for a woman to act when pregnant the same way as when she's not is not only a physically misleading but also morally wrong. And some trying to say that a woman bearing an 8 month old pregnancy is entitled to take action that is knowingly going to harm the baby for her own benefit may have religion, but have no morals. No, she was not a walking womb, she was a walking MOTHER.

Do you think it's possible that the strain of the pregnancy: physical, emotional, hormonal, may have put this woman in a depressive mental state that drove her to suicide in the first place. I believe the term for it is pre-partum depression.

Of course, that's probably a shade of grey your righteous morality filter could never perceive.

the term is pre partum PSYCHOSIS and it's simply not the case is it? it doesn't kick in because a man leaves you. everything nowadays is depression - an excuse to kill, to leave, to get divorced, to quit working. post-partum depression? kill the baby. pre-partum depression? kill the baby. excessive weight depression? kill the baby father left? kill the baby. depressed? GET A FRIGGING anti depressant like half of the population. RAT POISON gets rid of baby not of depression.

She was not trying to "knowingly harm the baby for her own benefit"...she was trying to kill herself. Do you really think she was in her right mind?

I KNOW she was in her right mind. She sent a letter to the man who fathered the child saying she was going to die and take the baby he had named Crystal with her. That's not someone depressed - that's a woman exercising REVENGE.

Is ANY child-killer in their right mind? The "benefit" to killing the baby was revenge. She said so herself.

I consider this a murder - suicide, only she didn't get the suicide part right. She should totally be held accountable for this.

Yes, she did have some sort of mental breakdown. And one should not be charged with having a mental breakdown unless that breakdown affects others, as it did that poor baby. Many woman go through what she went through and even worst and manage not to kill their children.

Now you're getting into issues of personhood. When Bei Bei made the suicide attempt, the baby was not born yet. If we start giving personhood rights to the unborn and start holding women accountable for the outcomes of their pregnancies, then you put women in a position where their bodies can be policed by the state, and their own rights can be trumped by the rights of the fetus inside them. Where does that end? If my doctor declares that an early induction or c-section is in the best interest of unborn baby and I refuse, can he get a court order and force me to undergo a medical procedure against my will or have my parental rights terminated? If I drink a glass of wine while pregnant, should I be arrested for providing alcohol to a minor? If I miscarry, should I be arrested for manslaughter?

Buttons, signs, t-shirt slogans etc are always banned from a court room during trial. However, you can't get a broad ban to limit all questions that might elicit sympathy from a potential juror, only questions based on untruthful or irrelevant information. Since the defense is attempted suicide, facts relating to that and her reasons for same, are going to be relevant and admissible. The Prosecutor better get used to that.

"I will kill myself and this baby you named Crystal" says the letter she sent to the father. if someone can sympathize with this, I would be more disappointed than I already am

A person who is seriously suicidal, as you would have to be to eat rat poison, (which is a horribly painful death), is simply not thinking in a rational manner. When she truly believed that she would be better off dead, of course she believed the same for her child.

The alternative was a child left to the whims of a father that hated and abandoned her. Contrary to popular belief, an unwed mother is NOT legally entitled to give her baby up for adoption all by herself. The father has equal rights, and can assert them to block any adoption. Imagine the endless legal ongoing complications of this, trying to protect your child from her father and his hostile wife, when you just want to be dead.

So yes, I sympathize with her. She was mentally ill, and faced with extreme circumstances even rational people would have difficulty handling.

Women as more than walking wombs. This law is being misused. The hospital personnel who are further victimizing this woman should be ashamed of themselves.

How is the woman being victimized? A baby that is 8 months in the womb is capable of surviving outside of the womb. Whats more at that stage of development the baby feels pain. What she did was selfish and she should be prosecuting for ending a life.

The problem is that this sets the ground for dehumanizing *all* pregnant women. The best quote up there for this was:
"This case aims to set a precedent that reduces pregnant women to walking wombs under total state control and surveillance at all times, subject to getting thrown in jail if for whatever reason we can't or don't obey,"

This has no wiggle room for the mental health of the mother; the problem here is that she tried to commit *suicide,* not infanticide. She didn't stab herself in the stomach, she took a poison to kill *herself,* and her child may (or may not) have been affected. It's the whole picture, not one part of it.

Because this isn't about the baby, this is about the mental health of the mother. She needs help, not to be prosecuted.
