Darkness at Noon: Georgia Dumps Peaches for Prisons With Immigration Law Today

Will the Peach State now become the Prison State?

When Gov. Nathan Deal signed his state's punitive HB 87 immigration law at noon today, Georgia took Arizona's place on the nation's fast track to penal profiteering from immigration crackdowns.

So much for colonial Georgia founder James Oglethorpe's legacy, who railed against the British prisons, and launched the Great Seal of Georgia in 1733 with the motto: "Not for ourselves, but for others."

Georgia's new motto: "Not less than three nor more than 15 years."

All civil rights violations aside, Georgia's Arizona copycat "show me your papers" law not only grants widely denounced authority for unprecedented police investigations, but also calls for unabashed long-term prison sentences for numerous violations.

For starters, read this section of HB 87:

SECTION 5. Said article of said title is further amended by revising Code Section 16-9-126, relating to penalties for violations, as follows: "16-9-126.


(a) A violation of this article, other than a violation of Code Section 16-9-121.1 or 16-9-122, shall be punishable by imprisonment for not less than one nor more than ten years or a fine not to exceed $100,000.00, or both. Any person who commits such a violation for the second or any subsequent offense shall be punished by imprisonment for not less than three nor more than 15 years, a fine not to exceed $250,000.00, or both.

(a.1) A violation of Code Section 16-9-121.1 shall be punishable by imprisonment for not less than one nor more than 15 years, a fine not to exceed $250,000.00, or both, and such sentence shall run consecutively to any other sentence which the person has received.

(b) A violation of this article which does not involve the intent to commit theft or appropriation of any property, resource, or other thing of value that is committed by a person who is less than 21 years of age shall be punishable by imprisonment for not less than one nor more than three years or a fine not to exceed $5,000.00, or both.


So, who is behind this kind of penal profiteering approach to immigration?

The national Cuéntame organization recently posted this video, "Immigrants For Sale," to explain the link between Arizona and Georgia-style immigration laws and the prison lobby:


To be sure, not all Georgians agree. The business and religious communities, as well as civil rights hero Rep. John Lewis, have joined President Obama's own call that the Georgia law wrongfully usurps federal jurisdiction. Arizona's own controversial SB 1070 law has already been struck down twice in federal courts.

Other critics point to the importance of immigrants, legal and undocumented, in Georgia's faltering economy. According to the Immigration Policy Center:

Immigrants are integral to Georgia's economy as workers.


Immigrants comprised 12.6% of the state's workforce in 2008 (or 626,836 workers), according to the U.S. Census Bureau.

Unauthorized immigrants comprised 6.3% of the state's workforce (or 325,000 workers) in 2008, according to a report by the Pew Hispanic Center.

If all unauthorized immigrants were removed from Georgia, the state would lose $21.3 billion in economic activity, $9.5 billion in gross state product, and approximately 132,460 jobs, even accounting for adequate market adjustment time, according to a report by the Perryman Group.

Unauthorized immigrants contribute to the state's economy.

Unauthorized immigrants in Georgia contributed between $215.6 million and $252.5 million in aggregated sales, income, and property tax, according to a 2006 study by the Georgia Budget and Policy Institute.

The average unauthorized family in Georgia contributed between $2,340 and $2,470 in state and local sales, income, and property tax, according to the same study. An unauthorized family that does not pay income taxes would have a sales and property tax contribution of $1,800 to $1,860.

I hope Hispanics are paying attention. They will never see such a bill from a Democratic governor. Even if Obama cannot get immigration reform, at least Hispanics know that Dems are not against them.

You're right! Right after Arizona passed its law and they started moving out of the state, the cost of education and social benefits decreased! Illegal immigrants come here not just for the jobs, but for the FREE education and FREE healthcare benefits! In the meantime, our elderly and mental illness population get nothing!!!! Shame on those in our government who choose the illegal immigrants over our own legal Americans! Its disgusting!

Too bad the loss in convention and tourism dollars dwarfed the savings and too bad the state legislature didn't take into account all these "savings" as they slashed education in our state and too bad the revenue generated by illegal workers who paid state and federal taxes flew the coop. But you have your principles, I guess, if not the right facts.

They should not only deport them but also investigate for the rest of their relatives and deport the whole group. This would be much more effective and efficient!

sounds great lets say it only costs 25,000 per immigrant (estimated 12 million in the country) to get that process in place... you willing to cut medicare for THAT expense???

We have an illegal immigration problem not from a lack of laws, hence the illegal part, but because of a lack of enforcement. Without enforcement what point do the laws serve? Illegal immigrants are already a big percentage of the prison population. It kind of puts a dent into the whole, their just hard workers, narrative. An open border provides you will all types. While I have sympathy to those who are just looking for a better life we aren't really doing them a service by letting them be here illegally. We aren't doing Mexico a service either. How much money do the cartels in Mexico make by funneling contraband and other things across the border?

in san francisco, a "sanctuary city" an ILLEGAL ALIEN "youth" was in the system, as a felon, but the city protected him from the immigration authorities. the "youth" then shot a father and his 2 sons, killing all 3. this is our future, get used to it. if you don't think so just look at mexico, we will become them, they will not become us!

"The Chronicle reported that Ramos was convicted of two gang-related felonies while a juvenile and remained in San Francisco because the Juvenile Probation Department did not alert federal authorities. San Francisco's 1989 "City of Refuge" ordinance prohibits city agencies from contacting the feds on immigration matters.
The newspaper also found that federal officials knew about Ramos' immigration status in March when he was arrested on a gun charge, though they couldn't tell the Chronicle why they didn't put an immigration hold on Ramos."

were the lives of 3 innocent american citizens worth sacrificing in order to protect ILLEGAL ALIENS?

What you fail to mention is if they left to go back to their own country they would not have to worry about jail. I sure hope Texas passes a law like this soon.

It's not likely illegal immigrants will have any money to pay fines.

Prisons are overcrowded with violent convicts.

Maybe they get to do their time on house arrest like Lindsay Lohan.

That video was obviously made by illegal alien criminal sympathizers. It doesn't accurately describe who is being locked up. They are not immigrants they are illegal aliens and/or criminals that are being locked up. This law as well as the law in Arizona are almost word for word the same as federal law. Arizona's law was only partially held back by a Circuit Court and the Governor is taking it to the Supreme Court. This is a good deal for the law-abiding citizens of Georgia. I would like to see these type of laws enacted in all the states. As long as the federal government is not doing their job the states have every right to lock up these criminals.

Clearly you didn't read the economic figures--it's a terrible deal for the law-abiding citizens of Georgia. And, once you factor in the inevitable business boycotts, it will be even worse.

My family has been in this state for more than 200 years, but I have to get out--it just keeps going backwards.
