Undercover at an Arizona Gun Show

Posted: 01/31/11 12:47 PM ET

How difficult is it for criminals, the mentally ill, and drug abusers to buy guns in Arizona?

We sent undercover investigators with hidden cameras to find out, and the answer is: not difficult at all. Just 15 days after the horrible tragedy in Tucson, our investigators found that people who may be prohibited by federal law from purchasing guns can nevertheless buy them as easily as a hamburger with fries at the local McDonald's.

The investigators visited a Phoenix gun show as a follow-up to a 2009 undercover investigation we conducted at gun shows across Ohio, Tennessee, and Nevada. In that investigation, we found out just how easy it is for criminals and the mentally ill to walk in and buy guns - no questions asked. It called attention to a huge loophole in the law that enables criminals and other dangerous people like drug abusers and the mentally ill to get guns without having to go through a background check.

Since then, four of the seven gun shows we investigated have decided to require background checks for all gun sales. At the time of the investigation, those four gun shows hosted 198 private sellers who were offering 2,600 firearms for sale in just one weekend. Furthermore, ATF has now investigated one of the unlicensed gun dealers we caught on camera making illegal sales in Nevada, and they seized a stockpile of 800 guns he was keeping at his house in Mesa, Arizona.

It's great news that four of the seven gun shows from the initial investigation have decided to change their practices. But the reality is that the practice of selling to prohibited purchasers is widespread, as we saw again at a gun show in Arizona.

Our investigators went to the Crossroads of the West gun show in Phoenix. You can watch the undercover videos and ask Congress to close the loopholes in our gun background check system at gunshowundercover.org.

The investigation sought to answer two simple questions:

First, how easy is it to buy a gun without a background check?

It's easy. At the gun show, an investigator bought - with no background check - a Glock 19 with an extended magazine, similar to the gun Jared Loughner allegedly used to kill six and wound 13 others, including Rep. Gabrielle Giffords. Unfortunately, under current federal laws, that sale was legal.

The second question we ask was would private sellers sell guns to people who said they probably couldn't pass a background check?

Again, the answer was yes. An investigator bought two handguns from two different private sellers, even after they said they probably couldn't pass a background check.

This fits the pattern of illegal activity at gun shows that we uncovered in 2009 - and it's all the more frustrating that it's happening just a little more than a hundred miles away from Tucson.

In 2009, 19 out of 30 private sellers made the sale in spite of the law, which says even private sellers are prohibited from selling to anyone they have reason to suspect could not pass a background check. This time, two private sellers in Arizona did the same thing.

We did these investigations for two reasons: to expose a glaring gap in the nation's gun laws, and to urge Congress to take notice - and take action. Unfortunately, they've done nothing to close this deadly loophole in our background checks.

Last week, our coalition announced a new plan to fix gaps and close loopholes in our nation's gun laws. Visit gunshowundercover.org to watch today's new videos and ask Congress to finally take action.

As I said after our first investigation in 2009, the vast majority of gun buyers at gun shows are law abiding citizens. Requiring background checks on all gun sales will not detract from anyone's Second Amendment rights. What it will do is send the message that we're no longer going to make it easy for criminals to get around the law.

Hey, it's not Arizona that wants "easy" gun laws. It is the whole country, that is why there were no federal laws broken in the making of the video clip. No state requires a private seller to perform a background check or institute a waiting period before selling a gun. It is not just Arizona. There are gun shows in Arkansas, there are gunshows in Mississippi, heck there is a gun show near Columbine, Colorado. So, don't pick on Arizona.

The people of Arizona want these easy gun laws and vote in politicians who support extremely easy access to guns. It is my opinion that the people of Arizona foster an environment where shootouts occur. They got what they voted for. Why they want such easy access to guns or such powerful weapons is incomprehensible.

Going to a gun show is like watching a remake of "One Flew over the Cuckoo’s Next" where all of the inmates have pony tails and are wearing camouflage.

One typo deserves another, NEST not NEXT.
I watched an outdoor gun show in one of the southern states that allowed people to pay to shoot just about anything weapon that had ever been made.

I'm confused. Why would anyone need to own an automatic or semi-automatic weapon?

Ask the police why they switched from revolvers to semi-autos.

The answer is equally applicable to civilians who wish to have a firearm for self defense.

Why would anyone want to live in a country where they feel a need to own a gun to be safe?

Which begs the question, why is the, per capita, murder rate in the US 10 times higher than Canada's and yet higher than in France, England, Germany, Spain to name just a few.

And why is the murder rate in Russia 3 times that in the US?

You could ask that same question without going outside the U.S.:  Why is the murder rate in Maryland nearly ten times the rate in Vermont, Utah, or New Hampshire? Maryland has strict gun laws, so that can't be, right?

PS:  It's not "10 times", not even close.

There are more holsteins than people in Vermont. I hope you can get the N.R.A. to stop blocking research into gun morbidity studies. Smells like big tobacco blocking studies in the past.

I don't understand why so many people are opposed to stricter gun regulations.

We'll never be able to stop the criminals from getting their hands on guns but we can make it more difficult for them to buy them legally. More thorough background checks with a waiting period would help keep guns out of the hands of people who shouldn't have them. People who have nothing to hide shouldn't mind if they have to wait a few days to be checked out.
04:17 PM on 02/06/2011
Really that seems to be the mantra of anyone wanting people to accept something without them thinking about it. So lets see do you have anything to hide, how about cheating on an old BF or maybe a tax break you were not suppose to get or maybe you smoke dope before and your employer might not like that. So you see yep everyone has stuff they do not want people to know so please get over it.
Lets get back to the new guns laws that you want to start. How many people do you think it will save or guns it will keep from the hands of the bad guys. Well guess what the CDC in a massive report said no gun law can be shown to have had any impact on gun crime. So I know I know you feel it will work and that is all that is needed for you but I want some concrete evidence before you infringe anymore. As for Bloomberg the Yard gnome I am waiting for one of these states to try and get him on some charges and arrest him.
Also just a point a retired ATF agent agrees no gun laws were broken in the video.

I have yet to read a proposed "stricter gun regulation" that actually makes sense.  Propose one that makes sense and we'll talk.

I'm not saying that I have all the answers. I just know that something needs to change. I'm not against guns. Maybe just enforce the existing regulations a little better!!

"Yet, any gang banger in NYC, can get a handgun illegally, so the net effect of NYC’s strict permit laws, is to disarm the law abiding, leaving them as victims for the city's predators."

Which, if you research the origins of gun control, makes complete sense. Sullivan's Act was the first gun control measure passed, ironically enough in New York by a State Senator. He was paid off by criminals who made a living from strong armed robbery of civilians. The criminals feared an armed citizen that might defend himself against the attack and decided to buy off State Senator Timothy Sullivan in order for legislation to be passed which would make it a felony to carry a handgun without a permit. The criminals continued their armed robberies, the citizens became defenseless.

The year after the law was passed, gun murders rose 50% in New York. This law has never been repealed.

THANK YOU for bringing this up. Many ill-informed, but "maybe" well intentioned people on the left think that if guns were outlawed everything would be great.
Completely apart from their pie-in-the-sky ideas is the fact that one of the most important things about our founding was that the founders never wanted the people to be defenseless against a tyrannical and overreaching Govt and properly thought to put protections for owning firearms in the founding documents.
04:07 PM on 02/06/2011
We have no idea what outlawing guns at a federal level would do. Examples citing city policies are not applicable since anyone can freely drive from one city to the next, and one state to the next, with no particular worry of search/seizure of illegal firearms.

The fact that this video prompts people to present evidence against gun control is beyond me. Why not common sense control? It's easier to buy a gun with bullets than it is to buy a car and legally drive it.
04:19 PM on 02/06/2011
Please they are not well intentioned they are misguided and dangerous because they would disarm you for nothing more then a good feeling.

Strict gun laws won't work if they are not applied and enforced *universally.* No strict gun law will have a measurable effect if someone can drive to the next state over and get whatever they want.

No strict gun law will work as long as there is a black market and smugglers.

I see many making light of this because it seems it's far better for our society to err on the side of arming everyone, rather than erring on the side of enhanced safety by ensuring stricter regulations. This is not news, but outrageous and very scary nonetheless!

Gun shows are a real trip. Having gone to several I can attest to it being 1) very eye opening; 2) loaded with hicks and 3) not the best place to buy a gun. The real interesting thing was that there was a large percentage (well over half) of hispanic and asian and practically 100% male. I also know that people visiting on business (from Asian countries or Europe) will often make time to attend a gun show because it is so uniquely American. Oh, and if you get caught with a loaded weapon they literally pile on you until your guts pop.

Perhaps the mayor favors a disarmed population so we will be less outraged when he spends more tax-payer money on additional chefs for his entertainment mansion.

There are by several estimates now 290,000,000 guns in America. How many more do we need? So tired of the insanity of the death industries. We know people die by guns. We know Cigarettes kill. We know Drugs kill. We know Polluters kill. Can we move on and kill less? Evolve America.

For all his bluster, all Bloomberg managed to do was to point out the obvious: that no matter how many laws you have on the books there will always be those who choose to ignore the law. This, however, doesn't mean the law is flawed or that we need more laws on top of what we already have. Shoplifting is against the law, yet people still shoplift: does this mean that we need more laws against shoplifting? I think not. We need only enforce the law. Having said that, enforcement of law requires resources: cops, inspectors, prosecutors, courts etc. Since there are not enough law enforcement resources to prevent or punish every crime, one has to allocate those limited resources in a manner that provides the most benefit. Sure, more resources could be put towards stricter enforcement of gun laws, but that means less law enforcement resources available to deal with other crimes. It's a matter of priorities. Is illegal gun purchases such a threat that we're willing to take cops and/or inspectors away from other criminal cases in order to have them hanging out at gun shows? Me--I prefer they spend their time catching murderers, rapist, muggers, and other violent criminals, rather than targeting the average Joe trying to buy a gun. Mayor Bloomberg's time would be better spent policing violent crime in his own city--things have gotten worse since Giuliani.

In 2010 the New York Post reported evidence the NYPD supervisors were under increased pressure to "fudge" crime stats by downgrading major crimes to minor offenses. Crime in New York has surpassed 2009's rates so far this year.

Given that many crimes center around use of a gun, perhaps an ounce of prevention is worth a pound of cure, and that money is best spent preventing unauthorized people from getting guns. More money on enforcement saves money on prosecuting crime.

My greatest laughs is going to the gun shows here in Houston and watching the people walking around in their camouflaged fatigues, their AK-47 assault weapon slung over their shoulders and reading their soldier of fortune magazines. I was thinking that if a military recruiter would set up a booth there he would get all kinds of takers but are those the type you want in our military.???
