Linda Evangelista & Francois-Henri Pinault Settle Child Support Case

Linda Evangelista

JENNIFER PELTZ   05/07/12 04:31 PM ET  AP

NEW YORK — In the midst of a trial that brought tales of the high life and high fashion to family court, supermodel Linda Evangelista and a billionaire French businessman have reached an agreement to end their child support fight, their lawyers said Monday.

Evangelista, Francois-Henri Pinault and their attorneys were mum about the details, which they planned to give to a magistrate on Tuesday.

"Everybody is very glad that it's over," Pinault lawyer David Aronson said.

The settlement came in the midst of a trial over how much, if anything, Pinault should pay toward the care of their 5-year-old son. Pinault is the CEO of a company that owns Gucci, Yves St. Laurent and other top-flight fashion lines; he's now married to actress Salma Hayek.

Both Pinault and Evangelista had testified at the trial, answering questions that delved into her career, his high-flying finances and his limited relationship with the boy. Evangelista had been due to continue testifying Monday.

The two sides negotiated all weekend and into Monday morning, according to a person familiar with the negotiations. The person spoke on condition of anonymity to discuss the private talks.

In legal papers, Evangelista had said she was spending $46,000 a month on armed bodyguards, a 24-hour-a-day nanny and other expenses for the boy, Augustin, nicknamed Augie. He was born in 2006 after a four-month relationship; Pinault said he and Evangelista spent only about seven days together in all.

Evangelista's lawyer said she willingly paid all the child's expenses at first, but she now needs some help. While Evangelista – who once quipped that supermodels "don't wake up for less than $10,000 a day" – testified that she still can command about $100,000 to walk a runway, attorney William Beslow said her roughly $1.8 million-a-year income sank last year because a major contract with L'Oreal ended.

"Ms. Evangelista is not looking to piggyback the lifestyle of Mr. Pinault," Beslow said in an opening statement last week. He said she wasn't asking for any particular amount.

As part of the family behind luxury-brands conglomerate PPR, Pinault makes about $4 million a year, and Forbes estimates his family's net worth at $13 billion. He wears a $100,000 watch, dropped about $52,000 on a 12-day vacation to Bora Bora and bought himself about $62,000 in clothes in a single year, according to his testimony.

Pinault, who has a 4-year-old daughter with Hayek and two other children from a previous marriage, legally recognized Augie as his son in 2007. Pinault said Evangelista asked for what he considered an unreasonable amount of child support, he countered with another offer, and he didn't get a response for years. She went to court in 2010.

"We are not going to claim that he cannot pay a fair and reasonable child support," Aronson said in an opening statement. But $46,000 a month, he said, would be "just ridiculous."

That would indeed be high, even for New York, though there have been some other big-money child support cases here. Rap impresario Sean "Diddy" Combs was ordered in 2005 to pay about $19,000 a month in support, and Revlon Inc. Chairman Ronald Perelman was ordered in 1999 to pay more than $12,000 a month.

She can earn 100,000 to walk on a runway but needs money to support a 5 year old? In what universe does it cost so much to feed, clothe and shelter a 5 year old? She has a 24 hour nanny for a job that consists of walking 30ft and collecting 100,000k?

The "universe" (to use your word) that YOU and some women live in, has cloudy and fuzzy values. You don't EXPECT the fathers of your children who helped create/make those children, carry 1/2 the responsibility to bring them TO ADULTHOOD.

Yes, this particular woman DOES need more than the average middleclass woman to support this child. She lives in Manhatten BECAUSE of her career. You feel the right to criticize a woman and lifestyle you know nothing about. YOU are ignorant of the cost of living there. These people don't live in YOUR "universe". She just lost her contract to L'Oreal. She has been supporting this child all by herself these years. She SHOULDN'T have had to do that. HE ALSO MADE THIS BOY, and that child deserves the same lifestyle of his siblings.....or do you even know what that word means ?

I am the mother of adult sons. They knew full well by the time they matured they better not create a part of them, or me, that they did not accept responsibility for and give the best start in life they could.

Francois-Henri created this child along with the others he spawned. He has the same responsibility to him as any of his other children. Read my other posts about the way children like this live. Private schools cost 20,000 + per year. If his other children are given private schools ,etc., so should this one. It is NOTHING to him financially.

Let's say a couple has a child while they're doing well financially. 5 years later they have another child. Then a year later they're not doing so well financially; maybe someone got laid off, maybe outsourced, maybe just plain old bad luck.

Does the second kid get to sue the parents for not providing the same lifestyle as the sibling?

Let's say the parents keep doing well financially. But one child tends to be very selfish and greedy. So they end up punishing him more often. And he doesn't get to have nearly as much stuff as the other.

Does the child get to sue for not having the same lifestyle?

In both cases the siblings experience different lifestyles. But no court would seriously consider it wrong for one kid to get more stuff than the other.

Because no one, not even children, is entitled to any given level of lifestyle. Courts don't enforce it if the couples stay together because life has its ups and downs; just because you're well off one year that doesn't mean you will always be well of. And even if you are, you're not required to lavish money on any of your children OR equally among your children.

Why should it be any different after a divorce?

Sometimes condoms break. If she didn't want a child she had at least 6 months to terminate. There's also emergency contraception. Lastly she could have put the child up for adoption.

The only honest conclusion is that she wanted to have the child. Since it is her choice the only one that should be financially responsible is her.

He is not very smart when it comes to his libido. He knocks up Evangelista , then he knocks up Hayek, oh but he marries her. Hmm i see a pattern here. Im gong to call him the 'Knock up guy" He will do this again, give it a few years.

Materialistic maternity…

This is the only child for Linda, nevertheless let's imagine she could already have had another child with a relatively poor man.
Would then her children have different lifestyles or would François-Henri have to provide for both of them the same lifestyle that Valentina enjoys?
08:06 PM on 05/08/2012
Legally speaking, in these odd hypothetical scenario, where she has child by another man and then they break up, that child's father would be legally obligated to contribute his share of child support, based on his income and the lifestyle that he leads.

In reality, and it is quite sad: some time ago Linda gave birth to a stillborn baby, and she and the man broke up afterwards. As for now at 47 it is unlikely that she would conceive again.

Rest assured, Linda would never have a child by a poor man or even relatively rich man. I believe she knew exactly what she was doing with Francois-Henri.
06:59 PM on 05/11/2012
No doubt about it, Henriette… I was just pondering the various possibilities.
There were assumptions that Augie could get mental scars for life if he new that his half-sister got a higher apanage than him, so I was trying to imagine a situation where Augie's would enjoy a life worth $46,000 while a sibling living with him would have to survive on —let's say— just $4,000 a month, because of a lesser father.

Learn from the mistakes of others...

If you're a wealthy guy, there's two things that need to be done:

1) Get a vasectomy. A $1000, 20 minute procedure will save thousands in child support payments.
2) DO NOT GET MARRIED! Nobody will care what you do if you're not married to anyone. Learn from George Clooney, Derek Jeter and Leo DiCapprio. These guys are smart not to get hitched to anyone.

No, just wear a condom. They sell them everywhere. Men are not the victims, their children they want to abort who will grow up without a father figure are the victims. "Robbed"? That deadbeat billionaire spends zero time with his child and had paid zero amount until he was taken to court. Why should she pay for all of the child's expenses, when she's taking care of him?

Men can use a condom, but some don't. It's not rocket science.
11:54 AM on 05/08/2012
$46,000 a month equates to $1,512 a day. On what universe does it take that much money to raise a child? This is just bootstrapping alimony.

My friend is a single Mom and she pays about $40,000 a year for a very very good full-time nanny. Ok, maybe it costs more in Manhattan, so pay the nanny $100,000 ... you still can't get to $46,000 a month in legitimate expenses for a small child.

It takes that much BECAUSE the father is a billionaire and the mother is a millionaire. The child should have the same lifestyle as the parents. Also, it would be unacceptable for one child of a billionaire (with his current wife) to be going to private school, vacationing all over the world, etc. when his other child is not. Sorry, if you have kids, you pay for them in accordance with your means.
01:38 PM on 05/08/2012
That's a terrible argument.
04:45 AM on 06/05/2012
If they were still married and lost all their money would the state lock them up for not keeping their children rich? Why is it only if they divorce is the child entitled to be rich?

Or,a radical thought; just because your parents are rich that doesn't mean you are.

This kid isn't suffering no matter how you slice it. To call living off of a millionaire instead of a billionaire suffering is to stretch incredulity beyond belief.

The largest chunk of the money is going to security because the boy is at risk of being kidnapped because his father is a billionaire.

If you don't think that's a viable possibility, look up children that it happened too.

And why shouldn't men pay for their children to live in the same lifestyle that they and their other children enjoy?

She has been solely supporting the child for years.

And men do not have a right to have sex with a woman, use no protection and then expect her to have an abortion. They also should not expect that if a pregancy results, that they will not have to pay a dime. Too bad for the deadbeat cheapskates. He's a billionaire who paid zero to his son.

here's what's interesting to me:

the main storyline is that a woman gets knocked by a dude, has to chase him down for child support.

in rich people land, it's a high profile case involving media, photographers and lawyers because she's a superstar model and he's a billionaire. they had a brief yet passionate affair and it resulted in the birth of an heir. made for tv, right?

in the regular world, she is his baby momma, he's some deadbeat dad. he shoulda put a hat on or a ring on it, she was trying to trap him. this situation plays out every single day, but when high profile people are involved, somehow it's not as "common" sounding.
04:49 AM on 06/05/2012
If she didn't want a child she could have terminated. Or put the child up for adoption. So even though she could have easily prevented the birth, and she is the only one who could, the man is still on the hook financially? Wow talk about milking the damsel in distress routine.

Not all can kill their baby. Per Francois, Linda is a very good mother. Having an abortion is an invasive procedure. The best thing that could have happened is that he could have used a condom. However, from your point of view women should shoulder most of the responsiblity. Too bad, those days are changing. Why should she should most the financial responbility? She wasn't born yesterday.

Ugly men like Francois use their money to sleep with women like Linda. So pay up.

WHERE DOES this prostitute thing come in ??? This is a VERY beautiful, highly successful woman in her own right. Excuse me, but males OR females of certain socio/economic levels usually date/associate with others of the same. That's who they are exposed to at their own social events, etc., who they have more in common with, AND who they have less concern about being exploited and victimized by. WHAT is so hard to understand about that ??

People who accuse others usually are PROJECTING what their own motives would have been.......
