NEW YORK — Michael Jackson has a chance to win artist of the year posthumously at the American Music Awards.

The pop superstar, who died on June 25, was among a diverse group of artists nominated Tuesday for the top honor. Country star Taylor Swift, rapper Eminem, breakthrough rockers Kings of Leon and flamboyant pop star Lady Gaga were the other nominees.

Swift topped all artists with six nominations. She drew inadvertent attention at the MTV Video Music Awards last month when rapper Kanye West interrupted her acceptance speech to say Beyonce deserved the award instead.

Jackson followed Swift with five nominations and Eminem received four.

Winners are determined by an online vote of fans and will be announced at a Los Angeles ceremony televised by ABC on Nov. 22. The nominees were selected through a measurement combining sales and radio airplay.

LOS ANGELES — An attorney for Roman Polanski's victim says scrutiny caused by the director's arrest is causing her health problems and job worries.

Attorney Lawrence Silver says Samantha Geimer is urging a California appeals court to dismiss the criminal case against the "Chinatown" director.

The filing Friday states Geimer and Silver have received nearly 500 calls seeking comment since Polanski was arrested in Switzerland on Sept. 26.

The statement says Geimer, who lives in Hawaii, is being stalked by journalists.

The filing also states she has suffered unspecified health issues and is fearful the attention will cause her to lose her job.

Victims of Calif. train derailment settle for $30M

LOS ANGELES — A commuter rail agency agreed to pay about $30 million to settle most of the lawsuits from a derailment that killed 11 people and injured another 180 after a driver trying to commit suicide parked his gas-drenched SUV on the tracks, attorneys said Wednesday.

Jerome Ringler, lead attorney for the plaintiffs, said Metrolink agreed to settle nearly 90 percent of the cases, including nine wrongful death claims and 15 serious injury cases.

He declined to characterize the cases still under negotiation because he didn't want to affect the settlements. Both sides are trying to resolve the remaining cases ahead of trial set for Jan. 4, he said.

"Metrolink is working diligently to reach a fair and reasonable resolution of each of the few remaining cases," agency spokesman Francisco Oaxaca said.

The Jan. 26, 2005, disaster in suburban Glendale was triggered when Juan Alvarez parked a Jeep Cherokee on the tracks.

Retreat leader speaks out over sweat lodge deaths

LOS ANGELES — The self-help expert who led a spiritual retreat in Arizona where two people were overcome in a sweat lodge and later died has spoken out about the tragedy, saying it has left him "frustrated and confused."

At a seminar outside Los Angeles, James Arthur Ray broke down in tears as he addressed the deaths of Kirby Brown, 38, of Westtown, N.Y., and James Shore, 40, of Milwaukee.

Authorities say Brown, Shore and more than 50 other people attending the retreat near Sedona, Ariz., were crowded into a 415-square-foot sweat lodge during a two-hour period Thursday.

Brown and Shore died, and 19 others people were hurt. One remains in critical condition.

"This is the most difficult time I've ever faced," Ray told a crowd of about 200 at a hotel in Marina del Rey Tuesday. "I don't know how to deal with it really."
