There was never anything hidden about the fact that growing and/or selling marijuanna is a federal crime. EVERY business has to put due diligence into making sure it's in compliance with the law... and clearly this guy did not. So where do we draw the line? We're already saying banks aren't going to be held accountable for institutionalized perjury and fraud, we're saying the pollution industry isn't held  Read More...

He won't. The AG didn't, after several debacles. But democrats and republicans who don't get ahead on this issue will lose to candidates who will.

I believe that medical marijuana is effective for those who are in chronic pain because it distracts the mind from concentrating on the pain. In other words, it takes a person from one place to another place and that other place is far better than chronic pain. It should be legal for all those in chronic pain.

I agree with you but (and I know you`re not a doctor) isn`t that the same way synthetic opiates work ?

There's a huge issue now for people with chronic pain. So many Doctors won't give synthetic opiates to chronic pain patients any more, and it leaves them without any way to help their pain. You wouldn't believe how many people kill themselves each year because of inadequate pain control.

There is a very simple explanation as to why the feds busted several medical marijuna facilities at that time. The White House was in need of some weed for a hip hop barb-b-que party they were throwing.

Mr. Obama needs to come out as strongly in favor for abolishing the anti-"Marijuana" laws as he has on other areas of importance.  He has been far too timid on this issue.

I feel bad for the guy but ..... "Davies disclosed to the officer that he was on his way to respond to an alarm at the warehouse where he stored his marijuana supply." !!! That was his second mistake. His first was running a commercial marijuana operation under the guise of providing medical marijuana. He's not ill and he's not a medical caregiver. He's just a very clever man who is making a fortune (an estimated $8 million annually) cultivating and selling pot in retail outlets to folks to have bogus medical marijuana cards. And let's be real - ALL organized crime outfits work very hard to project the appearance of being legit and operating within the framework of the law. While I am very PRO-legalization I think Davies is a wolf in sheep's clothing and, apparently, so does the Federal government.

There's no requirement to be a "medical caregiver" to run a dispensary. It sounds like he wasn't breaking any state laws, so its a mystery how this got referred to the feds (the officer is with the state). I don't know where you're getting the $8 million figure from either. From this article, there doesn't seem to be any difference between this guy and the thousands of other dispensaries/producers that are running afoul of federal law but not being prosecuted. This looks like selective and capricious application of the law.

Got the $8 million from a local CA paper about the arrest. He got referred to the feds by the local police (from his pull over and another unrelated incident at his business). I get the impression the problem the feds have is the sheer volume this guy manufactures and markets, even though it is legal in CA. We'd eliminate all these problems if we just legalized it federally.

In California there are only two classes of people who can grow or possess weed. Patients and their caregivers. Mr. Davies was neither.

This guy is looking at ten years where he will probably be exposed to more criminals then he would have ever encountered in his normal life. He might not even survive inside federal prison. How is this productive? When he was on the outside he was paying taxes (at least sales taxes) and contributing to the economy. I hope this family can figure out a way to get a good lawyer.

If Obama were to get involved in a case like this, he would be massacred by the Republicans and Fox news.It is a shame though. This lady's husband would get a congressional medal of honor in a fair world.I find it hard to believe that he would serve 10 years for this.I hope this woman bringing national attention to her husband's case saves him. I wish her the best.

Total number of liberties taken by Bush and restored by Obama - 0

Total number of liberties curtailed by Obama - Dozens.

Including direct violations of the 4th, 6th and 14th Amendments and Article 3 of the Constitution.  You are barking up the wrong tree here.

But most first time DWI doesn't result in 10 years in prison or any prison time. I agree no prison time for first offenders as long as no one was hurt or killed in the the process.

Obama should lead the way and push to legalize it on a federal level. It would save tax payers a bundle.
09:47 AM on 01/26/2013
YES! And then--then-- drug testing for a non-psychoactive metabolite of THC would be legally seen as job descimination against those who use marijuana--even if it's just once a month. Urinalysis does not catch the reckless employee who comes to work high.

If this guy is not a rich famous left leaning hollywood person then forget about it as Obama hates the everyday working hard middle class. Although if he is ultra poor then Obama might just give him a blank check covered by the people.
02:45 PM on 01/15/2013
What? Who do you really think Obama cares for??? He has proven it over and over again. He cares more about the middle and lower class than any other President this nation has seen in a long time. Something tells me that you must be a self indulged pos republican that cares more about yourself and how you can make and keep more money. Most likely the type of person who's way of thinking is "It's a drug, if you are growing it then you must be a drug dealer. F*** him lock him up and throw away the key!" Its people that make comments like yours that ruin everything that our President is trying to accomplish to bring our country back to where it needs to be. Back to where it was before Bush ever came into office and started putting our kids' futures at risk. I am a middle class father and husband, and since President Obama has been in office, our families and many others lives have progressivly gotten much better. So f*** all of you small minded, uneducated, racist, bush lovin fa*s. By the way anyone who is a supporter of the Bush addmin, He did cause 9/11. It's not a conspiracy, it is fact.
