'Madness' Surrounding Michigan State Basketball

It's March Madness time. So, in honor of all things mad, let's take a look at one of the top teams entering the tourney and the madness that surrounds an alleged rape a year and a half ago. Top media outlets knew about this significant event and refused to report, except for an independent online news site called the Michigan Messenger.

According to police reports, over August 29 and August 30, 2010, a young woman attended an orientation at Michigan State University's Wonders Hall. Later that evening, she noticed two men from orientation. They had a conversation and she agreed to go to their dorm room.

The three were playing mini-basketball when the alleged victim missed a basket. They told her to take off an article of clothing and she complied because she had a tank top on under her shirt.

The players were then purposely missing baskets and they stripped until they were completely naked. One of the men blocked the doorway while the other cornered the alleged victim.

Then the room went completely dark.

The alleged victim reports she was raped repeatedly in various positions. She asked them to stop and said she didn't want it.

The alleged victim said they pinned her hands down but she managed to hit one of the players in the face (in self-defense). The player allegedly continued to rape her.

According to reports, one of the players bragged about it to a roommate.

The MSU police interviewed one of the players who corroborated the victim's statement. The player said he stopped because "it was clear she didn't want it" and understood how the victim believed she couldn't leave the room.

But the other player continued, even when he reported the alleged victim was "timid" and "not aggressive."

It's obvious from both player and alleged victim statements to the police that the woman did not want sex. She did not want sex, the men allegedly prevented her from leaving, and they chose to intimidate and imprison her.

These high profile basketball players will be in the NCAA Men's Division 1 tournament, wearing Spartan uniforms for #1 seed, Michigan State.

Why? According to local district attorney Stuart A. Dunnings III, there wasn't enough evidence to prosecute. But Michigan State Police recommended the men be charged with Criminal Sexual Conduct 1, Michigan's most serious level of sexual assault.

Despite the evidence, prosecutors maintained they "could not find any of the necessary elements" to conclude it was force and/or coercion. Dunnings must be keenly aware of the power MSU basketball players have in the community and may see their prosecution as politically risky.

But Michigan State would have to react to such an egregious act, right? They didn't.
On Nov. 18, 2010, MSU Men's Basketball Coach Tom Izzo was given a new contract, including $500,000. His new salary is worth $3.49 million and includes a private plane for 25 hours a year, according to USA Today.

According to emails, the two freshmen basketball players were moved "temporarily and administratively" from Wonders Hall to Spartan Village, or family housing -- which is not allowed under MSU housing guidelines. The National Coalition Against Violent Athletes (NCAVA) sent a Freedom of Information Act (FOIA) request to MSU regarding the move in Dec. 2010.

The NCAVA requested documents that were leaked by employees within the MSU administration. The leaked documents were not included in the FOIA response and the NCAVA was still charged $700, up front.

After appealing directly to MSU President Lou Anna K. Simon, she stated to the NCAVA that the the documents had been "discovered," that some "should not have been redacted," and they would only be released until NCAVA paid another $700. The requested documents were not forwarded by MSU except for change.org petition emails, which seemed obstructive for $1,400.

During this time, outrage spilled over into the student body. Campus protests and sit-ins took place in President Simon's office and "Expel Rapists" banners were paraded through the Jack Breslin Student Events Center during basketball games. An entire organization, Coalition Against Sexual Violence, was formed in response to this event.

Despite the student actions, there was still no coverage in the local media. The Detroit Free Press and the Lansing State Journal remained quiet. Letters to the editor went unpublished. ESPN wouldn't report the story unless the victim granted an interview. This isn't newsworthy without a victim interview?

This incident prompted attorney Wendy Murphy and I to meet with NCAA President Mark Emmert in November 2010 to propose an NCAA policy surrounding athlete violence, mirroring the requirements under Federal Title IX law. The proposal was sent to each member of the NCAA Executive Committee, which includes MSU President Simon.

I specifically broached this particular incident with Emmert as another reason for the NCAA to adopt such a policy. We also provided data showing that athletes disproportionately commit sex crimes on campus, without accountability.

The NCAA denied the request. Yet, I truly believe Emmert is concerned. He is only one man. It's the college presidents who make up the NCAA Executive Committee, like Simon, who own this crisis.

Now, it's March Madness. The biggest money-maker in college sports. And ironically, it features two top basketball players playing for the #1 seed who escaped culpability for an alleged rape. And it's been kept a big secret.

While this story was, and is, of concern to me, this article makes some very great leaps and unfounded statements. The last two sentences in particular are simple libel. All of the evidence here indicates that there is no solid evidence of any rape. The police reports and witness statements do not back up Ms. Redmond's article and, as a former resident of the area, I can assure anyone that (much to the chagrin of many sports fans) Stuart Dunnings has never seemed at all reticent to prosecute athletes. Tom Izzo is also not one to tolerate bad behavior. As evidence, see Chris Allen and Corey Lucious - both star players integral to the team dismissed for much lesser offenses than rape.

While I do not categorically say that there was no rape that night, there is no excuse for this article and its factual errors and clear bias. People in this country (even athletes) are innocent until proven guilty. To say, in effect, that two members of the team are rapists who got away with it is simply wrong - both morally and journalistically. Worse, irresponsible reporting like this makes it easier for rapists to avoid punishment in the future. When news media rush to judgement and show clear bias in what seems to be a murky case of he said/she said, people will be that much more likely to dismiss future reporting of similar events as untrustworthy.

Hardly. This is something that was looked at heavily by the local authorites and was dismissed when none of the plaintiffs testamony checked out. Though it's foolish to be blinded by loyality to the point of excusing crime, so too is it foolish to believe the worst without evidence.

Statement from Ingham County Prosecutor Stuart Dunnings III

As Prosecutor, I have prosecuted numerous prominent persons – including police officers, attorneys and athletes. In each instance, I believe that our office has handled the case regardless of status, and shown neither favor nor prejudice to any person.

I declined to prosecute a recent incident that occurred on the MSU campus. I would like to explain the reasoning behind this decision.

The Assistant Prosecutor (Debra Bouck) who initially screened this case met with the woman who reported the incident. At this point, the case was still under review. Ms. Bouck explained the legal process. As is the standard practice of this office, Ms. Bouck also questioned the Complainant regarding specific details of the incident, which were not covered in the police interview. This was done so that the young woman would understand the types of questions that she would be called to answer should the matter go to court, and also because we need to know the answers to those questions in evaluating the case.

Following that further investigation, Ms. Bouck called her to indicate that no charges would be filed. Ms. Bouck then reviewed the case with Chief Assistant Prosecutor Lisa McCormick, who agreed with the decision.

There have been numerous reports that indicate that one of the two men "corroborated" the story told by the woman. However, the prosecutors who reviewed this case examined not only the police report, but also the actual interview of one of the men. I have attached transcripts of the police interview with one of the accused men. You can see from the transcript of the interview with the man that he did not, in fact, corroborate the facts necessary to substantiate a criminal sexual assault charge.

Based on our review of all of the materials, including the police report, actual interviews, and the specific details that were elicited directly from the Complainant, our office reached the conclusion that no crime had been committed. We therefore made the decision to decline to bring charges against the two young men.

Did anyone notice there are only one or two stories about Jerry Sandusky from back when he was allegedly molesting boys? It is only after the federal attorneys brought charges that all the information came to light and people questioned why the local AD sat on it.

And, I believe the local AD at State College made some similar comments about not having enough evidence and/or believing the victims.

She should at least have her day in court and if the MSU players are innocent, they can prove it.

Sad stuff, but not, unfortunately, not surprising.

actually...there was a lot of information reported and shared. This is nothing like Jerry Sandusky. The woman who wrote this article included links to the actual documents. She has severely misrepresented the facts...probably blinded by her bias.

As a Michigan fan, I have no love for the Spartans or any of their athletic teams. That said, I have always had a vast amount of respect for Tom Izzo and the program he has run there. I don't for a second believe that what is presented in this article is the entire story. The media in Michigan would have practically wet themselves to get this in the papers. To insinuate that a huge coverup occurred is laughable to anyone who lives in Michigan and/or has experience with the media there. Also, if the incident did occur and the police felt that there was in fact, no rape, there would be no reason for the players to be kicked off of the team. The "victim's" credibility is sketchy at best and I don't believe this case was handled improperly by anyone involved. Just my two cents.

One of the two players said that the victim said no, but that his fellow player continued to rape the victim. This would have been prosecuted if the perps weren't MSU players who were projected to contribute to a team lacking depth. As for who did it, do the research. It's a "pain in the apple," but you can figure out which two starters were involved.

After following all the links in Ms. Redmond's story and reading the police report and other information, I am shocked that Huffington Post which is a new organization allowed this article to be posted...even as a blog. The article could have been written in such a way to be more supportive of Ms. Redmond's cause. I support her cause wholeheartedly because I believe many athletes are brought up in a bubble that leads them to believe that everyone "wants" and adulates them or that they can get away with anything. However, I believe when lies and misrepresentations are used to support a worthy cause, the cause itself is diminished horribly. This article should have been vetted.

I followed all the links the author provided. She inaccurately reports the facts of the case including that one of the involved athletes "corroborated" the story.

Also, I can think of at least 5 Michigan State Basketball players that were on the team in August of 2010 are no longer with the team. One was dismissed without an explanation. To state that the offending players are still on the team may not be true. I could not find their identities in my research. I understand that the author has a bias on the side of the victim based upon her leading of the organization against athlete violence. Her attack on Izzo makes it appear as if she thought Izzo should have been fired who had nothing to do with the attack or any coverup. No Cover up is alleged. This is just a horrible situation. While the woman should not be blamed for any crime committed against her, I keep telling my daughter to not put herself in dangerous situations. I tell her never to go to a man's room and never disrobe in front of him. If he starts to disrobe, make it clear you are not interested. If he won't let you leave and you are in a public place (dorm), scream.

This is the case in East Lansing as well. If the author had done her homework, she would have learned that Stuart Dunnings III is known as a tough, impartial prosecutor who has never shied away from prosecuting MSU players in the past.

Further, as others have pointed out, Tom Izzo has too much integrity to look the other way if he felt that the charges had any merit.

The prosecuter was in political trouble due to wrongly convicting a man of murder. He is a UM grad without the political capital to prosecute the high profile accused MSU athletes. The alleged victim, Appling, and the police have the same story. The only person who sides with Payne is the career politician in hot water. My view from East Lansing.

Some things to note..Katherine Redmond was very vocal through the entire Duke Lacrosse case and she was noted as one of the biggest villains of that entire case.

Second, she sited a dodgy website that hasn't posted a news story since 11.15.11. It is far from a credible news source and if you go through the site they have a clear fringe left agenda.

Third, the local prosecutor saw that there was no need for an investigation and the victim understood why and accepted this. Go to mblog for this story.

Looks like personal bias has gotten in the way of reporting the truth for Katherine Redmond. I have no respect for her, she's clearly just out to promote her organizations agenda.
