It will be up to the judge to determine the legal
status of the highly visible piece in the Outlook
Section of the Sunday Washington Post that
is a partisan attack on the prosecutor and the
CIA and yet another smear attack against Joe
Wilson.

Is this an attempt by the Washington Post to
influence the jury after the defense has rested?

Is this an attempt to present arguments, facts
and assertions to the jury that were not legally
admissable at trial?

Is this some form of jury tampering?

This will be up to the judge.

Memo to senior Democrats and anyone who
believes in the rule of law:

If Mr. Libby is convicted, there should be an
immediate nuclear blast call on President Bush,
within minutes of the verdict, to publicly and
unequivocally state he will not issue a pardon.

If the President refuses to make this pledge
the Congress should immediately announce
major hearings on this entire subject.
