My cobloggers on the Volokh Conspiracy -- chiefly Orin Kerr, a law professor at George Washington University law school -- have blogged extensively on the supposed "constitution-in-exile" movement. Anyone interested in the subject (and a post below suggests that some readers might be), and anyone who read Jeffrey Rosen's piece on the subject, should read the thread I link to above for what strikes me as a powerful rebuttal to Rosen's article.
Incidentally, I know and like Rosen, and have found much of his work to be interesting and helpful; but on this item, he seems to have erred.
