BILLINGS, Mont. (AP) — An attorney for the state of Montana says a former teacher who raped a 14-year-old student is wrongly putting the blame on the victim.

Assistant Attorney General Tammy Plubell said Thursday that defendant Stacey Dean Rambold is wrong to suggest in a court filing that the victim willingly participated in her rape.

The office of Attorney General Tim Fox is appealing Rambold's one-month prison sentence, saying he should go back to prison for at least four years. Rambold is fighting the effort.

Rambold's attorneys have argued that the original sentence from state District Judge G. Todd Baugh was appropriate.

Baugh unsuccessfully sought to impose a longer term after coming under criticism for saying during an August sentencing hearing that the victim "appeared older than her chronological age."
