Putting the Blinders On

Like many Americans, I watched the press conferences about the Zimmerman arrest with great interest. I was at the gym at my Tribeca apartment building when the news came on, and everyone looked up to the televisions to follow what was going on. They listened to the prosecutor give her explanation succinctly and professionally.

Then Al Sharpton came on.

Now, Sharpton certainly deserves credit for this arrest. It would not have happened without him, leaders like him, and the average citizens who could not bear the enormity of the injustice. Finally, marching did something besides messing up people's shoes. I love Al but he is polarizing. One man at the gym rolled his eyes before one sentence was out of Sharpton's mouth. Many people perceive Sharpton the same way that I perceive, say, Bill O'Reilly. Whenever I hear O'Reilly, I assume that what he is presenting as "fact" is heavily skewed propaganda. Even when I agree with him -- and though it's rare, it does happen -- I am simply not receptive to the messenger.

To his further great credit, Sharpton was aware of how he's perceived and spoke accordingly. He went out of his way to praise Rick Scott, Florida's Tea Party Republican governor. He admitted that he did not trust Scott, and was proven wrong. In calm, level tones, Shaprton admonished those watching him that this was not a time to celebrate. Then he did the exact right thing: he stepped away from the mike.

When the family's attorney Benjamin Crump came on the television, I could barely believe how long he went on. I watched the people in the gym, and I saw the looks on their faces. It was a look I knew well. In my stand-up career, I've experienced what it's like to lose the audience by running my mouth for too long -- and those were people who had paid to see me. One by one, the people at the gym tuned the press conference out.

Finally, Trayvon Martin's mother Sybrina Fulton spoke. This was the way to appeal to people's humanity and their sense of right and wrong. Nothing is as American as a mother -- and nothing is as human. That was when the press conference should have ended.

But it did not.

The Zimmerman trial won't be held in Harlem or Baltimore. It will not be held in the court of public opinion, either. It will be held in Sanford, which is 57 percent white. It will be held in Florida, which is Southern. People tend not to think of Florida as a "Southern" state because they don't speak with an accent there. But it was the third state to secede, months before Arkansas and Kentucky. It was also the very state where Casey Anthony got acquitted of murdering her own child.

Look what's at stake in this case. This country is divided by race at a time when so much is on the line. No one could be more pleased than I that George Zimmerman has been arrested--but I am also aware of the optics of the situation. Even if Lady Justice is blind, every so often she does take a peek. If the case is perceived as "us versus them," every human being always chooses "us." OJ walked when it became "us versus them." If it becomes "us versus them," the prosecution doesn't have the numbers. If a color blind society is the goal, then people must become blind to color.

There are already those who believe Zimmerman was only charged due to political pressure. Many are waiting to exploit racial fears for political purposes. It's already begun. Those who believe Zimmerman's side could have defended him while expressing sorrow that a kid died needlessly, under tragic circumstances. But instead they are dragging this poor boy's body through the mud. It's not enough that he's dead. They are making sure that he's denigrated, too, lest he become a symbol.

If this trial bears any resemblance to a rally, I fear that the jury will lose a great deal of sympathy. Everyone relates to parents mourning the loss of their child. The only way to win this trial is to make it about people and families, not about civil rights and politics. I can guarantee that there will be people of all ideological stripes on that jury, and they will need to persuaded just as much as everyone else. How? By calling to their decency and humanity, as opposed to whatever their voting biases may be. People generally want to do the ethical thing, but they have to be listening to what you're saying first. But if it becomes a "black thing," they simply grow disinterested. A disinterested jury will not send a man to jail. If one, just one, juror sees a bunch of upset black people and thinks "there goes the neighborhood," this case is lost.

And frankly, that's something I don't want to think about.

I think what's going to really hurt this trial is percieved common sense vs the law. There's no way to deny that had Zimmerman not gone looking for him he would not be dead, that's just the facts. However, getting out of his car and going looking for him didn't violate any laws. Trayvon Martin may very well have attacked him but in the same way Zimmerman is hiding behind stand your ground, isn't that exactly what Martin was doing when he felt threatened by a man following him? But in doing so he may have created a situation where Zimmerman legitimately felt his life was in danger and shot him which would fall in line with stand your ground. On the other hand Zimmerman created the entire episode when he went looking for him... but that's not illegal. Either way Martin should not be dead and this entire thing is a tragedy that cannot be reversed. But the threats of no justice no peace aren't going to turn out the way people think if they're acted on

I am relieved that people in Central Florida really want normal neighbors who take walks with their dogs, and not armed loose cannons who stalk the neighborhood kids

Some have suggested this trial could incite a race riot. Others say this will be the defining moment of the 2012 campaign. I say this will be a murder or manslaughter trial like any other where race is a factor. No matter the outcome no one will agree with how it all went down. Justice will have still been denied to one side even if justice was done.

First of all, 57 percent Non-black does not equate white. Florida is a melting pot of Jamaicans, Hatians, Cubans, Puerto Ricans, Peruvians, Persians, Saudis, Seminole Indians, etc....I am angry. I am half Cherokee, half Scottish. And I have the upmost respect for Al Sharpton, because he has helped one of my Scottish family members. The NAACP does not only serve the African American community, it serves all who have had their civil rights violated. All of the above. I resent the racial profiling in your article. It is predjudice, and I am against that. Predjudice = Zimmerman and his actions. Trayvon did not die in vain, please tell me that in your article. Trayvon died to open the eyes of those who were raised to believe that some are better than other based on skin color. Simply untrue.

Neither man should have been characterized as more or less than they were or are. It's not relevant. Two guys who crossed paths and misunderstood the intentions/actions of one another and an encounter ended in tragedy.

The trial probably won't occur until next year, which will,hopefully, lower emotions all around.

What I absolutely agree with in Mr Hughley's statement is: nothing IS more human than motherhood. 99% of people anywhere ought to understand that and......... by extension, fatherhood. All other issues aside, let the parents have time and space to grieve.

The "two guys who crossed paths" was not exactly by fate, actually one hunted the other " a child" and comitted murder despite a voice from 911 telling him to rethink his position

You are misinterpreting the 911 dispatch statement. He wasn't told to rethink anything.
Legally 17 is an age of transition and many young people are on their own acting as adults.
I do not accept that you can call trying to keep sight of a person you believe to be a possible burglar for such a short span of time as "hunting." I think that is an emotional exaggeration of the circumstance.

I see little of that. I tend to see it as a tragic set of circumstances. My opinion changed based on what facts are presently available. My opinion may change again if future revelations warrant. Everyone should make an effort to look at the totality of information and not let personal emotions cloud their judgment!

Many people looked at his family , his mother and still came up with every excuse why this was Trayvon's fault. They tried to suggest he was a problem child suspended for marijuana. They tried to suggest he attack Zimmerman and broke his nose. They tried to suggest he brought this all on himself by wearing a hoodie. Looking at his family and their pictures (vacations that many can't afford/ riding horses/ sking ) one with sense knows this is not a child void of a good home but they still consider him asking for trouble by wearing a hoodie (Geraldo). All it is suggesting is that Trayvon some how brought this upon himself.

It seems possible to look only at the evidence of transcripts of the 911 calls, witness statements, crime scene photos, EMT reports, cell phone timelines, police and witness photos and come up with reasonable doubt as to Zimmerman's guilt. The suspension, family pictures, family, mother etc have nothing to do with the actual evidence of the case. It is alarming the way the incident was misreported and presented in the national media without all of the facts and played as a racial incident. Perhaps there is more evidence which we are not yet aware but right now it seems the original prosecutor made the correct call.

The media thrives on stories that can be racially sensationalized to boost ratings and sales. The Zimmerman/Martin story has been presented in the media as a young innocent child pursued and murdered by a ā€œwhiteā€ (Hispanic) racist profiler followed by racist police inaction. Much of the original national coverage was false and misleading. It has been seized upon by people like Sharpton who uses this opportunity to seek the limelight with little care or regard for truth and justice. Many of the known facts were initially omitted and the tragic events were spun in a manner to inflame emotions. The current available evidence certainly raises strong reasonable doubt on any charge let alone second degree murder. His arrest seems a cave in to public pressure as well as grandstanding by the special prosecutor, all of it fueled by media misinformation. It is even possible, due to the very rapid organized protests which sprang up simultaneously nationwide, well after the shooting, that it was orchestrated, perhaps to provoke racial division or even arouse waning black support for Obama. Regrettably, some in the black community may become violent when Zimmerman is eventually acquitted, on strong reasonable doubt, which is the logical foreseeable conclusion based on the original prosecutors analysis (which is why Zimmerman was never charged). This makes the idea of a conspiracy even more chilling. Read the entire 911 transcript, witness statements, medical and police reports before judging!

As for what the media thrives on they give the people what they want if you are in objection o that you cannot speak for the people the people speak for themselves.
And there is nothing new about keeping sale and ratings up that all in the game…but as for sensationalizing the stories.
This was not necessary the particular story that has you hopping right now is carnage GZs admitted to committing on an unarmed AfrAm child.
Yes at 17 years old he was mere child as for innocent yes he was, for any time that you are minding your own business, do not provoke anyone to assault you and retreat from an assault you are innocent.
He wasn’t threatening anyone, burglarizing homes, are breaking into cars, but walking to his father’s girlfriend’ s and he did run away from the confrontation. What is he to have done to have avoided this incident?
He did all he could do to avoid the incident and is still being labeled as the cause of the problem.
You whine about the fact that GZ was presented by the news media as a white/Hispanic, a racist profiler and the crime was followed by police inaction .
What is striking is that all of this is true and cannot be disputed yet you are upset with the fact that this wanton killing was brought to the light.

The problem for me is that the public did not have the evidence which the original prosecutor had. The media ran with what now appears misleading and inaccurate information which has resulted in a national outcry…but based on misrepresenting the actual events! Current available evidence has become available which suggest Zimmerman should not be convicted using the standard of reasonable doubt. Perhaps other evidence will be produced which will change the situation but I have yet to be aware of anything. Prosecutors do not want to put someone on trial unless the evidence actually calls for it. One of Reverand Sharptons main points was that Zimmerman was not injured. This has been shown to be factually wrong. Furthermore when reading the entire transcript of Zimmerman's 911 call it appears he was no longer following Trayvon and that he had run away in the direction of the back gate. Zimmerman spends much of the call after replying "ok" to the dispatchers saying "we don't want you to do that" (follow him), arranging with the dispatcher to meet the police. Zimmerman was the neighborhood watch coordinator and could reasonably be expected to see if he could observe where Trayvon had gone. Phone records as well as the 911 call times indicate that Trayvon could have gone to the apartment if he had wanted to. I would have expected an unbiased media to investigate and report all of the facts before putting out what seems a misleading story now too big to stop.

Get your damn facts straight. Had Zimmerman not been profiling that day, had he not had a loaded weapon that was against the rules of the property he was on, had he not gotten out of his car like the dispatcher ask him, had the states atty charged Zimmerman that night like the detective wanted to do, had the Sandford Police Dept not disrespected Trayvons Parents, none of this would have happened. I don;t want to hear let the justice system work because had it not been for Trayvons parents not settling for the explanation into their sons' death, there would be no trial. If people are uncomfortable or feel threatened with the emotions this case has brought out, too bad, go see a shink. That goes for DL Hughley too.

I have to say I agree with you. The emphasis has got to be on justice, on proper procedure, on the facts. If we get into making it about bigger issues that are only somewhat related, the case itself goes right down the drain.

And you're right, DL. If it becomes a black vs. white thing, the teams have already been picked, because there's nothing any of us can do about the identity with which we were born.

When we seek justice, we need to remove race from the equation to the fullest extent possible. Ultimately, this is about people, not color.

FINALLY, just what this situation needed to bring clarity, and sensibility, and to sort through the complexities of the social and judicial issues. The opinion of an Actor/Comedian!!!!!! Clearly we learned a lot from how Spike Lee represented the Film Industry in this situation!!!!

at least you got it right! The inflcting of continued desired character for Trayvon and that "thug" classification is despictable. Trayvon Martin, in the eyes of some will continue to be belittled so that his status and the incident involving his death in Sanford Fl, will be the key to knock off iconic or symbolic earnings. But I know the incident holds much more meaning than this. It is a wake-up call for people in this country to understand what is really going on. In Fl and around the region is an attempt to demean people of color even further than the 1800's. There is an agenda to shorten livelyhoods and take down the nations's Afro-American population. How this is known? It is being done everyday, beginning in DC and spilling into the countries states, cities and communities.

I once lived in Fl, not to flame the fire, but to acknowledge the differences of- uncaring to the regards of civil and due process rights for all. The justice system is questionable but until the evidence presents a positive identity pointing to "beyond a reasonable doubt;" this man will probably be aquitted of murdering Trayvon Martin the youth... but the outcome will point to the injustice and unfairness of a small town called "Sanford, Fl"

Yes indeed, it's becoming an epidemic, lawyers are wrapping their arms around big payouts, while groups of defendents are slimmed by the system. Unfairness as I know it happened in Florida now as I live in another state, the amount of system failures are far too many for this country to demonstrate justice for all. We see the gaming and feel the damages applied or not applied. You are right... it's all over the nation..
