Sheriff Arpaio Indicts Political Opponents While Feds Investigate Arpaio

PHOENIX, AZ -- Sheriff Joe Arpaio, famous for his aggressive prosecution of illegal immigrants, has become mired this week in a whirlwind of back-and-forth accusations, investigations, indictments, arrests, and general animosity between warring factions of local politicos in Maricopa County, the fifth largest county in the country. Disputes have become so overheated that Sheriff Arpaio has been barred by one judge from searching the home of another judge.

Arpaio, equally loved and despised by anti-immigration and pro-immigration activists respectively, is known as "America's Toughest Sheriff" for his hard line stance on immigration lawbreakers and his tent-based jails.

This week, Arpaio and County Attorney Andrew Thomas indicted Maricopa County Supervisor Don Stapley for the third time. They also indicted Maricopa County Supervisor Mary Rose Wilcox. Both Stapley (R) and Wilcox (D) have been vocal opponents of Arpaio's hardline immigration enforcement policies. Stapley has been charged with fraud, theft, perjury, forgery, and false swearing. Wilcox has been charged with conflict of interest, perjury, forgery, and false swearing. The merit of the charges, though, are lost on a public who is becoming increasingly cynical of the persecution of political foes in Maricopa County even for a local folk hero like Arpaio.

Last week, Thomas and Arpaio alleged in a RICO (racketeering) suit that Stapley, Wilcox, Judge Gary Donahoe, Judge Barbara Mundell, another judge, attorney Tom Irvine, and attorney Ed Novak have engaged in "a pattern of using their offices to benefit themselves" and have conspired to hinder the investigation and block the prosecution of conflicts of interest related to a new $347 million court tower. Then on Wednesday, after Judge Donahoe refused to recuse himself and just hours before Donahoe was set to hear a case that could have resulted in Thomas being barred from prosecuting county officials (i.e., Stapley and Wilcox), Thomas and Arpaio filed criminal charges against Donahoe for bribery, obstructing a criminal investigation, and hindering prosecution.

Much of the current back-and-forth between warring local political factions in November 2008 when Arpaio and Thomas first indicted Stapley on 188 criminal counts. They alleged that Stapley failed to disclose conflicts of interest and failed to declare income from land on his taxes. The Maricopa County Board of Supervisors (on which Stapley sits) retaliated within weeks by revoking Thomas's ability to represent the Board in civil cases.

After the Board contended that Thomas has a conflict of interest in prosecuting the case because his office provides legal advice to the Board, Thomas referred the case to Yavapai County where months later half the charges were dismissed and the other half thrown out. In September of this year, just days after the first case was dismissed against Stapley, Arpaio's office arrested Stapley on 100 new counts. When Yavapai County refused to take the new case, Thomas tried to appoint a special prosecutor, but the Board, citing inappropriate procurement procedures, refused to ratify that appointment.

Reportedly, the FBI is investigating Arpaio, who works hand-in-hand with Thomas on these corruption cases, for alleged abuses of power. Besides Maricopa County Supervisor Don Stapley, other local political opponents of Arpaio have also found themselves subjects of investigations by Arpaio and Thomas, including Phoenix Mayor Phil Gordon, former Mesa Police Chief George Gascon, former candidate Dan Saban, Arizona Attorney General Terry Goddard, Maricopa County Manager David Smith, Superior Court Presiding Judge Barbara Mundell, ACLU attorney Dan Pochoda, and Phoenix New Times reporter John Dougherty. This week, the Phoenix Business Journal reported that the U.S. Department of Justice (DOJ) had set up an Arpaio-specific hotline for Maricopa County residents to report suspected wrongdoing by MCSO related to "crime sweeps, traffic stops, and immigration raids." In March, the DOJ announced an investigation into alleged patterns of racial discrimination based on national origin. Although the DOJ has not been specific, the consensus among Arpaio's critics is that the investigation relates primarily to racial profiling and illegal searches and seizures. In October, Arpaio complained publicly that DOJ investigators had posed as reporters to gain access to one of his press conferences.

When connecting to the DOJ's Arpaio tip line, it says, "You have reached the U.S. Department of Justice Civil Rights Division, Maricopa County Sheriff's Office investigation line." Then it prompts the listener to choose between English and Spanish. By lunchtime Wednesday, both the English and Spanish mailboxes were full. They have been full throughout the week and are still full as of Saturday morning. The toll free number for the tip line is 877-613-2137.

In the new indictments against Stapley, Arpaio and Thomas allege that Stapley obtained loans through fraudulent means and misappropriated campaign funds from his campaign for President of the National Association of Counties, which is not a public office. According to the indictments, Stapley used campaign funds for personal use, including hair implants, furniture and decor for his home, tickets to a Broadway show, electronics, massages, groceries, a family vacation in Hawaii, a vacation in Orlando, and a ski trip for his son.

Arpaio alleges that Wilcox did not disclose business loans from Chicanos Por La Causa, a nonprofit that assists the disadvantaged, before voting on grants and contracts that the organization benefited from. Arpaio also executed search warrants on the nonprofit organization this week while they were holding a conference in their offices.

Donahoe is also the same judge who suffered the retaliation of an entire cadre of Arpaio's deputies last week after he held Deputy Adam Stoddard in contempt of court for taking an attorney's privileged papers out of her briefcase and make copies of them in the middle of a court session (a stunt so outrageous that it made national headlines). After Stoddard was ordered to serve jail time, Arpaio called Stoddard a "political prisoner" while other deputies disrupted court proceedings by holding a "sick out." The same day, the courthouse was evacuated because of a bomb threat, and deputies held a candlelight vigil outside of the courthouse that evening. Stoddard was released this week pending an appeal.

Though Thomas indicted Judge Donahoe for bribery (among other things), Thomas concedes that no money has changed hands. However, he says Donahoe stood to gain indirectly by the completion of the court tower (where Donahoe's court offices would be located). Thomas contends that Donahoe failed to disclose a conflict of interest, namely that attorneys Tom Irvine and Ed Novak were hired by the county and by the court (which will occupy the tower) to represent both in relation to Thomas's investigation into the new court tower. There was also a kerfuffle this week over the disclosure of Judge Donahoe's home address on court documents prepared by MCSO on Wednesday. Critics pointed out that Arpaio and Thomas went after reporters two years ago for publishing public documents that listed Thomas's home address. By the end of the day, the court ordered the removal of Donahoe's home address from the record.

Thomas is also alleging that Superior Court Judge Barbara Mundell has been purposely assigning cases, including the court tower and Stapley cases, to judges who are biased against both him and Arpaio. These accusations, which are part of the racketeering suit filed last week, prompted Mundell to take pre-emptive action Thursday night to obtain a court ordered stay prohibiting Thomas and Arpaio from executing any future search warrant on her private residence and her court chambers. The ruling says that search warrants by MCSO would exceed legal authority and would "represent an arbitrary and capricious abuse of discretion."

On Friday, Arpaio executed a search warrant on local computer firm Calence (owned by Insight) in relation to the racketeering suit and possible additional charges of fraud, computer tampering, and procurement irregularities against the Maricopa County Board of Supervisors, County Manager David Smith, Maricopa County information technology employees, and the Maricopa County budget office.

At a press conference earlier this week, Thomas described the county government as a corrupt "triad" of corrupt judges, attorneys, and county officials. He promised that more criminal charges will be filed against the others named in the racketeering suit. Thomas says his office will prosecute each of these cases and maintains that he has no conflict of interest, regardless of appearances. He bristled Tuesday at questions that he and Arpaio could be acting out of political vendettas, saying, "I think there's a perception that they are trying to generate so they can beat the rap, but it's not going to work. Nobody is above the law in this country."

And no Most Folks would not Vote for " Joe"....I'm not gay and the word eclectic means diverse population...ie...people of all colours and races and gays,,,,get used to it.

Most people are posting here about Arpiao but Andrew Thomas is also out of control. This guy thinks he can just charge people with serious crimes whenever he feels like it, just look at the Matt Bandy case, and now he files charges against people who question what he is doing.

After I heard about the Matt Bandy case and the fact that they are considering disbarring him in arizona, this stuff does not surprise me one bit.

I blame the voters of Maricopa county for this debacle. You Arizona voters put these clowns in place. You Arizona voters have been keeping them there. The sheriff has been there for years and has been re elected for years. The rest of these local elected officials seem to have been around too. Maricopa county people, their your officials. You voted for them. Now you live with them. You all wanted to be good loyal "conservative" people? You got them now.

Most of us could care less about being conservative. We voted for Joe because he enforces the law. If he was a Democrat we would vote him just the same. You guys get too bogged down in liberal vs conservative, which is not important in local elections.

How much money does this man cost AZ? Now the DOJ has to step in? So now he's costing the federal govt? I think this alone is enough to have him removed, regardless of anything else.

Well, the lawsuits brought against him in the past few years for violation of rights, neglect and prisoner death, inhumane procedures, shady dealings, etc have cost us MILLIONS in the past few years. Not to mention that the county spends over $500k a year just on his personal security, which is now going up to over $1m since he thinks his home and family are in danger after the Lou Dobbs home shooting.

But, the folks around here would gladly pay taxes to keep him around if they don't have to "pay" for illegals social security and medical and welfare and whatever else they think immigrants are "taking" from them. The state just passed a law eliminating Cultural and Women's studies from all Arizona schools because they don't want them to learn about the history of their culture and get chips on their shoulder, and is trying to make it impossible for citizen children of immigrant parents to attend school. If they want to go to school they have to reveal their immigration status and face their parents being deported.

All the while those laws were being passed, the state budget was being held hostage from the governor, much-needed tax increases were shot down, and our state landed in the lovely #2 worst deficit in the country spot. Niiiiice.

Most of these investigations and lawsuits are meant to harass the Sheriff. Any other sheriff that enforces immigration law will have the same problem.

Once Sheriff Joe can arrest and deport the criminals we won't have to worry about lawsuits.

Oh, and we all know that the DOJ is up to -- it's just Napolitano trying to be a bully because she has always had a personal problem with Arpaio.

Good comprehensive article Dawn, the only thing you need an FYI on is where you said that Arpaio is equally loved and hated by the people here....NO, I live here, there is no "equal" going on, for every Anti-Arpaio activist there are at least 100's of people who also cannot stand him or what he does, but they don't go out and do anything about it........I have been a vocal activist for 2 yrs now and have seen repeatedly the numbers of people who come out for and against Arpaio.. There is ALWAYS way more antis than pros. Usually 2000 protesters and 25 of them (Pro-Arpaios) show up. Unfortunately the media gives them the same coverage. I have seen this time and time again. It is not equal Dawn, he even has the very small USA (United for Sovereign America-Neo Nazis) support, but even combining the Neo Nazis and the Nativists (pro-Arpaios), their ranks are a smidgen of what the civil rights lovers are.

Most of the anti-Arpaio people at that protests are young kids that are bussed in from Catholic schools. Their parents are bussed in from the farm. They are given a sign and told to wave it -- I doubt most of them even know who Arpaio is.

Lot's of hypocrites say they hate Arpaio, but when it comes to their own security they want a tough guy and they vote for him. When our homes are being robbed or our daughters raped by illegal aliens we don't want sissies like they have in Pima country. We know when we call the sheriff the criminals will get their due.

Eclectic? That's a funny term for gay men wearing pink panties that moved to Tucson from San Francisco. If Arpaio ever arrests them and puts them in tent city they will be called something else that sounds sort of like beeches. Arpaio won't need to give them pink underwear, which will help Arizona's deficit.

I've lived in Phoenix for 20 years.

Posters here overlook that Arpiao's behavior did not escalate until Andrew Thomas was elected county attorney. The former country attorney, Rick Romley, a Republican, was professional and would not stand for this.

A Z has a large Republican registration advantage and only 3% of the population is black. Granted the Latino population is large, as is the Native population, but their population(the Natives) in Maricopa County is small.

Suppress the large Latino vote, a Joe specialty, and all that leaves is white people to vote for Joe.

No one will run against him because he uses his department to harrass them.

The problem isn't even llegal immigration. It's taxes. White people are outraged that their tax money pays for illegal services, overlooking the fact that many of them work (using fake SS numbers) and pay taxes, but never use services for fear of getting caught.
It's not right, but white people need to come clean and stop the law and order BS and admit, like the selfish Republicans they are that it's all about taxes.

The business community, especially the small business man, loves illegals.

Couple of years ago voters passed an employer sanction law. An employer knowingly hiring illegals could have their business license revoked for a 2nd offense.

Guess how many businesses have had this done to them under this law? A round number it is.

I simply tell the republicans this fact is proof there are no illegals in AZ.

This is just nonsense. First, it is impossible to "suppress" the Latin vote. That is the single most absurd comment I have read on this subject.

Next, using his department to harass - again, I would love to see some hard, documented evidence for this. I hear these kinds of remarks made by both liberals and conservatives and they are galling.

Next, you know NOTHING about being a small businessman as you are not. I have been in business for thirty years, am a CPA, and am the sixth generation in my family to own a business. And all of my siblings own their businesses. All are college educated and ordinary citizens. ALL of us employ people like YOU. Your job depends on us, whether you like this fact or not. All of us are tired of the ranting and loose conduct with "facts" - the use of opinion as if it were fact. All of know - and especially the CPAs among us - that higher taxes constrict and suppress business formation. All of us know that when we have more money, we expand the business. Less money forces us to contract. Anyone - and I mean anyone - who does not grasp this fundamental law of economic "physics" is simply ignorant or deliberately lying to support some other agenda.

Your political ranting is not helpful - it does not help people make sound decisions.

As for being a small business man, GET OVER IT. You are not as important to the economy as politicians have you believing. Most small business people I know are either failed employees from large corporations and think they can go it alone, or they want their own business to take advantage of the black market economy, especially paying taxes, or they just can't get along and be a team player in a large corporation unless they can be in control.
And with white people screaming they want their country back, you sound like the later, afraid of losing your original privelage to the dark hordes.




ONLY tax increases on the wealthy can get us out of the financial mess we are in. Unless you want to cut drastically governemt spending and you've convinced me we should start with Small Business Administration.

Remember, Congress cut taxes 1.8 trillion dollars during the last administration and the unemployment rate DOUBLED, from 3.9% to 7.6%.

That's all you need to know regarding angry white man BS about the relationship between taxes and economic growth

Nonsense--he won his reputation for not pampering run-of-the-mill criminals in his jails (hence the un-air-conditioned tents when crime skyrocketed due to the border drug trade) and only later his refusal to stand by and ignore crimes by illegal immigrants made headlines. Racial profiling? What "race" exactly? His opponents are open borders advocates and they're not complaining about his treatment of Caucasians, Asians, or African-Americans. They're complaining that he won't turn a blind eye to iillegal immigration. I think they mean "Latino" profiling. Given that the majority of the population is Latino, I'm not sure how they'd prove Latino profiling.

So what IS the story about corruption in the courthouse construction project? I couldn't find much in the way of facts in this story; instead we hear of the DoJ's investigation of Arpaio. SO the public could probably use some FACTS about the corruption allegations rather than a review of Arpaio's controversial history. And the sheriff does not indict; he had to persuade a prosecuting attorney to bring charges, so again the focus on the sheriff, while leading to more colorful reporting, is inappropriate. Finally:

"The merit of the charges, though, are lost on a public who is becoming increasingly cynical . . ."
That should be "The merits of the charges are lost" or "The merit of the charges is lost" and "a public THAT is becoming" or "a public who are becoming" rather than "a public who is becoming."

Of charges being brought by this duo, hundreds are thrown out and hundreds of others are being dropped? Sounds suspiciously like a serious attempt to silence political opponents in any way necessary. And to read that judges have to file cease and desist orders against Arpaio and Thomas concerning search warrants of their own homes speaks once again as attempts to silence political opponents of Arpaio and Thomas. What we have here, ladies and gentlemen, is a case of two fanatics persecuting everyone who doesn't agree with their view of the world.

The last person I can remember this ready to smear and attempt to intimidate political opponents? Nixon was a piker compared to Joe McCarthy. Arpaio and Thomas are of the same ilk as Tailgunner Joe!

Thomas loves to imply "indirect benefit". I was a jury foreman for a trial against a Mexican National who was arrested for having a fake Mexican driver's license. Instead of being charged for being in possession of a fake id, he was charged with forgery. The only problem is, part of the law states that you had to have used the forged document to gain material benefit (per the handout the judge gave to us). So one of Thomas' newbie prosecutors kept implying that he could have used the license to get work (we had hiring managers on the jury who very clearly disputed that "fact"), or could have used it to purchase something (kind of think you need money or a credit card for that, and they had no other forged documents).

Our job was to convict based on facts. The only fact that could be provided was that the man had a fake Mexican id. They knew the forger -- another Mexican National who lives in Mexico -- and of course, couldn't touch him since he was in Mexico. And the forger happened to be the man's uncle. My guess is that they couldn't get the uncle and so tried to get him. We could not, in good conscience, convict a man of the crime.
