Don't be so sure. Title companies are well aware of the pitfalls of the chaos in the housing market. When they see a house with clouded title or MERS involved, they won't issue a policy for that house or only issue one at a higher cost and include lots of exclusion and exceptions on the policy to cover themselves, leaving the policyholder fully exposed.

Many Title Insurers, such as Stewart Title, are part of the problem. They helped develop MERS, which is the main problem with title issues. The title insurers are now refusing to insure many foreclosures because of this issue.

The rule of law is upheld: Prove you have the right to collect payments or foreclose. If you don't and you come before the court with fraudulant documents you should be held accountable for fraud upon the court and perjury. No get-out-of-jail-free cards for the banksters.

No true. One owner paid, but the payments were to the "wrong" bank, and got foreclosed on. It happens often because the title isn't clear. This was not the owner's fault. I think there should be a law that wherever you got that original mortgage is where that mortgage should stay until it is paid off. No more "bundling" into investments. This is just plain wrong.

That is difficult to do when you don't know who the investor is. Default only occurs when the investor(s) does not get paid.

Bank A: I own it! And will manufacture the papers that say so!

Bank B: Um, we own the actual real papers....

'capitalize'? What's that about. This is about Lying buyers that innocent people are being Forced to bail out. This is a travesty to every renter and young person who does Not own real estate. Don't try to spin this travesty into some other argument. Any 'misfortune' could have been avoided by Not lying to get a mortgage and/or then piling credit cards and a second mortgage on top of it.
