here in the US. I don't think Indonesian people will need those family back. Let me tell the truth about some of those refugees. They came here with tourist visa. It means they have misrepresented themselves to the US consulate when they applied for the US visa. So, they lied. Do you really want to keep those liars here in the US? If they could lie before, what will prevent them from lie now or in the future, e.g., defraud all social benefits here in the US.

A lot of people in developing countries know already that they can misuse asylum claim to get permanent residence here in the US. So, they apply for tourist visa, then claim for asylum once they arrive here and make horrible stories about their own countries.

Sure there is always conflict among groups in many countries. However, if they claim that all non-muslims are prosecuted in Indonesia, then why there are still Christians living in Indonesia, why there are Christians becoming members of cabinets / governors / Parliament? It means Ms Tobing and Jemmy actually can move from one place to another within Indonesia to be safe, right?

Seriously, undocumented "illegal aliens" shouldn't be thrown in jail. Why should we imprison refugees for crossing our border, when they are escaping violence or persecution in their home country? It's not a serious crime.

Some of these people are criminals, sick, uneducated, unskilled and maybe carrying diseases. We have a immigration program you have to apply for a visa not make up your mind that you will just come here. If we have no penalty for breaking the law everyone will do whatever they feel like.

If Saudi Arabia, if you steal they cut off your hand. I bet they don't have many repeat offenders.

This is no different that a wanted bank robber walking into an FBI office asking them to hold off on the arrest warrant for a few months "while I get my affairs in order". If one wants to self-deport, they leave the country and then send a post card to ICE announcing their departure. In the instant case, I'm sure the Indonesian Consulate could have arranged for that.

As long as we have the Cheney/Bush privatized detention centers, there will be more fiascoes like the one in the article above,

Don't know about 1st paragraph, it's a civil versus criminal issue.
Last paragraph hit the nuts on their heads...privatization worse than your example in the first paragraph. Bank robber caught, he's outta the game. Bush/Cheney perfected the stealing game- it's in plain sight and it keeps on taking. Like the nuke industry. And the military industry. We taxpayers pay for the product AND profit and all us wimps do is complain about here where it does no good.
What will do some good is to neuter the Dem and Rep and get some alternative parties going. Green I like from their great performance in Germany and Columbia. Shows what can be done if you get relatively honest people to represent and get enough people involved in their community.

Deportation is a civil issue, it's not a punishment. It merely removes a person who does not have a right to be here and returns them back to the country of their birth.

You have to ask yourself why they offered to pay her flight if she stayed in custody. These immigrants are being held in private prisons who lobby millions to write anti-immigration laws giving them tax-payer profits. Create a problem, make sure those without a voice are your unwitting customers, and shazaam—you have a billion dollar industry. That's why, I believe, they don't want to have people deport themselves. Where's the profit in that?

"those without a voice?" They are illegal aliens! If they do not want to go to a for profit prisons, don't come to the US illegally. I have never been to jail, you know why? I don't break the law. 10 years ago i did get a parking ticket at work and 21 years ago i got a speeding ticket in NM out in the middle of nowhere other than that there's my criminal record.

Illegal aliens break the law crossing the border or overstaying their visa. They made a promise to obey the terms of the visa and lied. Tourist visa you're not suppose to work, now they get false documents, greencards, SS cards/numbers plus driving in the country. How did she support herself for 15 years?

Throw her in jail.

For people who love the illegals invading the US, answer this - why do you people so hate and disrespect all those who obey the law and PAY the fees to enter the US and why do you people work so hard to protect child sex traffickers who hide in illegal communities that you work to keep safe?

So she just voluntarily walked into the offices of a law enforcement agency and promised to stop breaking the law if they would let her keep on doing it for a few more months.
Sounds like the writer of this article purposely left out a huge chunk of information here.
But that is always this writers style.

I bet the people advocating about her staying are the same people who want more money to go to low income people. News flash - importing (legally or illegally) millions of low income people will not mean more funding goes to that group - only a smaller and smaller piece of pie to each.

Sorry but bush was just as bad as obama on immigration. He tried (along with kennedy and mccain) to get a massive amnesty through but luckily for us most repubs and some dems fought it.

Nope - we have not had good leadership on this issue from a president for a LONG time. Unless your idea of leadership is to have rolling amnesties.

dtairtime, I'm aware of Bush's poor policies on allowing illegals to come here and stay, even thinking about giving amnesty. What I was commenting on was I don't think the Bush administration would have detained the woman if she wanted to go home on her own. But you are right about the Bush immigration policy, and I think the Bush's having hispanics in the family swayed his policies somewhat.

We are going to continue to have issues like this, until we institute a national ID and require its use to work, or buy food. And anything a person earns while here illegally, should be considered proceeds from Illegal activity, Subject to Confiscation. Not only should she be detained, But the HR rep, and company owner that she worked for should be picked up as well. IF you let anyone get away with this, then you should also issue a refund to all the people that did apply and pay for an I-9, paid for their biometrics, and purchased the required work permits, paid to learn the language, or take the test.

I got a new military ID card about 6 weeks ago. They took my picture and my fingerprints. The ID card is scannable and you have to be in the DEERS system. Going through the gate Tuesday was the first time i had it scanned to enter the base. Just a matter of time before driver licenses, SS cards, greencards and all IDs will be E-Verifiable.

This is not a bad thing because identity theft is growing, something has to be done.

You are right, they can make something look very good. But how can they get their information into federal data bases? The biometrics, fingerprints/iris scans?

For my military ID they took my picture and fingerprints by a finger print reader. that's all in a data base. Fake IDs won't have that info.
