As a defense lawyer I hear all the time about "technicalities" that let the guilty walk free. Well, not so I'd notice. Its technical rules that often allow the state to hold onto a conviction that is improper.
To judge from most media coverage, the beaches are open, the fishing restrictions being lifted and the Gulf resorts open for business in a safe environment. We spent the last few weeks along the Gulf coast, and the reality is distinctly different.
The good news is that the cap is holding. The bad news is that, with the well no longer gushing, the oil is out of sight and out of mind and BP is pulling up boom and pulling back workers and the rest of the clean-up apparatus all across the Gulf.
