Andrew Shirvell, Lawyer Ordered To Pay $4.5M To Gay University Of Michigan Student Christopher Armstrong

DETROIT -- A jury on Thursday awarded a gay University of Michigan student body president $4.5 million in his lawsuit against a former Michigan assistant attorney general who posted about him in an anti-gay blog.

The U.S. District Court jury ruled in favor of Christopher Armstrong, who claimed he suffered distress after a blog created by Andrew Shirvell accused him of enticing minors with alcohol and recruiting people to become homosexual.

"I'm just incredibly humbled by what happened today," Armstrong told The Associated Press. "This is truly a victory – not just for myself, but for a lot of other kids out there."

Shirvell, who was representing himself, said the jury award was "grossly excessive" for what was "clearly protected speech ... and activity."

"This should have been thrown out," he said, adding that he plans to appeal. "Juries give short shrift to First Amendment rights."

Armstrong accused Shirvell of defamation as well as emotional distress for his actions on the blog, in Facebook posts and during visits to the Ann Arbor campus.

Then-Attorney General Mike Cox fired Shirvell in 2010 after he criticized Armstrong, who graduated last year.

Shirvell has said he viewed his blog "as a movement to get" Armstrong to resign. Shirvell argued he was acting within his First Amendment rights and that his statements were either true or protected because of Armstrong's role as a public figure.

Armstrong's attorney, Deborah Gordon, had said she would drop the lawsuit if Shirvell apologized and retracted his comments. Shirvell said that was disingenuous, since it wasn't until closing arguments that a multimillion-dollar award was brought up.

Shirvell said he's unemployed and "there's no way I could possibly ever pay such a judgment."

Gordon said the jury couldn't make him apologize, so the money was the only answer.

"We needed him to retract the flat-out fabrications he had come up with about Chris," she said. "Once he refused to take responsibility, we put it in the hands of the jury."

If you get a chance take a look at Andrew Shirvell's interview with Anderson Cooper. I'm not a doctor, but Shirvell shows signs of Asperger's Syndrome.

But I don't know if Asperger's would impair a person's judgement f right and wrong.

He didn't "Critisize" him. HE stalked him, showed up at his house, picketed, he accused him of illegal activities, accused him of going after minors, etc... All of which were completely false.

The student only sued for $25,000 and said he would drop the case if the guy apologized.

Is there some reason that this article is trying to minimize what this guy actually did?

Another bad lawyer story. This time it cost the attorney money instead of scamming a litigant. You would think an assistant Attorney General would be above blogging about this student. Shrivell of course will appeal the verdict, but the jury was probably punishing him for other bad attorneys.

A case in the Northern District of Texas: A lawyer billing scam supervised by a Texas federal judge caused a business owner to have all f his all of his possessions seized, without any notice or hearing, and essentially ordered him into receivership basically putting him under “house arrest”. This was a huge story and should have been highlighted on the front page.

Remember that Mike Cox(R) Attourney General, believed this man competant and hired him. Graduate of Ava Maria Law School. Sort of Tom Monaghan's Catholic Liberty U.

Good. Lawyers need to be held accountable for the outlandish things that they say. They shouldn't be allowed to just say anything.

A student body president at a college is hardly considered a "public figure". Further libel is not protected speech and flat out defamation SHOULD be punished. I hope Shrivell loses his appeal and ends up finding out the hard way that lying about someone and attempting to smear them isn't a political right and has consequences.
