Martijn, Dutch Pedophile Association, Outlawed

THE HAGUE, Netherlands — A Dutch court outlawed a pedophile association Wednesday, saying its promotion of sexual contact between adults and children breaches the country's generally accepted moral values.

The civil court in Assen ordered the association, called Martijn, to immediately be dissolved.

The court said in a statement that Martijn is a threat to public order because it "glorifies sexual contact (between adults and children) and presents it as something that should be normal and acceptable."

Its chairman, Marthijn Uittenbogaard, called the decision "an attack on the freedom of expression."

"We are not happy and we are considering whether to appeal," he told The Associated Press in a telephone interview.

The organization says on its website it was established in 1982 in the traditionally tolerant Netherlands as a "platform for discussion of pedophilia." It was largely ignored for years, but has been under attack more recently from lawmakers and prosecutors who wanted it banned. Such groups are almost unknown elsewhere in Europe, despite many countries' history of safeguarding freedom of expression.

Martijn's former chairman, Ad van den Berg, was convicted last year of child pornography possession and sentenced to three years in prison. Van den Berg claimed the images and films were for scientific research.

The group said in a statement last month that the court should not honor the public prosecutor's request for a ban, saying it had never committed a crime.

"It is naive to think that banning Martijn will make pedophiles disappear," the group, which claimed to have 60 Dutch members, said.

Prosecutors who sought the ban said they were satisfied with the court's decision, adding that it helps the Netherlands meet its international commitments to protect children from sexual predators.

Martijn also made headlines in 2007 when a member posted on the group's website photos of the then 3-year-old Princess Amalia, daughter of the heir to the Dutch throne.

The royal house went to court and won an injunction barring Martijn from publishing such photos on its site and Crown Prince Willem-Alexander harshly criticized the group for using the pictures.

"I have no words for this kind of child abuse," he said at the time. "Luckily, I didn't see it, because if I had, I'd have gone crazy and probably would not have been able to react reasonably."

Members of Martijn also were involved in a 2006 move to create a political group called the Party for Brotherly Love, Freedom and Diversity to take part in national elections with a platform that included lowering the age of sexual consent to 12 and legalizing child pornography.

The party failed to collect enough signatures from supporters to allow it to nominate candidates under Dutch electoral rules.

The group would have needed around 60,000 votes to win a single seat in the 150-member Dutch parliament, and pollsters estimated it would have gotten fewer than 1,000 votes.

In 2004, Denmark's top prosecutor investigated whether a Danish group that openly supported pedophilia could be banned. The investigation concluded that the DanPedo organization, which existed under the constitution's provision for freedom of speech and association, didn't break any laws.

However, the organization's website was shut down by its internet provider in 2004.

Kuno Soerensen of the Danish chapter of Save the Children said some DanPedo members attempted to create new websites, but that these, too, were later shut down.

"Every time we find one of these, we contact the Internet provider to tell them what kind of people are running these sites and they usually shut them down right away," Soerensen said.

Soerensen said a similar site also exists in Norway.

Answer: a lot better off!

Why would anybody anywhere allow these people to run such a site that targets children like that? I don't understand how it could have gotten that far. Children need to be protected from those who wish to physically harm them and nobody should be allowed to publicly use and abuse their little bodies in this fashion.

While I cannot condone the message of these people (I frankly think its disgusting), I'm concerned by the blatant disregard of the civil right of freedom of association for political purposes and freedom of speech. When we take away the rights of any group, we take away rights from all people. What will they outlaw next? Groups which advocate for gun rights? Groups which advocate for pagans? Without the right to advocate for a change in position of something which is currently illegal, how does one change the system short of revolution? The rationale applied by the Dutch Court could just as easily be used to "outlaw" proponents of gay sexual rights and gay marriage or even apartheid when those actions were at one time accepted by mainstream society.

The "slippery slope" argument is usually a poor one.

This isn't about free speech, this is about protecting children. Paedophilia is not just illegal, it's a crime that is universally considered sick, disturbing and harmful. Only those messed in the head think sexual abuse towards babies the kind of thing that should be debated or discussed.

You know I can make just a few changes in your statement and prove my point. . "Only those messed in the head think "interracial marriage is" the kind of thing that should be debated or discussed.  Or how about "Only thosed messed in the head think "women's right to vote". .Or how about "Only those messed inthe head think "homosexuality". . .Or how about euthanasia, full rights for blacks, Jews allowed in country clubs, . . at what point does the majority say somethings can "never" be discussed or debated?

With all due respect, but I'd say this is a slippery slope, if you assert that this ban must inevitably lead to another ban.

To give some background, the Dutch constitution, article 2, guarantees freedom of association and speech. The group itself was not banned for merely associating or expressing its views.

The investigations carried out by the DA's office in Assen led to the conclusion the way the pedophile club manifested itself was contrary to public order and morals on account of the fact its website provided links to sites showing child pornography. Also, on its website the association condoned and glorified both pedophilia and pedosexuality. The fact its chairman was convicted last year of child pornography possession and sentenced to three years in prison did not help the association's cause (if you can call it that way) either.

Freedom of association in this specific case weighs less heavily than the protection of potential victims, the more so as the Netherlands are a signatory to the UN' charters for the protection of children's rights.

You made my argument when you said that "freedom of association" weighs less heavily than protection of potential victims.  I cannot ever agree with the weighing of civil rights. In Nazi Germany, rights were stripped from the Jews, and then the Communists, and then the Churches.  If we who value civil rights do not oppose the first restriction of rights for anyone, we ultimately run the risk of losing those rights for ourselves.  I do understand your opposition to their proposed conduct however and agree that as a society  we should never approve of what they are trying to do; just their right to say and advocate for positions no matter how intolerable they are.

Th Dutch are always bending backwards for human and civil rights. In there zeal to provide for these ideals they have a tendency to go over board and allow things that have no place in decent moral society. In order to push their agenda the pedophile group Martijn proposed to lower the age of concent to twelve. Are these people for real. They must realize that common sense sees right through this. Perpetrators of this pedophilia should be procecuted to the full extend of the law. They have no place in society and may they never run into an angry parent.

Yes, there was one, and no, it was not tax exempt as it was not a non-profit group.

According to Dutch news sites the association was outlawed effective today, and is due to hand over its administration etc. to the courts within 5 days.

Better yet, round up all the members and lock them up / treat them in psychiatric institutions, they either have or will abuse children. It is a mental illness.
