Half-Baked in Alaska: Palin's 11th Hour "Troopergate" Exoneration Was a Lie

It was surely an odd bit of timing on Monday, November 3--just hours before one of the biggest presidential elections in American history--that the Alaska State Personnel Board issued a finding by its chief investigator, Timothy J. Petumenos, that Republican vice-presidential candidate and Alaska governor, Sarah Palin, did not breach state ethics laws when she fired Alaska public safety commissioner Walt Monegan in July of this year.

This last minute finding appeared to exonerate Palin of any legal culpability in the so-called "Troopergate" scandal that dogged her throughout her ill-fated, two-month run on the Republican ticket. Palin boldly claimed it a "vindication," while headlines throughout the world declared that she had been "cleared" of any wrongdoing.

That was hardly the case. Composed entirely of political appointees--and all Republican--the Personnel Board was hell-bent on clearing Palin from the get-go. Its findings were neither final nor impartial. And they leave many questions about her behavior, along with that of her husband and her staff, unanswered.

Perhaps the most significant questions that remain are whether or not Governor Palin and her husband, Todd, committed perjury in their sworn affidavits to the personnel board.

There is significant circumstantial evidence that they did.

Less than a month before the Personnel Board's findings, of course, a Republican investigator of the bipartisan Alaska Legislative Council declared that while Palin broke no laws in firing Monegan, she had, in fact, violated the state's Executive Ethics Act by actively pursuing the firing of her former brother-in-law, Alaska state trooper Mike Wooten.

Palin put the lean on Monegan to fire Wooten. He didn't. So he was fired instead.

As Governor, Palin had the executive right to fire Monegan. On that fact, both the Legislative Council and Personnel Board agree.

What they disagree about is whether Palin, her husband, and her staff had the right to hound Monegan about the firing of Wooten. The Personnel Board said that she did have the right; the Legislative Council's reading of the Alaska Ethics Act says she did not.

And hound they did. More than three dozen times in less than two years.

In the aftermath of Monegan's dismissal, Palin gave at least four different reasons for it--all of which seem spurious, at best, and concocted, at worst. And there is strong evidence contradicting every one of her four explanations.

But even more troubling is the absolutely obsessive pattern of strong-arming Monegan about Wooten that began immediately once Palin took office. Within two months of her December 2006 inauguration, Palin and her husband, Todd, contacted Monegan a half-dozen times about firing Wooten. Then Palin's staff members began the assault. Then more contacts from the Palins. Then more from staff.

The pressure was unrelenting and continued right up until the time that Monegan was fired. The record on that--emails, notes, even taped phone conversations--is quite clear.

Perhaps the most troubling piece of evidence is a February 7, 2007, email from Gov. Palin to Monegan. It's a long, rambling missive that concludes with a return to her obsession with Wooten: "Just my opinion -- I know you know I've experienced a lot of frustration with this issue. I know Todd's even expressed to you a lot of concern about our family's safety after this trooper threatened to kill a family member..."

Both Palin and her husband swore under oath that they did not have conversations with Monegan a month earlier (in January 2007) about the Wooten matter. Yet the February 2007 email proves concretely that Palin was aware that her husband had conveyed concerns to Monegan and, by implication ("I know you know") that she had as well. It also clearly establishes the pattern of her trying to use her influence to get Wooten fired from her earliest days in office.

Palin further contradicted her own testimony by saying that her husband complained to her so frequently about the handling of the Wooten matter that she had to tell him to stop, and then shortly thereafter contended that she knew nothing about his activities to get Wooten fired.

Implausible? Absolutely. Perjury? That remains for a legal body to decide.

But will one?

I contacted Monegan's talented attorney in Anchorage, Jeffrey Feldman, of Feldman, Orlansky & Sanders, to ask him about the state of the case and what were the next legal steps in this matter.

"No one knows the answer to that question," he declared. Since the Personnel Board made a finding of "no probable cause" and denied Monegan's request for a hearing, there "is nothing currently pending before the Personnel Board."

Feldman indicated that Monegan's legal options are also limited. He "could file an action in court either challenging his dismissal, asserting defamation claims, or seeking a due process name-clearing hearing," but as of now that's uncertain.

That leaves the Alaska Legislature. When it goes back into session in January, there are a variety of options it could pursue. Although there's a bipartisan majority caucus in the state Senate, Feldman said, it's uncertain whether Senate President-designate, Republican Gary Stevens (not related to the convicted U.S. Senator), will follow up on any matter dealing with Troopergate.

That, to me, would seem to be a dereliction of the Legislature's duty. The Alaska Legislature has the right--and I believe the obligation--to follow-up on the findings of its own investigation and to censure Governor Palin for what was a clear pattern of abusing her power.

Moreover, the Legislature also has the power to seek contempt charges against Palin and other state officials who willingly ignored the Legislative Council's subpoenas during its investigation of Troopergate. And it also has the power to hold hearings on whether or not Palin and her husband committed perjury. There's troubling evidence that they did.

Come January, someone needs to show Alaska's first family that they are not above the law.

I always thought that there was something screwy about that 11th hour announcement. Now that the senate race has been decided. She needs to fade into the Alaskan canvass and study the Couric interview to see how poorly she truly handled it. ( She still thinks she did a great job!)

I think it is time to have a look at the appointees, the evidence, the reasoning and the timing behind their decision.
Based on the same evidence, an arguably more impartial group came to an entirely different decision.
Did the personel board do the work they swore to do?
Hmmm, looks like not so much.

After becoming informed of a $7million dollar book payment to Palin for the right to a book, By all means lets take a page out of Palins game book and not necessarily burn the book, because someone needs Toilet Paper in this world, but lets call for everyone to boycott the sale of this tarnish of American political worst.

For a politician to come out as a "court jester" in her lack of knowledge of the political arena, let alone basics posessed by most high school graduates. This country is above of rewarding people for lieing, cheating, bullying, noy to include of being at the bottom of the list of most educated within this country. If there were a "Will Rodgers" alive today and commented on Palin, this woman could never stick her head out of the door without being laughed at. Maybe thiis would be a good nest for a bright young comedian to roost, taking down to earth well meant heartfull free shots at the best and in this case the worst of the politicians within our country. But to again follow the guide to books narrated by Palin, lets simply ban the Palin book!!!!!!! As to the publisher how would he title this book, Maybe "Queen Of Liars Who Fails The People"

Palin got $7M for her advance and Obama only got $4M? I thought women only made half as much as men? Something ain't right here - - -

Religious wannabes are just that. They live a superficial religious existence with their God and think they hold the last word in their actions. The Palins will be in for surprise come judgment day unless they actually submit to their God. I'm being serious. Her Jesus had to be crying everytime she took the stage in her rallies. And even now in her interviews where she still stands behind her unfounded and already disproved attacks of pure hate and lies. Compare her to the Obamas. They emulate Jesus a thousand times more than she does with their history of community service, sacrifice and just plain humbleness. Sarah could learn a lot from her new President and our new First Lady.

The only thing Palin is qualified for is being a news reporter on Fox news!!!!!

Knowing about stuff like this does very little for the health of my stress levels. I mean thank God for people who remain dogged in their investigations, and thank you to Mr. Dunn, but unless I can be assured the right thing will be done all I feel is pissed off. This kind of shady crap happens all the time and frankly I'm sick of it! Who's gonna fix this already?
10:17 PM on 11/18/2008
The problem is Palin was successfully shielded by the GOP to keep the public unaware of the truth and the truth about her has to be brought out into the open just in case she does enter into the 2012 race.

The above is just for the protection of the people as we already know there are 40% of the voters too uninformed to make a rational decision on their own behalf so the rest of the country needs to know everything about the candidates regardless of what party they belong to.

Alaska's first family is not above the law and the BIBLE! Look in the commandments and repeat, Thou Shalt NOT LIE! Your words are terribly incongruent with your behavior and conservatives, evangelicals, and Christians alike are squirming at your behavior which is an absolute mockery of your faith! But alas, even the faithful - you Sarah can be forgiven, IF and only IF you can bring yourself and Todd to confess your sins and ask forgiveness... than tell the TRUTH to the public, and ask for forgiveness from Officer Monegan. How does this terrible story play with your character in question to the people of the lower 48? Was it worth a shot at the veep run? Would you step over anybody or anyone to advance your career at the expense of an outstanding enforcement officer in your community. Great, suppress the leaders in your cabinet to take advantage of "political opportunity!" Avoiding this now will cloud your future trust with your immediate governing leadership and potentially put you on the trophy wall of a local bar as another one to bite the dust in a long line of corrupt officials from Alaska. Not a pretty picture or lasting legacy! Your choice, live in a perpetual lie, or be free with forgiveness??? Remember you will be judged by your God right!!

We're only now starting to leave the Palin Zone- whew. What a strange and unpleasant place. A place where Sarah makes up the rules, where clothes disappear, where nothing makes any sense whatsoever- EEEK!
I hope Alaska is less drooley for her soon and sends her back to Wasilla to remodel her mayor's office lavishly with her $7 million book deal money. But Sarah will be back I fear. She secretly wants to be a Washington insider, you betcha.

Even after bipartisan Alaska Legislative Council declared that while Palin broke no laws in firing Monegan, she had, in fact, violated the state's Executive Ethics Act , she was calling it a vindication and saying it exonerated her. I have never seen anyone like her before -- time and time again she would look hard evidence in the eye and say the exact opposite! I hope the lower 48 never has to deal with her again!

She is amazing. Unfortunately not in a good way. I'd have to say though that she probably learned from the best at "looking hard evidence in the eye and saying the exact opposite" for eight years; our soon to be former President, George Bush.
10:19 PM on 11/18/2008
Well apparently she inherits her lying ways rightfully. Look at Ted Stevens. At the debate two days prior to the election, he told the people point blank that he had not been convicted of anything even though he had just been convicted on 7 felony counts a couple of days before that.

It must be something in that Alaskan drinking water that makes them lie through their teeth with a straight face.

There has been no punitive action against the Bush administration, or
against the people who stole money from the Social Security fund, or
from us to cover up bad judgements in business. So why hold
Governor Palin accountable in January?
How many people from the Senate and Congress and other branches of
our government have been through an investigation, or are about to be,
and how many have actually done jail time?
It seems to me that being elected to office also gives some measure of
immunity. Why should it be different for the Governor?
