Prop 8's Supporters Were Too Scared to Testify, But They Still Whine After the Fact

In celebration of the recent Ninth Circuit Court of Appeals ruling against Proposition 8, I was going to write something uplifting about the perseverance of the LGBTQ community. But I decided not to.

For one, I am sure that there are so many others who are going to be dwelling on that subject. For another, based upon the reactions coming from the religious right, I feel that another direction is in order -- that is, a missive directed to Maggie Gallagher of the National Organization for Marriage, the Family Research Council, and all those other folks whining about the ruling. (This missive would have included Mitt Romney because of his negative words about the ruling. However, seeing that it is Mitt Romney, I figure a week from now we'll find him supporting it.)

Maggie Gallagher wrote a piece with the headline, "Ninth Circuit to 7 Million California Voters: You Are Irrational Bigots." Meanwhile, others such as the Family Research Council, Concerned Women for America, etc. have sent out the usual junk about "unelected judges," "activist judges," "redefinition of marriage," and all of the other hyperbolic mess we have come to expect from them.

But here is my question, and it's relatively simple.

Just where were these folks when the original trial was taking place last year? Why didn't any of these folks testify as to why Prop 8 was needed? Remember, Prop 8's proponents could only find two witnesses, and both did a poor job defending the law. One witness, David Blankenhorn, inadvertently made the case for the anti-Prop-8 side. Where were Maggie Gallagher, Brian Brown, Peter Sprigg, Tony Perkins, or any of these other folks who put so much work in getting the law passed? Gallagher's headline alleges that 7 million people voted for Prop 8. However, amongst those 7 million, only two witnesses could be found? Who are they kidding?

All this outrage after the fact is bogus. It's a diversion, and a pitiful one at that. It's an attempt to obscure a basic fact: that Proposition 8 was built upon deliberate lies that Maggie Gallagher, Tony Perkins, Peter Sprigg, and the rest of those pushing it were too fearful to defend in court. None of these people -- not one -- had the guts to stand up in court, take an oath, and attest to the veracity of the claims they made regarding what allegedly would happen should marriage equality become legal in California, because they knew that the lawyers attacking the law, David Boies and Ted Olson, would call them out and reveal their deception.

So Maggie dearest and the rest of you folks, please stop whining. You are not fooling anyone. You dug this hole yourself, so you have no reason to cry out when the dirt comes in to bury you.

This issue has revealed the religionists as the liars and knaves that they are. They lie, lie, lie, rationalizing such dishonesty with the-end-justifies-the-means mentality. Who knew that religionists had such a capacity for hate?! When I was a kid, some time ago, when someone told you he was a Christian, you could reliably believe they were honest, decent and somewhat humble, or at least tried to be those things. These days, when someone says "I'm a Christian," it's like a warning, a red flag to run for the hills!

Excellent point! The religious have their church weddings where they can excluding any one who doesn't believe their particular set of fairy tales, but civil weddings should be for all. Basic civil right, Simple. All the religion talk is surely a smokescreen for hate and bigotry. Of course they could find no one to testify because there is no justification for insanity. We are all equal before the law or not. There is no middle ground. I can't understand any judge ruling for Prop 8; since it is clearly discrimination.

you're right, it IS a diversion... one that they're sending to their backers to raise cash for the next court battle I'm sure. Prop 8 was overturned, but there's still two weeks for the court to hold hearings for a further appeal... and I'm sure while that next appeal is going on, they'll place a stay on their ruling. I hope nobody gets the idea I'm pro prop 8 from this post (my Husband and I were married in 2008, while it was legal... and are definite proponents of marriage equality)... I'm just stating what they're doing. Yes, they're whining... but that seems to work for them when it comes to raising cash.

Maggie, Peter Sprigg, etc. didn't testify because they were cowards or anything like that. Most likely they didn't have the credentials to qualify as expert witnesses, per jaxstl's comment below.

I think they didn't testify because they realized it's one thing to lie as a matter of your job, but another to lie under oath. They would not withstand cross-examination, and they knew it. They might make a lot of money in the hate-gay-for-pay industry, but they don't want to go to jail for perjury. They can't make up statistics or cite unreliable sources or generally create any credibility for themselves under oath. That's why they hate the courts so much: it's the one place they can't play and win.

I don't think they could have testified since they are not experts on law or homosexuality. They are not scientist or sociologist, they do not posses advanced education and credential in Theology, nor to my knowledge any of them experts on constitutional law, so Olsen would have question their legitimacy before they even testified.

Still wondering where Maggie Gallagher, Brian Brown, Peter Sprigg, Tony Perkins, et al. were during the original trial?! They were making money. I'm sure they would have been delighted to testify - if somebody could have paid them enough.

Fighting marriage equality for these folks is how they make a living. Skipping the original trial was, for them, just simply a sound business decision.

The reason they were afraid to testify is because they would have to place their right hand on the Holy Bible and promise "To Tell the Truth, The Whole Truth, And Nothing but the Truth, So Help You God", and they knew they would have to lie. They knew they had to lie to get Proposition 8 passed, but they could not lie to defend it.

Alvin, your insight is profound. I never thought of it over the months, but, you're absolutely right! I would have relished them on the stand when they pontificate, as in the case of Perkins,"Well, the social sciences say...", and have David pointedly ask him to prove it! Would it not be great. I, personally would love to see them caught in the miasmic smokescreen that they are paid, quite handsomely, to do! All for the sake of instilling fear, bigotry and hatred in the emotions of their constituents. Ah, but it is only a dream. These are conniving montebanks, if you will, that we are dealt with, and wimpy ones at best.

I understand that this is an emotional issue but please try not to stoop to their level. Name calling and insults will not reveal just how wrong they are. Facts and truth. Thats how we win.

I don't think so, LMPE. I believe they knew they were going to lose from the start. This was simply their way of getting equality (and not just in marriage) to the SCOUSA where the Bush Court will affirm that Gay people are 3rd class citizens.

Not sure how much it would matter, given that their "expert" witnesses turned out to be not all that expert on the stand. It was really bizarre to read in the transcripts--marginal degree work in the field in which one was presenting as an "expert", no peer-reviewed studies on the field in which one is supposedly expert, and on and on and on.

And since marriage is all about procreation - forbid marriage for those where one or both of the individuals are infertile ("Sir, we will need a sample before we issue a marriage license") and those who opt not to have children

I've seen the "procreation" argument brought to its frightening yet funny logical conclusion once. How about this:

- To get their initial marriage license, a couple needs a current or recent document proving that they can have kids together by natural ways.

- A marriage license is not a permanent document. Regular checks are made: if the woman is pregnant or if the couple has natural kids under the age of 18, then the license is automatically renewed (couples are not allowed to refuse renewal). Otherwise, the license is automatically void. The only way to divorce is to have at least one kid and raise him/her to adulthood.

Let's see if Maggie, Tony and co. could live with such a system.
